SUBMITTED BY: CARRERAS, JOSE 0481 (AR08103836) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: HAVING IN POSSESSION THE VICTIM'S DIRT BIKE WITHOUT PERMISSION OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)(C)(1). ON 061908, DEPUTY RAMOS WAS DISPATCHED TO 9329 NORTH UNICORN POINT IN DUNNELLON IN REFERENCE TO THE THEFT OF A DIRT BIKE. UPON ARRIVAL, DEPUTY RAMOS MADE CONTACT WITH THE COMPLAINANT, MR ROY KNOWLES, WHO ADVISED THAT UNKNOWN PERSON(S) TOOK HIS SON'S 2002 KAWASAKI DIRT BIKE. IT SHOULD BE NOTED THE COMPLAINANT STOPPED DEPUTY RAMOS AT THE INTERSECTION OF WEST CALVARY STREET AND NORTH UNICORN POINT, AT WHICH TIME, HE SHOWED DEPUTY RAMOS HIS TIRE MARKS OF THE DIRT BIKE AND THE SUSPECT'S VEHICLE. THE COMPLAINANT ADVISED DEPUTY RAMOS THE DIRT BIKE WAS PARKED IN FRONT OF THE RESIDENCE ON 061808, AT APPROXIMATELY 2330 HOURS. THE COMPLAINANT STATED WHEN HIS SON, THE VICTIM MR ANTHONY KNOWLES, WENT TO CHECK ON THE DIRT BIKE ON 061908 AT APPROXIMATELY 1045 HOURS THE VICTIM NOTICED IT WAS MISSING. THE COMPLAINANT STATED IT WAS NOT SECURED IN ANYWAY BUT JUST LEANING AGAINST THE TREE. ON 061908 AT APPROXIMATELY 0230 HOURS, I APPROACHED THE INTERSECTION NORTHBOUND WEST ANSON PLACE AND NORTH CITRUS SPRINGS BOULEVARD WHEN I OBSERVED A WHITE MALE RIDING A DIRT BIKE TRAVELING EAST BOUND FROM NORTH DELTONA BOULEVARD TOWARDS NORTH FLORIDA AVENUE. I ALSO OBSERVED A DARK COLORED VEHICLE FOLLOWING ALONGSIDE THE WHITE MALE ON THE DIRT BIKE TRAVELING EAST BOUND. AS THEY BOTH CROSSED MY DIRECTION I BEGAN TO FOLLOW THEM IN AN UNMARKED AGENCY VEHICLE TO OBSERVE WHERE THE SUBJECTS WERE TRAVELING TO. AT THAT TIME, I NOTIFIED DISPATCH OF THIS DISCOVERY AND REQUESTED ANY NEARBY BACKUP OFFICER TO RESPOND TO THE AREA OF NORTH FLORIDA AVENUE AND NORTH CITRUS SPRINGS BOULEVARD. UPON APPROACHING that INTERSECTION, I OBSERVED A WHITE MALE ON A GREEN AND WHITE KAWASAKI DIRT BIKE COME TO A COMPLETE STOP ON the CORNER OF NORTH FLORIDA AVENUE ON THE SOUTHBOUND SIDE. I THEN CONTINUED TO FOLLOW THE VEHICLE ACROSS THE INTERSECTION OF NORTH FLORIDA AND OBSERVED THE VEHICLE CONDUCE A U-TURN GOING BACK TOWARD THE WHITE MALE ON THE DIRT BIKE. I ALSO CONDUCTED A U-TURN FOLLOWING THAT VEHICLE ADVISING DISPATCH OF THE TAG NUMBER THEN APPROACHED THE WHITE MALE THAT WAS STOPPED ON THE DIRT BIKE ON THE CORNER OF NORTH FLORIDA AVENUE AND NORTH CITRUS SPRINGS BOULEVARD. I IDENTIFIED MYSELF TO THE WHITE MALE AS I WAS IN PLAIN CLOTHES AS A CITRUS COUNTY SHERIFF'S DEPUTY making MY AGENCY BADGE VISIBLE AND THEN REQUESTED HIS IDENTIFICATION. THE WHITE MALE HESITANTLY BEGAN SEARCHING FOR HIS IDENTIFICATION. AT WHICH TIME, THE VEHICLE THAT WAS FOLLOWING THIS SUBJECT APPROACHED US AND PARKED ON THE RIGHT SIDE BESIDE US. I REQUESTED THAT DRIVER'S IDENTIFICATION, WHO WAS LATER IDENTIFIED AS MR KENNETH WISE. UPON RECEIVING THE FIRST SUBJECT'S IDENTIFICATION HE WAS LATER IDENTIFIED AS MR JASON LAND. I THEN ASKED MR LAND WHAT WAS THE REASON FOR HIM RIDING THE DIRT BIKE ON the MAIN ROAD AND HE ADVISED THAT HE AND MR WISE WERE PICKING UP THE DIRT BIKE FROM MR WISE'S BROTHER'S HOUSE AND WERE TAKING IT BACK TO THEIR PLACE. MR LAND ADVISED THAT MR WISE WAS INITIALLY RIDING THE DIRT BIKE AND ENDED UP CRASHING INTO MR