SUBMITTED BY: WILSON, JAMES 0707 (AR10117985) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, WAL-MART SUPERCENTER, TO WIT: A SCARFACE DIGITAL VIDEO DISC (DVD), A PAIR OF BOXER UNDERWEAR, A MEN'S T-SHIRT, A JERSEY, A KNIT CAP AND A MISCELLANEOUS PIECE OF CLOTHING, SAID PROPERTY BEING OF A VALUE OF $65.50, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTE 812.014(3)(a). IT IS UNLAWFUL FOR A PERSON WHO HAS BEEN ARRESTED OR LAWFULLY DETAINED BY A LAW ENFORCEMENT OFFICER TO GIVE A FALSE NAME, OR OTHERWISE FALSELY IDENTIFY HIMSELF OR HERSELF IN ANY WAY, TO THE LAW ENFORCEMENT OFFICER OR ANY COUNTY JAIL PERSONNEL, IN VIOLATION OF FLORIDA STATE STATUTE 901.36. ON 111810, THE DEFENDANT, MR JAMES THOMAS TIMMERMAN JR, WAS PLACED UNDER ARREST FOR CONCEALING AND ATTEMPTING TO LEAVE WAL-MART WITH $65.50 WORTH OF STOLEN MISCELLANEOUS ITEMS. AFTER THE DEFENDANT WAS PLACED UNDER ARREST HE WITNESSED HIS CO-DEFENDANT GAVE DEPUTY SCHAFFER HIS NAME AND INFORMATION. AT THAT TIME, THE CO-DEFENDANT GAVE THE NAME OF MR VICTOR THOMAS TIMMERMAN WITH A FALSE SOCIAL SECURITY NUMBER AND DATE OF BIRTH, HOWEVER AT NO TIME DURING THE INVESTIGATION OR THE TRANSPORT TO THE CITRUS COUNTY DETENTION FACILITY DID THE DEFENDANT CORRECT THE INFORMATION THAT WAS GIVEN TO US. UPON FURTHER INVESTIGATION OF HIS ACTUAL IDENTITY, IT WAS DISCOVERED THAT THE DEFENDANT HAD AN ACTIVE CITRUS COUNTY WARRANT WHICH IS WHY HE DID NOT REVEAL HIS TRUE IDENTITY. AT THIS TIME, THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED) IN THE BACK, SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNT DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $250.00 PER THE BOND SCHEDULE FOR THE RETAIL PETIT THEFT AND $500 PER THE BOND SCHEDULE FOR GIVING FALSE INFORMATION TO LAW ENFORCEMENT.
