Probable cause affidavit: SUBMITTED BY: DERA, MARK 0688 (AR13-4705) DID, KNOWING HIS DRIVER’S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). ON 030113, WHILE CONDUCTING TRAFFIC ENFORCEMENT ON US HIGHWAY 19 IN THE CITY OF CRYSTAL RIVER, I OBSERVED A SILVER IN COLOR, CHEVROLET PICKUP TRUCK WITH A FLORIDA LICENSE PLATE NUMBER OF K946RY, TO BE TRAVELING NORTH BOUND ON US HIGHWAY 19. I OBSERVED THAT THIS VEHICLE HAD AN INOPERATIVE TAG LIGHT, WHICH RENDERED THE TAG UNREADABLE. I THEN ACTIVATED MY OVERHEAD EMERGENCY LIGHTS, AND INITIATED A TRAFFIC STOP ON SAID VEHICLE, AT THE HAYES HOTEL, LOCATED T 1151 NW US HIGHWAY 19. I THEN MADE CONTACT WITH THE DRIVER OF THE VEHICLE, LATER IDENTIFIED AS THE DEFENDANT, MR JAMES EARL WILLIAMS. I ADVISED HIM OF THE INFRACTION AND REASON FOR MY TRAFFIC STOP. HE THEN PROVIDED ME WITH HIS FLORIDA DRIVER'S LICENSE, AS WELL AS HIS PROOF OF INSURANCE AND VEHICLE REGISTRATION. I THEN RETURNED TO MY VEHICLE, AND RAN THE DEFENDANT’S INFORMATION THROUGH FCIC/NCIC VIA TELETYPE, WHICH REVEALED THAT THE DEFENDANT’S DRIVER'S LICENSE HAD BEEN SUSPENDED INDEFINITELY, ON 110310, FOR FAILURE TO PAY TRAFFIC FINES, WITH NOTICE GIVEN ON 111410. I THEN RETURNED TO THE DEFENDANT’S VEHICLE, AND ADVISED HIM OF MY FINDINGS. AT FIRST, THE DEFENDANT DENIED KNOWING ABOUT THIS, BUT LATER ADMITTED THAT HE HAD NOT PAID A FEW TRAFFIC FINES. I THEN ADVISED THE DEFENDANT THAT HE WAS BEING PLACED UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED. HE WAS HANDCUFFED, DOUBLE LOCKED BEHIND HIS BACK, AND SECURED IN THE REAR OF MY PATROL VEHICLE. I THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY UPON HIS ARRIVAL, HE WAS RELEASED TO DETENTION FACILITY STAFF FOR BOOKING AND PROCESSING. THE DEFENDANT’S VEHICLE WAS TURNED OVER TO HIS WIFE, PER HIS REQUEST. THE DEFENDANT WAS CHARGED WITH ONE COUNT OF DRIVING ON A SUSPENDED DRIVER’S LICENSE, WITH HIS BOND SET AT $500.00, PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED FLORIDA UNIFORM TRAFFIC CITATION, CITATION NUMBER 6778GQF1, FOR DRIVING WHILE LICENSE SUSPENDED, WITH A MANDATORY COURT DATE OF 032113, AT 1300 HOURS. THE DEFENDANT WAS ALSO ISSUED TWO CITRUS COUNTY SHERIFF'S OFFICE WRITTEN WARNINGS, WARNING NUMBER 360534B, FOR DEFECTIVE TAG LIGHT; AND WARNING NUMBER 360536B, FOR FAILURE TO CHANGE ADDRESS ON DRIVER'S LICENSE WITHIN TEN DAYS OF CHANGE OF ADDRESS.
