SUBMITTED BY: SEFFERN, JONATHAN 0623 (AR2012-1296)âââââ DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WINN DIXIE, STORE 2223, TO WIT: MULTIPLE PACKS OF BEER AND MISCELLANEOUS GROCERY ITEMS, BY CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY VALUED AT $115.25, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015, 812.014(1), AND 812.014(3)(A). ON 052312, AT 1748 HOURS, I RESPONDED TO 3792 SOUTH SUNCOAST BOULEVARD, WHICH IS THE WINN DIXIE STORE NUMBER 2223, IN HOMOSASSA. UPON ARRIVAL I MADE CONTACT WITH THE STORE MANAGER, MR TIMOTHY RICHARDS, WHO ADVISED THAT HE OBSERVED A WHITE MALE EXITING THE GROCERY STORE BETWEEN THE SERVICE DESK AND THE FIRST CASHIER LINE WITH A GROCERY CART FULL OF GROCERIES AND BEER. MR RICHARDS STATED THE CASHIER BEGAN YELLING AT HIM THAT HE HAD NOT PAID FOR THE GROCERIES; HOWEVER, THE WHITE MALE IGNORED HER AND PRETENDED HE WAS ON A CELLULAR TELEPHONE. HE STATED THE CASHIER YELLED AT THE SUBJECT MULTIPLE TIMES THAT HE NEEDED TO PAY FOR THE GROCERIES, AT WHICH TIME THE WHITE MALE SUSPECT RAISED A DEBIT CARD AND THEN EXITED THE STORE. MR RICHARDS STATED THAT HE PURSUED THE SUSPECT OUT OF THE STORE AND OBSERVED HIM TO THROW ALL OF THE GROCERIES AND BEER INTO THE BACK OF A WHITE PICKUP TRUCK AND THEN TAKE OFF ON FOOT. HE STATED WHEN THE WHITE MALE TOOK OFF ON FOOT, HE WAS STILL CARRYING A 24 PACK OF BUDWEISER BEER CANS. HE STATED HE FOLLOWED THE SUBJECT OUT TO HIGHWAY 19, AND THEN OBSERVED DEPUTIES ARRIVING ON SCENE AND HE SUBSEQUENTLY RETURNED TO THE SCENE. AT THAT TIME MULTIPLE UNITS ARRIVED ON SCENE AND WERE QUICKLY ABLE TO LOCATE THE SUSPECT. THE SUSPECT WAS LOCATED NEXT TO ACE HARDWARE IN HOMOSASSA, WHICH IS APPROXIMATELY 400 YARDS FROM WINN DIXIE. UPON THE SUSPECT BEING LOCATED HE WAS STILL IN POSSESSION OF THE 24 PACK OF BUDWEISER BEER CANS AS DESCRIBED BY MR RICHARDS. AT THAT TIME MR RICHARDS WAS BROUGHT TO THE LOCATION WHERE THE SUSPECT HAD BEEN LOCATED, TO IDENTIFY THE SUSPECT. UPON MR RICHARDS ARRIVAL AT THE SUSPECTâS LOCATION, HE POSITIVELY IDENTIFIED HIM AS THE SUBJECT WHO HAD STOLEN THE ITEMS. AT THAT TIME MR RICHARDS WAS RETURNED TO WINN DIXIE. AT THAT TIME I READ THE SUSPECT, IDENTIFIED AS MR JASON WILLIAMS, MIRANDA RIGHTS FROM A PREPRINTED CARD, AT WHICH TIME HE ADVISED HE UNDERSTOOD HIS RIGHTS; HOWEVER, HE DID NOT WANT TO SPEAK TO ME. AT THAT TIME THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED BEHIND HIS BACK DOUBLE LOCKED AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE, FOR TRANSPORT TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. PRIOR TO LEAVING THE SCENE, I ASKED THE DEFENDANT IF HE HAD MONEY TO PAY FOR THE GROCERIES AND BEER, AT WHICH TIME HE STATED HE ALREADY HAD DONE SO. I ASKED THE DEFENDANT HOW MUCH HE HAD PAID FOR THE GROCERIES AND HOW HE HAD PAID FOR THE GROCERIES, AND HE STATED HE PAID ABOUT $50.00 AND HAD PAID WITH HIS DEBIT CARD. MR RICHARDS HAD PROVIDED ME WITH A COPY OF THE STORE RECEIPT REGARDING THE RECOVERED ITEMS FROM THE WHITE PICKUP TRUCK WHICH TOTALED $115.25 WORTH OF MERCHANDISE. MR RICHARDS AND THE CASHIER COMPLETED SWORN WRITTEN STATEMENTS ATTESTING TO THE EVENTS THAT HAD OCCURRED, WHICH WERE LATER TURNED OVER TO RECORDS. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS CHARGED WITH ONE COUNT OF PETIT THEFT, WITH BOND SET AT $250.00 PER THE BOND SCHEDULE. |
