Charge description: Jayson Ezell Brown was sentenced to one-year probation on February 6, 2014 after a jury convicted him of Interference with the Duties of a Public Servant and Resisting Arrest on January 8th of this year. The 30-year-old Houston man was charged with both crimes after an altercation with police in 2012. According to lead prosecutor Omar Khawaja, Sugar Land Police Sergeant Danny Cornelius and Officer Shawn Hersey were working security at the M Lounge on Kensington Drive in Sugar Land on October 14, 2012. While Sgt. Cornelius attempted to detain an intoxicated person who was disturbing other guests, he was confronted by Brown. Despite being in full uniform with his police badge prominently displayed, Brown attempted to push Sgt. Cornelius off of the intoxicated subject while he was handcuffing him. Officer Shawn Hersey observed the defendant push Sgt. Cornelius and ran over to assist his fellow officer. The defendant then took an even more aggressive posture and began hurling profanities at both officers as they attempted to detain him for Interference with Public Duties. Brown threatened to beat them both while actively resisting arrest by pulling his hands and arms away from the officers as they attempted to arrest him. Finally, with the assistance of a third officer, Cornelius and Hersey were able to control the defendant and place handcuffs on him. This defendants reckless behavior jeopardized his own safety and the safety of everyone in that establishment including the officers doing their job, said Khawaja. The jurys verdict is a message that the people of Fort Bend County value the safety of their law enforcement officers. Brown was tried in County Court at Law No. 1 before Visiting Judge Larry Wagenbach. Interference with the duty of a Public Servant in this case is a Class B misdemeanor punishable by up to 180 days in jail and a fine not to exceed $2,000. Resisting Arrest is a Class A misdemeanor punishable by up to 365 days in jail and a fine not to exceed $4,000. Brown must also pay a $200 fine, attend anger management classes and perform 24 hours of community service during his probation. Assistant District Attorneys Omar Khawaja and Susan Sweeney prosecuted the case. Attorney Charlie Williams represented the defendant.
