SUBMITTED BY: POLLARD, RANDALL 0677 (AR11122945) NORTON, NICHOLAS 0758 THE DEFENDANT DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN STRUCTURE OR CURTILAGE THEREOF, TO-WIT: A SHED, LOCATED AT 9201 EAST FLORAL ACRES COURT IN FLORAL CITY, IN THE COUNTY AND STATE AFORESAID, THE PROPERTY OF THE VICTIM, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO-WIT: THEFT, IN VIOLATION OF FLORIDA STATUTE 810.02(4)(A) AND THE DEFENDANT DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO WIT: TOOLS, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: APPROXIMATELY ONE THOUSAND DOLLARS, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)C(1). ON 092811 AT APPROXIMATELY 2240 HOURS, I RESPONDED TO THE AREA OF SOUTH ISTACHATTA ROAD IN FLORAL CITY IN REFERENCE TO A RESIDENTIAL BURGLARY WHICH HAD JUST OCCURRED. WHILE EN ROUTE, DISPATCH ADVISED THAT THE COMPLAINANT HAD WITNESSED TWO MALE SUBJECTS BURGLARIZE THE RESIDENCE. DISPATCH ADVISED THAT THE NEIGHBOR PURSUED THE SUSPECT VEHICLE. DISPATCH ADVISED THE COMPLAINANT ADVISED THAT THE SUSPECT'S VEHICLE HIT A NEIGHBOR'S FENCE, THEN BACKED UP INTO THE COMPLAINANT'S VEHICLE. THE NEIGHBOR ADVISED DISPATCH THAT HE CONTINUED TO FOLLOW THE SUSPECT'S VEHICLE TO ITS FINAL RESTING POINT ON SOUTH ISTACHATTA ROAD, NORTH FROM THE INCIDENT LOCATION. UPON ARRIVAL, I SPOKE WITH THE COMPLAINANT, MR JOSEPH SCOZZAFARA, WHO STATED HE FREQUENTLY CHECKED THE RESIDENCE, PER THE VICTIM'S REQUEST, AND KNEW THAT NO ONE SHOULD BE AT THE RESIDENCE. HE STATED THE MEN FLED THE RESIDENCE, THAT THE VAN THEY WERE IN KNOCKED OVER A FENCE AND POPPED THE SUSPECT VEHICLE'S RIGHT FRONT TIRE AS HE PURSUED THE VAN. THE COMPLAINANT STATED THE VAN THEN BACKED IN TO HIS VEHICLE AND FLED AGAIN. THE VAN CONTINUED FOR APPROXIMATELY THREE QUARTERS OF A MILE TO SOUTH ISTACHATTA ROAD WHERE THE TWO WHITE MALE SUBJECTS FLED EAST IN TO A WOODED AREA TOWARD RAILS TO TRAILS. THE COMPLAINant advised HE DID NOT SEE THE DRIVER BUT THE PASSENGER OF THE VAN APPEARED TO BE A WHITE MALE, APPROXIMATELY 5'09" TALL WITH A THIN BUILD, DARK HAIR AND A SCRUFFY BEARD. I APPROACHED THE VEHICLE, A GOLD MINI-VAN BEARING FLORIDA TAG 218-MWD. I OBSERVED A RIGID SHOP-VACUUM AND MISCELLANEOUS OTHER ITEMS IN THE REAR STORAGE AREA OF THE VAN. I ALSO OBSERVED THAT THE FRONT DRIVER'S SIDE RIM WAS BARE AND THERE WERE VARIOUS DENTS ON THE VEHICLE WHICH APPEARED TO BE CONSISTENT WITH THE COMPLAINANT'S STATEMENT. I ALSO OBSERVED THE COMPLAINANT'S VEHICLE WHICH HAD SUSTAINED MINOR DAMAGE TO THE DRIVER SIDE HEADLIGHT AND SCRAPES TO THE DRIVER SIDE FRONT BUMPER. I FOLLOWED THE COMPLAINANT TO THE VICTIM'S RESIDENCE, LOCATED AT 9201 EAST FLORAL ACRES COURT IN FLORAL CITY. DEPUTY POLLARD AND I CLEARED THE RESIDENCE WHICH