SUBMITTED BY: RUBY, SAMUEL 0562 (AR10118402) DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: GRABBED THE VICTIM BY THE NECK AND SHOVED HER, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 121610, I WAS CONDUCTING ROUTINE PATROL OF SUNCOAST BOULEVARD, WHEN I OBSERVED TWO WHITE FEMALES WALKING NORTHBOUND NEAR EAGLE BUICK. I STOPPED AND MADE CONTACT WITH THE FEMALES. THE YOUNGEST FEMALE/VICTIM ADVISED THAT THE DEFENDANT, MR JAMES SYMONS, HAD GRABBED HER BY THE NECK AND SHOVED HER AGAINST THE PAPER BOX IN FRONT OF THE KANGAROO AT HIGHWAY 19 AND LONG FELLOW. SHE ADVISED THAT THEY HAD SHARED A TAXI CAB WHEN THE TAXI DRIVER MADE THEM GET OUT OF THE CAB DUE TO THEM ARGUING. WHILE IN FRONT OF THE KANGAROO THEY CONTINUED TO ARGUE, WHEN THE DEFENDANT GRABBED HER BY THE NECK AND PUSHED HER AGAINST THE PAPER BOX. SHE ADVISED THAT THE CLERK AT THE KANGAROO SAW THE INCIDENT AND ASKED IF SHE WANTED HER TO CALL 9-1-1. THE VICTIM STATED THAT SHE WAS AFRAID AND SHE AND HER FRIEND LEFT THE STORE WALKING NORTHBOUND. THE VICTIM REFUSED EMERGENCY MEDICAL SERVICES, AND I DID OBSERVE RED MARKS ON EACH SIDE OF THE VICTIM'S NECK. AT THAT TIME, I RESPONDED TO THE KANGAROO AND MADE CONTACT WITH THE DEFENDANT. WHEN I ASKED THE DEFENDANT WHAT HAPPENED, HE STATED THAT HE PAID FOR A CAB TO TAKE HIM HOME OFF OF GROVER CLEVELAND, AT WHICH TIME HE AND THE VICTIM WERE ARGUING AND THE CAB DRIVER MADE THEM GET OUT AT THE CAB. HE ADVISED THAT THE VICTIM GOT IN HIS FACE WHEN HE SHOVED HER AGAINST THE PAPER BOX. WRITTEN STATEMENTS WERE COMPLETED BY THE VICTIM AND WITNESS AND TURNED IN TO THE CITRUS COUNTY SHERIFF'S OFFICE RECORDS DEPARTMENT. THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED (DOUBLE-LOCKED) BEHIND THE BACK AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE.
