| Probable cause affidavit: | SUBMITTED BY: SKINNER, RODNEY 0563 (AR10115778) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, CITGO GAS STATION, TO WIT: ONE POPSICLE AND ONE 2 OZ FOLGERS COFFEE , SAID PROPERTY BEING OF A VALUE OF $4.38 WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HER OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTE 812.014(3)(C). ON 071110 AT APPROXIMATELY 1730 HOURS, I RESPONDED TO THE CITGO GAS STATION LOCATED AT 7810 SOUTH FLORIDA AVENUE IN FLORAL CITY IN REFERENCE TO A THEFT THAT HAD ALREADY OCCURRED. WHILE ENROUTE, DISPATCH ADVISED THAT THE STORE MANAGER HAD AN ADULT FEMALE DETAINED. UPON ARRIVAL I MADE CONTACT WITH THE STORE MANAGER/COMPLAINANT WHO STATED THAT ON 071110 AT APPROXIMATELY 1700 HOURS THE DEFENDANT, MS JANET INGALLS, HAD COME IN TO THE STORE AND ASKED HOW MUCH A PACK OF CIGARETTES COST. THE COMPLAINANT STATED HE BECAME SUSPICIOUS OF THE DEFENDANT; BECAUSE SHE WAS LOOKING AROUND ALLOT WHILE WALKING THROUGH THE STORE, SO HE PLACED HER UNDER OBSERVATION. THE COMPLAINANT ADVISED A FEW MINUTES LATER HE WENT IN TO THE STORE'S SECURITY OFFICE AND STARTED MONITORING THE DEFENDANT'S MOVEMENTS ON THE VIDEO SURVEILLANCE CAMERA. THE COMPLAINANT OBSERVED THE DEFENDANT WALK IN TO ONE OF THE ISLES AND TOOK A TWO OUNCE FOLGERS COFFEE CONTAINER VALUED AT $3.39 OFF THE DISPLAY SHELF AND CONCEAL THE ITEM IN HER LARGE HANDBAG. THE COMPLAINANT CONTINUED TO MONITOR THE DEFENDANT AS SHE WALKED AROUND THE STORE SOME MORE. THE DEFENDANT THEN OPENED THE ICE CREAM COOLER AND TOOK AN ICE CREAM BAR AND THEN WALKED AROUND THE STORE WITH THE ICE CREAM BAR IN HER HAND. THE COMPLAINANT CONTINUED OBSERVING THE DEFENDANT UNTIL SHE WALKED TO THE BACK OF THE STORE AND THEN HE THEN OBSERVED HER PLACE THE ICE CREAM BAR IN HER HANDBAG. the COMPLAINANT ADVISED THAT HE LEFT THE SECURITY ROOM AND WALKED BACK TO THE CASH REGISTER. THE DEFENDANT BEGAN WALKING AROUND THE STORE SOME MORE AND EVENTUALLY APPROACHED THE CHECK OUT COUNTER. THE DEFENDANT PLACED HER HANDBAG ON TOP OF THE COUNTER AND PAID FOR A BAG OF PEANUTS. AT THAT TIME, THE COMPLAINANT COULD OBSERVE THE ICE CREAM BAR INSIDE THE HANDBAG. THE COMPLAINANT CONFRONTED THE DEFENDANT ABOUT THE ITEMS SHE HAD CONCEALED IN HER HANDBAG. THE COMPLAINANT ADVISED THAT THE DEFENDANT DENIED TAKING THE ITEMS AND SHE THEN STARTED WALK PAST THE CHECK OUT COUNTER. THE COMPLAINANT TOLD THE DEFENDANT THAT SHE WOULD HAVE TO WAIT AS HE WAS CALLING LAW ENFORCEMENT. THE COMPLAINANT ADVISED THAT THE DEFENDANT WAS COOPERATIVE AND WAITED UNTIL LAW ENFORCEMENT ARRIVED ON SCENE. THIS DEPUTY DID VIEW THE VIDEO SURVEILLANCE AND I OBSERVED THE DEFENDANT CONCEALING THE ITEMS IN THE HANDBAG. THE VIDEO SHOWED THAT THE DEFENDANT MOVEMENTS CONCURRED WITH THE COMPLAINANT'S STATEMENTS. THE COMPLAINANT STATED HE WOULD DOWNLOAD THE VIDEO SURVEILLANCE ON DIGITAL VIDEO DISC (DVD) AND CONTACT THIS AGENCY WHEN IT WAS READY TO BE PICKED UP. THE COMPLAINANT DID PROVIDE A SWORN WRITTEN STATEMENT THAT WAS TURNED IN TO THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO) RECORDS DIVISION. CONTACT WAS MADE WITH THE DEFENDANT. SHE WAS READ HER MIRANDA WARNING FROM A PREPRINTED CARD. THE DEFENDANT ADVISED THAT SHE UNDERSTOOD AND WANTED TO INVOKE HER RIGHTS AND NOT MAKE ANY STATEMENTS REGARDING THIS INCIDENT. THE DEFENDANT DID STATE THAT SHE HAD BEEN ARRESTED IN PINELLAS COUNTY FOR GRAND THEFT BUT THAT WAS THE ONLY TIME THAT SHE HAD BEEN IN TROUBLE. THE DEFENDANT WAS PLACED UNDER ARREST. THE DEFENDANT WAS NOT HANDCUFFED DUE TO HAVING A LARGE CIST ON HER RIGHT WRIST, SHE WAS THEN PLACED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY (CCJ) AND UPON ARRIVAL WAS TURNED OVER TO STAFF FOR BOOKING AND PROCESSING. WHILE AT THE DETENTION FACILITY, THE DEFENDANT'S INFORMATION WAS RUN THROUGH FCIC/NCIC FOR A CRIMINAL HISTORY; WHICH, REVEALED NUMEROUS ARRESTS IN PINELLAS AND PASCO COUNTY. THE DEFENDANT HAD TWO PRIOR CONVICTIONS ON HER RECORD FOR GRAND THEFT WITH DISPOSITION DATE OF 042909 AND RETAIL/PETIT THEFT WITH A DISPOSITION DATE OF 020810 IN PINELLAS COUNTY.
