SUBMITTED BY: HOLLOWAY, WILLIAM 0463 (AR11121035) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: AIR CONDITIONING CONDENSERS AND COILS OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN TWENTY THOUSAND DOLLARS ($20,000.00), WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA'S STATE STATUTE 812.014(2)(C)(1). did unlawfully traffic in or endeavor to traffic in property that THE DEFENDANT knew or should have known was stolen, to-wit: AIR CONDITIONING CONDENSERS AND COILS, the property of THE VICTIM, in violation of Florida'S STATE Statute 812.019(2). Any person who knowingly gives false verification of ownership or who gives a false or altered identification and who receives money or other consideration from a secondary metals recycler, in return for regulated metals, AND THE value of the money or other consideration received is less than $300.00, IN VIOLATION OF FLORIDA'S STATE STATUTE 538.23(3)(A). Any person who knowingly gives false verification of ownership or who gives a false or altered identification and who receives money or other consideration from a secondary metals recycler, in return for regulated metals, AND THE value of the money or other consideration received is MORE than $300.00, IN VIOLATION OF FLORIDA STATE STATUTE 538.23(3)(B). ON 052911 A GRAND THEFT WAS REPORTED AT 41 SOUTH WINTERSET AVENUE IN CRYSTAL RIVER. DURING THE GRAND THEFT, DEFENDANT ONE, MR KYLE WEAVER, ALONG WITH ANOTHER SUBJECT CLIMBED OVER A LOCKED GATED FENCE AND STRIPPED THE COILS AND CONDENSERS FROM UP TO TWELVE AIR CONDITIONING UNITS THAT WERE STORED ON THE PROPERTY. DEFENDANT TWO, MS JANIE FUDGE, WOULD DROP DEFENDANT ONE AND A SECOND SUBJECT OFF AND WAIT AT THE STREET TO BE CALLED SO THEY COULD LOAD THE STOLEN ITEMS INTO DEFENDANT ONE'S TRUCK. THE VICTIM STATED THAT THESE UNITS ARE NOW RUINED AND BEYOND REPAIR AND THEY WERE SPECIALIZED UNITS AND AS FAR AS HE KNOWS THEY ARE NOT MADE ANYMORE. THE VICTIM WAS ASKED HOW MUCH THE AIR CONDITIONING UNITS WERE WORTH IN USED CONDITION, TO WHICH HE ADVISED APPROXIMATELY $900.00 EACH. ON 053111 AFTER REVIEWING THE REPORT, I RESPONDED TO A CITRUS COUNTY SECOND HAND METAL RECYCLER. I ASKED THE MANAGER IF ANYONE HAD SCRAPPED ITEMS THAT WERE SIMILAR TO THIS REPORT, TO WHICH HE STATED YES AND PRODUCED SEVERAL TRANSACTION FORMS WITH DEFENDANT ONE'S NAME AND DEFENDANT TWO'S NAME AND A THIRD PERSON WHO HAS NOT BEEN LOCATED AT THIS TIME. THE MANAGER ALSO SHOWED ME A STACK OF AIR CONDITIONING CONDENSERS WITH SOME OF THEM HAVING SPRAY PAINT THAT WAS MARKED BY THE VICTIM AND NOTATED IN THE ORIGINAL REPORT. DEPUTY PARSONS, DEPUTY LAKATIS AND I THEN RESPONDED TO THE DEFENDANT'S ADDRESS. INITIALLY THE DEFENDANT WAS NOT HOME, BUT OUTSIDE THE DOOR THERE WAS A PLASTIC GARBAGE CAN THAT CONTAINED THE END PIECES THAT WERE CUT OFF THE CONDENSERS AND THE COILS OF THE AIR CONDITIONING UNITS. LATER CONTACT WAS MADE WITH THE DEFENDANT AND CO-DEFENDANT. BOTH WERE READ THEIR MIRANDA WARNINGS VIA PREPRINTED CARD AND AGREED TO SPEAK TO THIS DEPUTY. BOTH SUBJECTS DURING A DIGITALLY RECORDED INTERVIEW ADMITTED TO THEIR PART IN THE GRAND THEFT AND DEALING IN STOLEN PROPERTY AND GIVING FALSE INFORMATION TO A SECOND HAND RECYCLER. DEFENDANT TWO WAS RELEASED ON HER OWN RECOGNIZANCE FOR ALL CHARGES.
