Probable cause affidavit: SUBMITTED BY: CANFIELD, ANDRA 0441 (AR08104593) DID UNLAWFULLY, WILLFULLY AND MALICIOUSLY INJURE OR DAMAGE CERTAIN PROPERTY OF THE VICTIM, TO-WIT: A 2002 RED DODGE RAM, SAID DAMAGE BEING OF A VALUE OF $200.00 OR MORE OR BUT LESS THAN $1,000.00, IN VIOLATION OF FLORIDA STATUTES 806.13(1)(A) AND 806.13(1)(B)(2). ON 080708, I WAS DISPATCHED TO 7 NORTH LEE STREET, IN REFERENCE TO THREATS. UPON ARRIVAL, I WAS MET BY THE VICTIM, WHO ADVISED THAT HIS BROTHER-IN-LAW/DEFENDANT, MR JEFFERY PUSKARIC, AND HE HAD BEEN ARGUING ALL DAY. THE VICTIM STATED THE ARGUING BEGAN OVER A VIDEO GAME CONTROLLER, AT WHICH TIME THE DEFENDANT WALKED OUT INTO THE CARPORT WITH THE GAME CONTROLLER AND HE FOLLOWED HIM TO GET HIS GAME CONTROLLER BACK. THE VICTIM STATED THE ARGUING CONTINUED AND THE DEFENDANT THEN ACTED AS THOUGH HE WAS GOING TO HIT THE VICTIM, WHO THEN TOLD THE DEFENDANT THAT IT WOULD BE THE BIGGEST MISTAKE HE EVER MADE. THE VICTIM ADVISED IT WAS AT THAT TIME, HE WENT BACK IN TO THE RESIDENCE AND I ARRIVED ON SCENE. THE VICTIM ALSO STATED THAT IF THE DEFENDANT DID NOT LEAVE THAT HE WAS GOING TO HAVE TO, "BEAT HIS ASS." AT THAT TIME, I CALMED THE VICTIM DOWN AND ASKED HIM TO TELL ME WHAT WAS HAPPENING. THE VICTIM ADVISED THE DEFENDANT HAD BEEN LIVING WITH THEM AND THEY HAD BEEN FIGHTING ALL DAY AND THAT HE WAS TIRED OF THE DEFENDANT BREAKING THINGS IN HIS RESIDENCE. AT THAT TIME, I WENT AND SPOKE WITH THE DEFENDANT WHO WAS SITTING OUT IN THE CARPORT AREA. THE DEFENDANT SEEMED EXTREMELY AGITATED, STATING THAT HE WAS MAD BECAUSE HIS BROTHER-IN-LAW/VICTIM DOES NOT WANT HIM AND THAT NOBODY WANTS HIM. AT THAT TIME, THE DEFENDANT BECAME MAD AND THREW AN ASHTRAY ACROSS THE CARPORT AND I INSTRUCTED HIM TO CALM DOWN, THAT WE WERE JUST TALKING AND WE WOULD TRY TO WORK THINGS OUT. AFTER SPEAKING WITH THE DEFENDANT, HIS EMOTIONS RANGED FROM BEING CALM, TO SMASHING ITEMS THAT WERE IN FRONT OF HIM. I WENT TO SPEAK WITH THE VICTIM, WHO ADVISED THEY HAD MADE CONTACT WITH THE DEFENDANT'S OTHER SISTER AND SHE WOULD BE WILLING TO TAKE HIM. I THEN WENT BACK OUT TO SPEAK WITH THE DEFENDANT AND I ASKED HIM IF HE WOULD BE WILLING TO GO TO HIS OTHER SISTER'S RESIDENCE AND HE STATED NO. THE DEFENDANT THEN ASKED ME IF IT WAS THE VICTIM'S WIFE WHO WANTED HIM TO LEAVE AND I DID TELL HIM YES, BECAUSE SHE WAS AFRAID THAT THE FIGHTING BETWEEN THE VICTIM AND THE DEFENDANT WOULD ESCALATE. AT THAT TIME, THE DEFENDANT BECAME EXTREMELY AGITATED, BREAKING SEVERAL MORE ITEMS AND STATING TO THIS DEPUTY THAT HE WOULD KILL HIS BROTHER-IN-LAW. I WAS NOT ABLE TO CALM THE DEFENDANT DOWN AND HE CONTINUED TO KICK THINGS AROUND. THE DEFENDANT WENT OUT IN TO THE DRIVEWAY AND BEGAN SLAMMING HIS FISTS IN TO THE VICTIM'S VEHICLE, CAUSING SEVERAL DENTS TO THE HOOD AND SIDE OF THE PICKUP TRUCK. DUE TO THE LEVEL OF AGITATION THAT THE DEFENDANT WAS AT, AND THE FACT THAT HE STATED TO THIS DEPUTY HE WOULD KILL ANYBODY WHO ATTEMPTED TO MAKE HIM LEAVE, I CALLED FOR BACKUP AND UPON DEPUTY HUNTER'S ARRIVAL, THE DEFENDANT WAS TAKEN IN TO CUSTODY WITHOUT INCIDENT AND PLACED IN MY PATROL VEHICLE. IT SHOULD BE NOTED, THE DEFENDANT HAD NO ACCESS OR PRIVILEGE TO THE VICTIM'S VEHICLE AND THE APPROXIMATE DAMAGE TO THE VICTIM'S VEHICLE WAS $500.00 TO THE FRONT END OF THE PICKUP TRUCK. THE VICTIM PROVIDED A SWORN STATEMENT AS TO THE ITEMS THAT HAD BEEN DAMAGED, TO INCLUDE OTHER FURNITURE IN THE RESIDENCE. THE VICTIM WAS PROVIDED WITH AN AGENCY CARD BEARING MY NAME AND THIS CASE NUMBER AND THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. IT SHOULD BE NOTED, WHILE EN ROUTE TO THE DETENTION FACILITY, THE DEFENDANT HAD ANOTHER TEMPER TANTRUM, KICKING THE REAR OF THE PATROL VEHICLE AND THREATENING TO KILL THE VICTIM AGAIN. AFTER THAT INCIDENT, THE DEFENDANT REMAINED QUIET IN THE PATROL VEHICLE. ONCE AT THE DETENTION FACILITY, THE DEFENDANT'S BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. *NOT-EXEMPT*
