Probable cause affidavit: SUBMITTED BY: MULLINS, MARVIN 0493 (AR14-12305AR) DID UNLAWFULLY, WILLFULLY AND MALICIOUSLY INJURE OR DAMAGE CERTAIN PROPERTY OF THE VICTIM, TO-WIT: THE DEFENDANT STABBED A HOLE IN THE SIDE WALL OF THE VICTIM'S PASSENGER REAR TIRE, SAID DAMAGE BEING OF A VALUE OF $200.00 OR LESS, IN VIOLATION OF FLORIDA STATUTE 806.13(1)(B)1. ON 100914 AT APPROXIMATELY 1602 HOURS, I WAS DISPATCHED TO THE DOLLAR GENERAL, LOCATED AT 8495 EAST GULF TO LAKE HIGHWAY, IN INVERNESS, IN REFERENCE TO THE VICTIM'S TIRE BEING SLASHED. WHILE EN ROUTE, I WAS ADVISED OF A SUSPECT DESCRIPTION OF A WHITE MALE, WEARING A T-SHIRT, LONG PANTS, AND CARRYING A BLUE BACKPACK AND HE WAS WALKING WEST. AS I APPROACHED THE INTERSECTION OF HIGHWAY 44 AND TRANQUIL POINT, I OBSERVED A SUBJECT WHO MATCHED THE DESCRIPTION. ALSO, DISPATCH ADVISED THAT THE VICTIM KNEW THE SUSPECT AND ADVISED HIS NAME WAS MR JAMES TRICKEL. I PULLED IN BEHIND THE SUBJECT WHO WAS WALKING WEST AT THE INTERSECTION AND I EXITED MY PATROL VEHICLE. THE SUBJECT IMMEDIATELY TURNED AROUND, BEGAN WALKING TOWARDS ME, AND ADVISED THE HE KNEW WHY I WAS THERE. I ASKED HIM IF HIS NAME WAS JAMES AND HE STATED YES. I ASKED HIM TO EXPLAIN WHAT WAS GOING ON AND HE ADVISED THAT HE WAS RIDING IN THE VICTIM'S TRUCK HOME FROM A JOB SIGHT IN THE VILLAGES AND HE WAS ARGUING WITH THE VICTIM. THE VICTIM TOLD THE DEFENDANT THAT HE WAS GOING TO DROP HIM OFF AT THE NEAREST BUSINESS AND MAKE HIM WALK HOME. THE DEFENDANT ADVISED THAT HE TOLD THE VICTIM THAT IF HE KICKED HIM OUT OF HIS TRUCK THAT HE WAS GOING TO SLASH HIS TIRES. THE VICTIM THEN PULLED IN TO THE DOLLAR GENERAL ON HIGHWAY 44 EAST AND ADVISED THE DEFENDANT THAT HE WAS GOING INSIDE TO USE THE RESTROOM AND THAT THE DEFENDANT NEEDED TO START WALKING HOME. THE DEFENDANT STATED TO ME THAT WHILE THE VICTIM WAS INSIDE THE BUSINESS HE USED HIS POCKET KNIFE AND STABBED THE SIDE WALL OF THE PASSENGER REAR TIRE, ONE TIME, WHICH CAUSED IT TO DEFLATE. THE DEFENDANT ADVISED THAT AT THAT TIME, HE BEGAN WALKING WESTBOUND. AT THAT TIME, I ASKED THE DEFENDANT IF HE WOULD RIDE WITH ME BACK TO THE DOLLAR GENERAL SO I COULD MAKE CONTACT WITH THE VICTIM. THE DEFENDANT ADVISED THAT HE WOULD, AT WHICH TIME I ASKED HIM IF I COULD SEARCH HIS PERSON FOR ANY WEAPONS. THE DEFENDANT ADVISED THAT HE HAD A COUPLE OF KNIVES ON HIM AND BECAUSE ONE WAS ATTACHED TO HIS BELT, I ADVISED THE DEFENDANT THAT I WAS GOING TO PLACE HIM IN HANDCUFFS BEHIND