SUBMITTED BY: ALEXANDER, DAWN 0561 (AR13-7961) \tDID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATUTE, 322.34(1). ON 111313, I WAS DRIVING SOUTHBOUND ON NORTH SUNCOAST BOULEVARD IN THE AREA OF FT ISLAND TRAIL, WHEN I OBSERVED A SILVER SUBARU VEHICLE BEARING FLORIDA TAG, C746CA, DRIVING IN FRONT OF ME. THE VEHICLE SPED UP AS I FOLLOWED BEHIND IT WHILE PACING IT. THE VEHICLE GOT TO 62 MILES PER HOUR, WHERE THIS IS A POSTED 45 MILES PER HOUR ZONE. I ADVISED DISPATCH THAT I WOULD BE CONDUCTING A TRAFFIC STOP ON SAID VEHICLE AND ACTIVATED MY EMERGENCY OVERHEAD LIGHTS. THE VEHICLE THEN PULLED IN TO THE BEALLS PARKING LOT. I APPROACHED THE DRIVER AND ASKED FOR HIS PROOF OF INSURANCE, DRIVER'S LICENSE AND REGISTRATION. AT THAT TIME HE ADVISED ME THAT HIS LICENSE WAS SUSPENDED OUT OF WEST VIRGINIA DUE TO NOT PAYING A TRAFFIC TICKET. HE STATED THAT HE WAS WAITING UNTIL 111813, WHEN HE GOT HIS STUDENT LOANS, SO HE COULD PAY OFF THE WEST VIRGINIA TICKET. HE WAS ABLE TO PRODUCE A FLORIDA IDENTIFICATION CARD FOR THIS DEPUTY. I THEN ASKED THE DRIVER WHY HE WAS DRIVING WHEN HE KNEW HIS DRIVER'S LICENSE WAS SUSPENDED. HE STATED THAT HIS WIFE USUALLY DRIVES HIM BUT SHE WAS SICK TODAY AND HE HAD TO GO TO SCHOOL. I RETURNED TO MY PATROL VEHICLE AND RAN THE DEFENDANTâS WEST VIRGINIA DRIVER'S LICENSE, E792698, WHICH CAME BACK SHOWING IT AS SUSPENDED AND EXPIRED IN 2008. THE DRIVER/DEFENDANT, WHOSE NAME APPEARED ON HIS FLORIDA DRIVER'S LICENSE AS MR JAMES SAPP, DID NOT HAVE A FLORIDA DRIVERâS LICENSE EITHER, AND ONLY HAD A FLORIDA ISSUED IDENTIFICATION CARD. THE DEFENDANT WAS THEN PLACED UNDER ARREST FOR KNOWINGLY DRIVING ON A SUSPENDED DRIVER'S LICENSE. HE WAS HANDCUFFED (DOUBLE LOCKED), BEHIND HIS BACK, AND SECURED IN THE REAR OF MY PATROL VEHICLE FOR TRANSPORT TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANTâS VEHICLE WAS LEFT ON SCENE PER HIS REQUEST AFTER BEING SECURED IN HIS PRESENCE. UPON ARRIVAL AT THE DETENTION FACILITY, THE DEFENDANT WAS TURNED OVER TO DETENTION STAFF FOR PROCESSING, WHERE HIS BOND WAS SET AT $500.00. THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION, 7945FRY (3), FOR DRIVING ON A SUSPENDED DRIVERâS LICENSE WITH KNOWLEDGE, WITH A MANDATORY COURT APPEARANCE OF 120513 AT 1300 HOURS. THE DEFENDANT WAS ALSO ISSUED WARNING, 372436B, FOR UNLAWFUL SPEED WITH NO FINE. THE DEFENDANT HAS ONE WITHHOLD OF JUDICATION FOR DRIVING WHILE LICENSE SUSPENDED IN 2010. |
