SUBMITTED BY: LAKATIS, KENNETH 0585 (AR10117636) KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2). ON 102810 AT APPROXIMATELY 2115 HOURS, DEPUTY BERGEN AND I WERE TRAVELING SOUTH ON ROCK CRUSHER ROAD. AS WE WERE NEARING THE INTERSECTION OF ROCK CRUSHER ROAD AND WEST VENABLE STREET, A GREY FOUR DOOR PONTIAC PASSED US IN A NO PASSING ZONE WHICH WAS CLEARLY MARKED WITH A DOUBLE YELLOW LINE. DEPUTY BERGEN AND I THEN ACTIVATED THE EMERGENCY LIGHTS ON OUR UNMARKED PATROL VEHICLE AND PULLED THE PONTIAC OVER. UPON THE VEHICLE STOPPING, DEPUTY BERGEN MADE CONTACT WITH THE DRIVER/DEFENDANT, MR JASON WAMBLES, AND EXPLAINED THE REASON FOR THE TRAFFIC STOP. DEPUTY BERGEN REQUESTED HIS DRIVER'S LICENSE AND THE VEHICLE REGISTRATION. THE DEFENDANT STATED HE DID NOT HAVE A LICENSE. DEPUTY BERGEN ASKED HIM IF HE DID NOT HAVE IT ON HIM OR IF IT WAS SUSPENDED, TO WHICH THE DEFENDANT STATED HE BELIEVED HIS LICENSE WAS SUSPENDED. DEPUTY BERGEN ASKED THE DEFENDANT TO STEP OUT OF THE VEHICLE, AT WHICH TIME HE WAS SECURED IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK. THE DEFENDANT'S INFORMATION WAS THEN RUN THROUGH TELETYPE, AT WHICH TIME IT WAS CONFIRMED THAT THE DEFENDANT'S DRIVER'S LICENSE WAS SUSPENDED FOR FAILURE TO PAY CHILD SUPPORT. THE DEFENDANT WAS ADVISED HE WAS UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED, KNOWINGLY (DWLS) AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. UPON ARRIVAL, THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION NUMBER 0992-FIR4, FOR DWLS KNOWINGLY WITH A MANDATORY COURT APPEARANCE DATE OF 111810 AT 1300 HOURS THE CITRUS COUNTY COURTHOUSE. THE DEFENDANT'S BOND WAS SET AT $500.00, IN ACCORDANCE WITH THE BOND SCHEDULE.