APPEARED TO HAVE BEEN RANSACKED. THE COMPLAINANT ADVISED THAT THE RESIDENCE HAD BEEN PREVIOUSLY BURGLARIZED AND HE WAS NOT SURE IF ANY PROPERTY HAD BEEN TAKEN THIS TIME FROM THE RESIDENCE. THE COMPLAINANT LED ME TO A SHED LOCATED ON THE SOUTH SIDE OF THE RESIDENCE WHERE ENTRY HAD BEEN MADE THROUGH THE FRONT AND ONLY DOOR WHICH HAD BEEN LEFT UNLOCKED. THE COMPLAINANT IMMEDIATELY ADVISED THAT A RED TOOLBOX, A RIGID SHOP-VACUUM, A SADDLE AND A COMPOUND MITER SAW HAD BEEN TAKEN. THE FRONT OF THE SHED WAS FACING EAST. THE COMPLAINANT ADVISED THAT THE TOOLBOX HAD BEEN LOCATED ON THE NORTHERN WALL OF THE SHED. THE COMPLAINANT ADVISED THE TOOLBOX WAS POSSIBLY A CRAFTSMAN BRAND TOOLBOX. THE SHOP-VACUUM HAD BEEN LOCATED ON THE WEST WALL. THE COMPLAINANT ADVISED HE KNEW THE BRAND WAS RIGID. THE COMPOUND MITER SAW HAD BEEN LOCATED ON THE FLOOR IN THE MIDDLE OF THE SHED. THE SHED WAS PROCESSED FOR LATENT FINGERPRINTS. SEE ID SERVICES REPORT. THE VICTIM WAS NOT ABLE TO BE CONTACTED AT THIS TIME. THE COMPLAINANT WAS ACTING ON HIS BEHALF AS HE WAS CARETAKER OF THE PROPERTY. A WRITTEN STATEMENT WAS COMPLETED BY THE COMPLAINANT AND LATER TURNED IN TO RECORDS. WHILE AT THE INCIDENT LOCATION, I WAS ADVISED BY CANINE DEPUTY ROWAND THAT TWO SUSPECTS HAD BEEN APPREHENDED IN THE WOOD LINE IN CLOSE PROXIMITY TO THE SUSPECT VEHICLE. DEFENDANT ONE WAS IDENTIFIED AS MR BRIAN SKUTA. DEFENDANT TWO WAS IDENTIFIED AS MR JASON KOZEVSKI. BOTH DEFENDANTS WERE TRANSPORTED TO CITRUS MEMORIAL HEALTH SYSTEM EMERGENCY ROOM AFTER THE CANINE APPREHENSION. DEFENDANT KOZEVSKI WAS READ HIS MIRANDA WARNINGS FROM A PREPRINTED AGENCY CARD, TO WHICH DEFENDANT KOZEVSKI WAIVED HIS RIGHTS AND GAVE A FULL CONFESSION TO DETECTIVE CONLEY. HE ADMITTED TO STEALING THE ITEMS, STATING HE WAS WITH DEFENDANT SKUTA AND THAT THAT WAS THEIR SECOND TRIP TO THE RESIDENCE ON 092811. DEFENDANT KOZEVSKI STATED DEFENDANT SKUTA HAD BEEN DRIVING THE VEHICLE. THE RED CRAFTSMAN TOOLBOX, WHICH THE COMPLAINANT STATED WAS MISSING, WAS LOCATED BY DEPUTY LAMBERT AT DEFENDANT KOZEVSKI'S RESIDENCE LOCATED AT 6633 EAST SUBURBAN LANE IN FLORAL CITY ALONG WITH A RYOBI WEED EATER WHICH HAD ALSO BEEN STOLEN FROM THE VICTIM'S SHED. DEFENDANT KOZEVSKI STATED THE TOOLBOX AND THE WEED EATER WERE STOLEN ON THEIR FIRST TRIP TO THE VICTIM'S RESIDENCE. AFTER MEDICAL CLEARANCE, DEFENDANT KOZEVSKI WAS HANDCUFFED (DOUBLE LOCKED) IN FRONT OF HIS PERSON, SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. DEFENDANT SKUTA WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY BY DEPUTY L CANFIELD. UPON ARRIVAL AT THE DETENTION FACILITY, DEFENDANT SKUTA AND DEFENDANT KOZEVSKI WERE PROCESSED AND HELD ON AN INDIVIDUAL TOTAL BOND OF $5,000.00, IN ACCORDANCE WITH THE BOND SCHEDULE.
