Probable cause affidavit: | SUBMITTED BY: VICK, BRYAN 0684 (AR12-784) THE DEFENDANT DID UNLAWFULLY AND KNOWINGLY SELL, MANUFACTURE OR DELIVER OR POSSESS WITH THE INTENT TO CAUSE TO BE SOLD, MANUFACTURED OR DELIVERED, A CONTROLLED SUBSTANCE, TO WIT: SEVEN CANNABIS PLANTS IN POTS, IN VIOLATION OF FLORIDA STATE STATUTES 893.13(1)(A)(1) AND 893.13(1)(A)2. ON 041212 AT APPROXIMATELY 0300 HOURS, WHILE AT THE CIRCLE K CONVENIENCE STORE LOCATED AT US HIGHWAY 19 AND WEST CARDINAL STREET IN HOMOSASSA, A STORE CLERK SHOWED ME A CELLULAR TELEPHONE AND ADVISED THAT A CUSTOMER HAD LOST IT IN THE STORE. THE CLERK ASKED IF I WISHED TO BROWSE THE PHONE IN AN ATTEMPT TO LOCATE THE OWNERâS INFORMATION. INITIALLY, I WAS NOT ABLE TO LOCATE A NAME, HOWEVER, IN THE PHOTOGRAPHS, I OBSERVED SEVERAL PICTURES OF THE DEFENDANT, LATER IDENTIFIED AS MR JASON ANGER, AS WELL AS SEVERAL PHOTOGRAPHS OF MARIJUANA PLANTS. I CONTINUED LOOKING THROUGH THE DEFENDANTâS CELLULAR TELEPHONE UNTIL I WAS ABLE TO LOCATE THE OWNERâS NAME. AT THAT TIME, THE DEFENDANT RETURNED TO THE STORE AND ADVISED THAT THE LOST CELLULAR TELEPHONE WAS HIS. I RECOGNIZED THE DEFENDANT AS THE SUBJECT IN THE PHOTOGRAPHS. DUE TO THE LATE HOUR, I CHOSE TO WAIT TO PURSUE THE POSSIBLE NARCOTICS INVESTIGATION. ON 041612, I RESPONDED TO THE DEFENDANTâS RESIDENCE LOCATED AT 6629 WEST CARDINAL STREET IN HOMOSASSA IN REFERENCE TO A KNOCK AND TALK INVESTIGATION. UPON ARRIVAL, I WAS ADVISED THAT THE DEFENDANT WAS NOT AT HOME BUT WOULD BE RETURNING SHORTLY. CANINE DEPUTY RITLI AND I THEN LEFT THE DEFENDANTâS PROPERTY VIA A TRAIL THAT LEADS TO A RETENTION POND AND VACANT PROPERTY. UPON LEAVING THE DEFENDANTâS PROPERTY, I LOCATED SEVEN CANNABIS PLANTS IN POTS WHICH WERE PHOTOGRAPHED AND COLLECTED. THE POTS WERE NOT ABLE TO BE FINGERPRINTED DUE TO THEM BEING VERY DIRTY. SHORTLY THEREAFTER, THE DEFENDANT RETURNED HOME AND ASKED IF I could SPEAK WITH HIM. I ASKED THE DEFENDANT IF HE HAD ANY KNOWLEDGE OF THE CANNABIS PLANTS WHICH WERE LOCATED BEHIND HIS PROPERTY. HE ADVISED THAT THAT IS NOT HIS PROPERTY AND DENIED ANY KNOWLEDGE OF THE PLANTS BEING THERE. I EXPLAINED TO THE DEFENDANT WHAT HAD LED ME TO HIS RESIDENCE. THE DEFENDANT STATED THE CANNABIS PLANTS BELONGED TO SOMEONE ELSE BUT DID ADMIT KNOWLEDGE OF THEM BEING THERE. HE ALSO STATED THAT HIS FINGERPRINTS WOULD BE ON THE POTS AS HE HAD HELPED UNLOAD THEM FROM A TRUCK. I ADVISED THE DEFENDANT THAT I DID NOT BELIEVE HE WAS BEING COMPLETELY TRUTHFUL WITH ME. the DEFENDANT THEN STATED THAT A SUBJECT HAD GIVEN HIM THE PLANTS WHICH HE UNLOADED AND PLACED ON THE PROPERTY BEHIND HIS HOUSE. HE STATED HE KNEW IT WAS STUPID AND THAT HE SHOULD HAVE KNOWN BETTER. THE DEFENDANT DID APPEAR REMORSEFUL. THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK, SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. WHILE ON SCENE, THE DEFENDANT COMPLETED A SWORN WRITTEN STATEMENT WHICH WAS LATER TURNED IN TO RECORDS. UPON ARRIVAL AT THE DETENTION FACILITY, THE DEFENDANT WAS BOOKED AND RELEASED ON HIS OWN RECOGNIZANCE, DUE TO HIS COOPERATION. |
