Probable cause affidavit: | SUBMITTED BY LAKATIS, KENNETH 0585 (AR12-2877) DID UNLAWFULLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A PIPE AND BURT TINFOIL, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) ON 092012 WHILE TRAVELING ON SOUTHERLY AVENUE NEAR THE INTERSECTION OF EDEN DRIVE I OBSERVED A RED DODGE VEHICLE. AS THE VEHICLE TURNED ONTO SOUTHERLY AVENUE I NOTICED THAT THE DRIVER, MS JAMIKAY BINNING, WAS NOT WEARING HER SAFETY BELT AS SHE WAS LEANING FORWARD WHILE ATTEMPTING TO LIGHT A CIGARETTE. HER VEHICLE PASSED ME AND I TURNED AROUND AND FOLLOWED IT TO THE INTERSECTION OF SOUTHERLY AVENUE AND SPRUCE STREET WHERE I INITIATED A TRAFFIC STOP. UPON THE VEHICLE STOPPING I MADE CONTACT WITH THE DRIVER, JAMIKAY BINNING. I EXPLAINED WHY HAD STOPPED HER AND ASKED HER FOR HER LICENSE AND THE REGISTRATION FOR THE VEHICLE. WHILE SHE WAS LOOKING FOR THE INFORMATION I ALSO GATHERED THE PASSENGERSâ, MR SEAN MCCORMICK INFORMATION. WHILE GATHERING HIS INFORMATION I NOTICED BINNING FIDGETING WITH THE CENTER CONSOLE AS WELL AS HER PURSE. I THEN WENT BACK OVER TO BINNING AND RETRIEVED HER LICENSE. I THEN ASKED HER IF THERE WAS ANY ILLEGAL NARCOTICS IN THE VEHICLE. SHE SAID NO. I THEN RAN HER AND HER PASSENGERâS INFORMATION THROUGH TELETYPE FOR WANTS AND WARRANTS. I THEN COMPLETED A WRITTEN WARNING FOR BINNING FOR NOT WEARING SAFETY BELT. I THEN HAD HER STEP FROM HER VEHICLE WHERE SHE SIGNED THE WARNING. HAVE COMPLETING THE WARNING AND HANDING IT TO HER I ASKED IF SHE MINDED IF I LOOKED THROUGH HER CAR TO VERIFY THERE WERE NO ILLEGAL NARCOTICS. BINNING SHRUGGED HER SHOULDERS AND SAID THAT SHE DID NOT CARE. SHE THEN QUICKLY WENT BACK TO HER CAR WHERE SHE AGAIN WHEN INTO THE CENTER CONSOLE AND THEN GRABBED HER PURSE AS IF SHE LOOKING FOR SOMETHING. WHEN I ASKED HER ABOUT HER NERVOUS BEHAVIOR SHE SAID THAT SHE HAD A BRILLO-PAD IN HER VEHICLE AND DID NOT WANT US TO THINK SHE WAS USING FOR SMOKING CRACK COCAINE. AS SHE WAS TELLING ME THIS SHE STILL WAS GRASPING HER PURSE AS IF THERE WAS SOMETHING IN THERE THAT SHE DID NOT WANT ME TO SEE. I TOLD HER THAT I DID NOT THINK SHE WAS BEING HONEST AND BELIEVED THAT SHE WAS HIDING SOMETHING IN HER PURSE. BINNING STARTED CRYING AND REACHED INTO HER PURSE WHERE SHE RETRIEVED A MULTI-COLORED PIPE. SHE STATED THAT IT WAS HER FRIENDS AND IT WAS USED TO SMOKE MARIJUANA. STILL BELIEVING THAT SHE WAS NOT BEING COMPLETELY HONEST WITH I ASKED HER TO SEE INSIDE HER PURSE. AS I DID I DISCOVERED SEVERAL PIECES OF BURNT TIN-FOIL AND STRAWS WHICH WERE CUT. DO TO MY TRAINING AND EXPERIENCE I KNEW THAT THIS TYPE OF PARAPHERNALIA WAS USED TO SMOKE NARCOTIC PAIN PILLS. AFTER COLLECTING THOSE ITEMS A COMPLETING A SEARCH OF HER VEHICLE BINNING WAS READ MIRANDA VIA PRE-PRINTED CARD. BINNING SAID SHE UNDERSTOOD HER RIGHTS AND WOULD TALK TO ME. I ASKED HER WHAT THE ITEMS I FOUND IN HER PURSE WERE FOR. SHE SAID SMOKING PAIN PILLS. I THEN ASKED HER IF SHE HAD A PRESCRIPTION FOR PAIN PILLS. SHE SAID NO. I THEN ASKED HER IF SHE HAD SMOKED MARIJUANA OUT OF THE PIPE. SHE SAID SHE HAD. AT THAT TIME I INFORMED HER THAT SHE WAS BEING PLACED UNDER ARREST FOR POSSESSION OF DRUG PARAPHERNALIA. SHE WAS ISSUED A MISDEMEANOR CITATION, CITATION NUMBER 17860 WITH A MANDATORY COURT DATE OF OCTOBER 4TH 2012 AT THE CITRUS COUNTY COURT HOUSE. THE DEFENDANT SIGNED THE CITATION AND WAS RELEASED WITH OUT FURTHER INCIDENT. THE CONTRABAND WAS PLACED INTO EVIDENCE PER THE CITRUS COUNTY SHERIFF OFFICE POLICY AND PROCEDURES. |