LAND'S VEHICLE AND GOT BRUISED UP IN SEVERAL AREAS. HE ADVISED DURING THAT TIME THEY SWITCHED PLACES AND HE THEN GOT ON THE BIKE TO DRIVE IT BACK. MR WISE ADVISED ME that HE WAS RIDING THE DIRT BIKE UNTIL HE CRASHED AT THE INTERSECTION AT NORTH CITRUS SPRINGS BOULEVARD AND NORTH ELKCAM BOULEVARD NEAR THE CHURCH. HE ADVISED HE CRASHED INTO THE REAR OF MR LAND'S VEHICLE. I OBSERVED SEVERAL FRESH SCRAPES ON MR WISE'S ELBOWS AND HANDS DUE TO THE ACCIDENT THAT HE ALLEGED. MR LAND ADVISED ME THAT THE VEHICLE BELONGED TO A SUBJECT NAMED AARON KIRSCHNER AND ADVISED THAT AARON WAS CURRENTLY INCARCERATED AND that THEY WERE WATCHING THE BIKE FOR HIM. MR LAND SHOWED ME THAT THE RIGHT SIDE OF THE HANDLE BAR WAS BANGED UP DUE TO THE CRASH THAT WAS CAUSED BY MR WISE. THE MOTORCYCLE APPEARED TO BE A DIRT BIKE, GREEN AND WHITE IN COLOR, WITH A FRONT PLATE ON THE HANDLE BARS WITH the NUMBER 148 ON IT. IT HAD A LOGO OF "TEAM CHEVY TRUCKS" ON the SIDE OF IT AND ON the SEAT IT HAD THE NAME "ONE INDUSTRIES". DEPUTY RUSS HOWARD ARRIVED ON SCENE DURING MY INITIAL CONTACT AND THE SCENE WAS TURNED OVER TO HIM. DEPUTY HOWARD COMPLETED A CRASH REPORT FOR THE ACCIDENT WITH THE INCIDENT NUMBER BEING 124189. ON 062208, AT 0040 HOURS, I RESPONDED TO 10235 NORTH ABBEY DRIVE IN REFERENCE TO MAKING CONTACT WITH THE DEFENDANT, MR JASON LAND. UPON ARRIVAL, I MADE CONTACT WITH DEFENDANT LAND AND ADVISED HIM OF THE REASON FOR MY PRESENCE AT WHICH TIME, HE ADVISED HE KNEW WHY I WAS THERE. I READ DEFENDANT LAND HIS MIRANDA WARNING AND HE ADVISED THAT HE UNDERSTOOD HIS RIGHTS AND STILL WISHED TO SPEAK WITH ME. HE FURTHER STATED THAT PRIOR TO OUR INITIAL CONTACT WHEN THIS DEPUTY SEEN HIM RIDING THE DIRT BIKE, HE WENT TO SEE HIS FRIEND, THE OWNER OF THE DIRT BIKE, SO that THEY COULD HANG OUT. WHILE AT the VICTIM'S RESIDENCE, HIS FRIEND, DEFENDANT WISE, ADVISED HIM OF THE DIRT BIKE THAT WAS ON the PROPERTY AND PERSUADED HIM TO TAKE IT OFF the PROPERTY. HE ADVISED THAT HIS VEHICLE WAS LEFT OUTSIDE the FRONT GATE OF the VICTIM'S PROPERTY WHILE HE AND DEFENDANT WISE PUSHED THE DIRT BIKE OUT TO WHERE the VEHICLE WAS. HE ADVISED THAT AS THEY PROCEEDED TO LEAVE the PROPERTY, DEFENDANT WISE WAS LATER INVOLVED IN AN ACCIDENT WHICH CAUSED DAMAGED TO the RIGHT SIDE OF THE DIRT BIKE WHILE RIDING the DIRT BIKE ON NORTH CITRUS SPRINGS BOULEVARD BY COUGAR PAW. HE ADVISED THAT AFTER the ACCIDENT, theY THEN SWITCHED PLACES WHERE DEFENDANT WISE DROVE the VEHICLE AND DROVE THE DIRT BIKE HEADING EASTBOUND ON NORTH CITRUS SPRINGS BOULEVARD. I THEN ADVISED DEFENDANT LAND THAT HE WAS BEING PLACED UNDER ARREST FOR THEFT OF the DIRT BIKE. DEFENDANT LAND WAS THEN HANDCUFFED (DOUBLE LOCKED) AND PLACED INTO THE REAR SEAT OF DEPUTY HAYNES PATROL VEHICLE. DEPUTY HAYNES THEN TRANSPORTED DEFENDANT LAND TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. IT SHOULD BE NOTED, DEFENDANT LAND COOPERATED AND PROVIDED A SIGNED SWORN WRITTEN STATEMENT WHILE AT THE DETENTION FACILITY. IT SHOULD ALSO BE NOTED THAT DEFENDANT WISE WAS ALSO ARRESTED WHERE HE LATER CONFESSED TO REMOVING THE DIRT BIKE WITH DEFENDANT LAND OFF OF THE VICTIMS PROPERTY WITHOUT PERMISSION. the DEFENDANT'S BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE. *NOT-EXEMPT* |