HIS BACK, SO I COULD SECURE ALL OF HIS WEAPONS. WHILE I WAS DOING THIS, THE DEFENDANT STATED THAT HE THREW ONE KNIFE BEHIND A TREE LINE JUST WEST OF THE DOLLAR GENERAL, WHICH WAS THE KNIFE HE USED TO SLASH THE TIRE. I AGAIN ASKED THE DEFENDANT IF HE WOULD RIDE WITH ME BACK TO THE DOLLAR GENERAL AND TO POSSIBLY FIND THE KNIFE, AND HE ADVISED THAT HE WOULD. AT THAT TIME, I PLACED THE DEFENDANT IN HANDCUFFS, (DOUBLE LOCKED) BEHIND HIS BACK, AND PLACED HIM IN THE REAR SEAT OF MY PATROL VEHICLE. I DID NOT ASK HIM ANY FURTHER QUESTIONS PERTAINING TO THE CASE. AT THAT TIME, I RESPONDED BACK TO THE DOLLAR GENERAL, WHERE I MADE CONTACT WITH THE VICTIM. THE VICTIM ADVISED THAT THE DEFENDANT AND HE WERE IN THE TRUCK ON THEIR WAY HOME FROM A JOB SIGHT IN THE VILLAGES WHEN THEY BEGAN ARGUING. THE VICTIM ADVISED THAT HE TOLD THE DEFENDANT HE WAS GOING TO KICK HIM OUT OF HIS TRUCK WHEN THEY REACHED THE DOLLAR GENERAL AND MAKE HIM WALK HOME. HE ADVISED THAT THE DEFENDANT TOLD HIM IF HE KICKED HIM OUT OF THE TRUCK THAT HE WOULD SLASH HIS TIRES; HOWEVER, THE VICTIM STILL STOPPED AT THE DOLLAR GENERAL. THE VICTIM ADVISED THAT HE WENT INSIDE TO USE THE RESTROOM AND WHEN HE CAME OUT HE NOTICED HIS PASSENGER REAR TIRE HAD BEEN SLASHED AND HE SAW THE DEFENDANT WALKING WESTBOUND ON HIGHWAY 44. AT THAT TIME, I OBSERVED THE TIRE, WHICH HAD AN APPROXIMATE INCH AND A HALF LACERATION IN THE SIDE WALL, WHICH WAS CONSISTENT WITH BEING STABBED WITH A KNIFE. I ASKED THE VICTIM IF HE WANTED TO PURSUE CHARGES AND HE ADVISED HE DID. I RESEARCHED THE PRICE OF THE TIRE, WHICH IS A BF GOODRICH LONG TRAIL T/A (P235 75R15) AND IT APPEARED THAT THE TIRE IS VALUED AT APPROXIMATELY $138.00. THE VICTIM WAS PROVIDED WITH AN AGENCY CASE CARD BEARING MY NAME AND THE CASE NUMBER AND I ADVISED HIM THAT WHEN HE REPLACED THE TIRE TO KEEP THE RECEIPT. AT THAT TIME, I ADVISED THE DEFENDANT THAT I WAS PLACING HIM UNDER ARREST FOR CRIMINAL MISCHIEF AND I TRANSPORTED HIM TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. WHILE EN ROUTE TO THE CITRUS COUNTY DETENTION FACILITY I PULLED OVER IN THE AREA WHERE THE DEFENDANT ADVISED HE THREW THE KNIFE, WHICH PREVIOUSLY HE HAD DESCRIBED AS A DARK SCHRADE FOLDING POCKET KNIFE. WHEN I LOOKED JUST BEYOND THE TREE LINE, I OBSERVED THE DEFENDANT'S KNIFE SITTING ON TOP OF THE GRASS. I COLLECTED THE KNIFE, WHICH WILL BE TURNED IN TO EVIDENCE. THE DEFENDANT'S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE.
