Probable cause affidavit: | SUBMITTED BY: BERGEN, JOHN 0519 (13-114146) (AR13-6978) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: OXYCODONE, A SCHEDULE II CONTROLLED, IN VIOLATION OF FLORIDA STATUTES 812.014(1) AND 812.014(2)(C)(13). APPROXIMATELY ONE MONTH AGO, THE VICTIM IN THIS CASE CONTACTED ME WITH CONCERNS THAT HIS HOUSEKEEPER/DEFENDANT, MS JAYME BISCARDI, WAS STEALING CONTROLLED SUBSTANCE MEDICATIONS FROM HIS BATHROOM MEDICINE CABINET. HE ADVISED THAT HIS WIFE HAD A BOTTLE OF XANAX THAT HAD COME UP MISSING AND AN OLD PRESCRIPTION FOR DARVOCET THAT HAD BEEN FULL AND IS NOW ¾ EMPTY. HE WAS ALSO MISSING SOME PERCOCET TABLETS. I TOLD THE VICTIM BEFORE THE NEXT TIME THE HOUSEKEEPER COMES, TO COUNT THE NUMBER OF PILLS BEFORE SHE COMES AND SEE IF THERE ARE ANY MISSING AFTER SHE LEAVES. THE VICTIM CONTACTED ME BACK AND ADVISED THAT INDEED THERE WERE PILLS MISSING AFTER THE HOUSEKEEPER HAD BEEN IN THE HOME. ON 082213, I RESPONDED TO THE VICTIMâS RESIDENCE AND HE SHOWED ME WHERE HE KEPT HIS MEDICATIONS. I COUNTED THE DARVOCET WHICH WAS 13 TABLETS AND THE OXYCODONE WHICH WAS 8 TABLETS. THESE MEDICATIONS WERE IN THE MEDICINE CABINET IN THE MASTER BATHROOM. I THEN DEPLOYED A COVERT VIDEO SYSTEM THAT POINTED AT THE MEDICINE CABINET. I SHOWED THE VICTIM HOW TO TURN IT ON WHEN THE HOUSEKEEPER GOT THERE. I THEN LEFT THE RESIDENCE AND WAITED A SHORT DISTANCE AWAY. AFTER THE HOUSEKEEPERâS ARRIVAL, THE VICTIM TURNED ON THE VIDEO RECORDING DEVICE AND TOLD THE HOUSEKEEPER HE WAS LEAVING TO GO TO THE STORE AND WOULD BE GONE APPROXIMATELY 30 MINUTES. APPROXIMATELY 30 MINUTES LATER THE VICTIM RETURNED HOME AND ADVISED ME VIA TEXT MESSAGE THAT THERE WAS ONE OXYCODONE TABLET MISSING. I RESPONDED TO THE RESIDENCE AND COUNTED THE PILLS MYSELF BEFORE MAKING CONTACT WITH THE DEFENDANT, MS BISCARDI, IN THE LIVING ROOM. I ASKED HER TO HAVE A SEAT AND I READ HER MIRANDA WARNING VIA AGENCY PREPRINTED CARD. SHE ADVISED THAT SHE UNDERSTOOD HER RIGHTS AND STATED THAT SHE WOULD SPEAK WITH ME AT THIS TIME. I TOLD THE DEFENDANT THAT I WAS THERE INVESTIGATING THE THEFT OF MEDICATION AND THAT OVER THE LAST MONTH A WHOLE BOTTLE OF XANAX, ¾ OF A BOTTLE OF DARVOCET AND SOME OXYCODONE WERE MISSING. I ADVISED THE DEFENDANT THAT THE VICTIM FOUND THESE ITEMS TO BE MISSING AFTER SHE HAD LEFT THE HOUSE. THE DEFENDANT THEN STATED âI HAVE NEVER TAKEN ANYTHING FROM THIS HOUSE, I WOULD NEVER TAKE ANYTHING LIKE PILLS OR ANYTHING ELSEâ. I THEN TOLD THE DEFENDANT THAT I HAD SET UP COVERT VIDEO CAMERAS AT WHICH TIME SHE IMMEDIATELY SAID âOKAY ONE, I DID TAKE ONE TODAY BUT THATâS ITâ. I ASKED THE DEFENDANT IF SHE KNEW WHAT THE MEDICATION WAS THAT SHE TOOK, TO WHICH SHE SAID SHE DID KNOW THAT IT WAS A CONTROLLED SUBSTANCE PAIN MEDICATION AND THAT SHE WAS TAKING IT FOR A HEADACHE. SHE SAID SHE HAD LOOKED FOR ADVIL OR IBUPROFEN, BUT COULD NOT FIND ANY, HOWEVER, THERE ARE IBUPROFEN TABLETS ON THE KITCHEN COUNTER AS WELL AS THE MEDICINE CABINET THAT SHE TOOK THE OXYCODONE FROM. I ASKED THE DEFENDANT WHERE THE PILL WAS, TO WHICH SHE SAID THAT SHE TOOK IT. THE DEFENDANT WAS PLACED UNDER ARREST FOR GRAND THEFT OF A CONTROLLED SUBSTANCE AND HANDCUFFED. I CONTACTED DEPUTY SANCHEZ TO RESPOND TO MY LOCATION AND TRANSPORT THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. AFTER THE DEFENDANT LEFT THE SCENE, I RETRIEVED MY VIDEO EQUIPMENT AND RETURNED TO MY OFFICE WHERE I VIEWED THE VIDEO WHICH SHOWED THE DEFENDANT ENTER THE BATHROOM AND REMOVE TWO DARVOCET TABLETS FROM THE BOTTLE. SHE THEN NOTICES THE OXYCODONE, RETURNS THE DARVOCET TO THE BOTTLE AND TAKES ONE OXYCODONE. I RESPONDED TO THE CITRUS COUNTY DETENTION FACILITY WHERE THE DEFENDANT WAS CHARGED WITH ONE COUNT OF GRAND THEFT OF A CONTROLLED SUBSTANCE. THE VIDEO WILL BE TURNED IN TO EVIDENCE. THE DEFENDANT WAS RELEASED ON HER OWN RECOGNIZANCE. |
