Probable cause affidavit: SUBMITTED BY: QUINN, STEPHEN 1241 (16-149983) (AR16-21488) DID KNOWINGLY, ACTUALLY AND INTENTIONALLY TOUCH OR STRIKE A JUVENILE CORRECTIONS OFFICER MS BRENDA BOONE FROM CYPRESS CREEK ACADEMY, TO WIT: INTENTIONALLY PUSHED THE VICTIM MULTIPLE TIMES, AGAINST THE WILL OF THE PERSON WHILE KNOWING THAT THE SAID CORRECTION'S OFFICER WAS ENGAGED IN THE LAWFUL PERFORMANCE OF HER LEGAL DUTIES, IN VIOLATION OF FLORIDA STATE STATUTE 784.075. ON 103116, I WAS DISPATCHED TO 18 ROOSEVELT BOULEVARD, IN BEVERLY HILLS, IN REFERENCE TO AN ASSAULT THAT HAD ALREADY OCCURRED. UPON ARRIVAL, I MADE CONTACT WITH MS BRENDA BOONE, IDENTIFIED AS THE VICTIM. SHE STATED THAT AT APPROXIMATELY 1300 HOURS A DETAINEE, THAT WAS ASSIGNED TO THE CYPRESS CREEK ACADEMY, AND HER HAD GOTTEN INTO AN ALTERCATION. THE VICTIM ADVISED THAT MR JAVONNE JENKINS, LATER IDENTIFIED AS THE DEFENDANT, CAME IN FOR LUNCH LATE AFTER PLAYING BASKETBALL OUTSIDE AND ATE HIS MEAL. SHE STATED THAT HE GOT UP AND WALKED AWAY FROM HIS TABLE AND LEFT HIS TRAY THERE WITH A PIECE OF BREAD STILL ON IT. SHE ADVISED THAT SHE PICKED UP THE TRAY AND ASKED MR JENKINS IF HE WAS DONE EATING, AND HE STATED THAT HE WAS NOT AND WALKED OVER TOWARDS THE VICTIM AND RIPPED THE TRAY OUT OF HER HAND. AFTER RIPPING THE TRAY OUT OF HER HAND, SHE CALLED OVER THE RADIO FOR ASSISTANCE AND ATTEMPTED TO GRAB THE TRAY BACK FROM THE DEFENDANT. SHE STATED THAT THEY WERE STRUGGLING OVER THE LUNCH TRAY AND SHE WAS STRUCK OVER THE HEAD AND HE ALSO PUSHED HER MULTIPLE TIMES. I DID OBSERVE MARKS ON HER ARM AND ARMPIT AREA CONSISTENT WITH HER STORY. I WAS ALSO ABLE TO FEEL A KNOT ON TOP OF THE VICTIM’S HEAD, ALSO CONSISTENT WITH HER STORY. I THEN RESPONDED TO CYPRESS CREEK ACADEMY AND MET WITH MR BIFF MCCORMICK, WHO WAS A SUPERVISOR OF THE FACILITY. I ADVISED HIM THAT I NEEDED TO SPEAK WITH MR JENKINS IN REFERENCE TO AN INCIDENT THAT HAD HAPPENED EARLIER IN THE DAY. UPON SPEAKING WITH THE DEFENDANT, HE WAS READ HIS MIRANDA VIA PRE-PRINTED CARD, I ASKED HIM IF HE KNEW WHY I WAS THERE, AND HE STATED THAT HE DID, AND I ASKED HIM IF HE WISHED TO SPEAK WITH ME. HE STATED THAT THE VICTIM, WHO WAS ASSIGNED TO HIS UNIT, TRIED TO TAKE HIS TRAY FROM HIM AT WHICH POINT HE WENT AND TOOK THE TRAY BACK FROM THE VICTIM AND THEY GOT INTO A ‘TUSSLE’. HE STATED THAT HE RIPPED THE TRAY FROM HER AND THEN SHE TRIED TO RESTRAIN HIM, AT WHICH POINT HE PUSHED HER MULTIPLE TIMES IN THE SHOULDER AREA. MR MCCORMICK SHOWED ME THE VIDEO OF THE INCIDENT, WHICH WAS CONSISTENT WITH THEIR STORIES. I WAS ABLE TO OBSERVE ON THE VIDEO THE TRAY BEING RIPPED OUT OF THE VICTIM’S HANDS, THE DEFENDANT HOLDING IT ABOVE HER HEAD AND HITTING HER IN THE HEAD AT ONE POINT. I ALSO OBSERVED THE DEFENDANT PUSHING THE VICTIM AWAY FROM HIM ON MULTIPLE OCCASIONS THROUGHOUT THE INCIDENT. AT THAT TIME, THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED, DOUBLE-LOCKED, BEHIND HIS BACK AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT’S BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE. NO FURTHER ACTION BY THIS DEPUTY.
