Probable cause affidavit: SUBMITTED BY: MCGILL, TOMMY 1360 (AR15-17079) DID, KNOWING HIS DRIVER’S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE, 322.34(1). ON 110215, AT APPROXIMATELY 1313 HOURS, I WAS TRAVELING WESTBOUND WHILE CONDUCTING TRAFFIC ENFORCEMENT AT THE INTERSECTION OF DAMPIER AND NORTH APOPKA IN INVERNESS. AT THAT TIME, I OBSERVED THE DEFENDANT, MR JEFFERY WILLIAMS, TRAVELLING EASTBOUND ONTO DAMPIER STREET. THE DEFENDANT THEN STOPPED AT THE INTERSECTION OF EAST DAMPIER AND APOPKA WHERE HE FAILED TO STOP AT THE STOP BAR/STOP SIGN AT THAT INTERSECTION. I OBSERVED THE DEFENDANT TURN RIGHT ONTO NORTH APOPKA AVENUE AND CONTINUED TO FOLLOW HIM AS HE TRAVELED SOUTHBOUND ONTO NORTH APOPKA. THE DEFENDANT THEN TURNED LEFT ONTO EAST MAIN STREET AND COURTHOUSE SQUARE. AT THAT TIME, I CONDUCTED A TRAFFIC STOP UTILIZING MY EMERGENCY OVERHEAD EQUIPMENT AND THE DRIVER/DEFENDANT CAME TO A STOP. I MADE CONTACT WITH THE DEFENDANT, MR JEFFERY WILLIAMS, AND ADVISED HIM OF THE REASON FOR THE TRAFFIC STOP. WHEN ASKED WHERE HE WAS TRAVELING TO, THE DEFENDANT ADVISED HE WAS GOING TO THE WATER COMPANY. I THEN REQUESTED THE DEFENDANT PROVIDE ME WITH HIS DRIVER’S LICENSE AND REGISTRATION WHICH HE COMPLIED TO. I RETURNED TO MY PATROL VEHICLE AND CONDUCTED A ‘’WANTS AND WARRANTS’’ CHECK ON THE DEFENDANT THROUGH THE CITRUS COUNTY SHERIFF’S OFFICE TELETYPE DIVISION. THIS REVEALED THAT THE DEFENDANT’S DRIVER’S LICENSE WAS SUSPENDED INDEFINITELY DUE TO FAILURE TO PAY FINANCIAL OBLIGATIONS. IT FURTHER REVEALED THE DEFENDANT WAS PROVIDED A NOTICE DATE OF 102714. I THEN CONFIRMED THIS INFORMATION THROUGH THE ‘’DAVID’’ SYSTEM. I AGAIN MADE CONTACT WITH THE DEFENDANT AND ASKED HIM TO STEP OUTSIDE OF HIS VEHICLE. I ASKED THE DEFENDANT WHY HE DID NOT INFORM ME THAT HIS DRIVER’S LICENSE WAS SUSPENDED, TO WHICH THE DEFENDANT ADVISED HE WAS NOT AWARE HIS DRIVER’S LICENSE WAS SUSPENDED. THE DEFENDANT THEN ADVISED THAT HE HAD DONE JAIL TIME IN THE MARION COUNTY JAIL, AND HE BELIEVED HIS DRIVER’S LICENSE ISSUE WAS TAKEN CARE OF. I INFORMED THE DEFENDANT THAT JUST BECAUSE HE DID JAIL TIME IT DID NOT MEAN THAT HIS DRIVER’S LICENSE ISSUE WAS CORRECTED. THE DEFENDANT AGAIN STATED THAT HE WAS NOT AWARE THAT HIS DRIVER’S LICENSE WAS SUSPENDED. AT THAT TIME, DEPUTY GENTILE (1362) ARRIVED ON SCENE. I ASKED THE DEFENDANT FOR PERMISSION TO CONDUCT A SEARCH OF HIS VEHICLE WHICH HE PROVIDED CONSENT FOR. AT THAT TIME, A SEARCH OF THE DEFENDANT’S VEHICLE REVEALED NEGATIVE RESULTS FOR CONTRABAND OR WEAPONS. I ADVISED THE DEFENDANT THAT I WOULD BE PLACING HIM UNDER ARREST FOR ONE COUNT OF DRIVING WHILE LICENSE WAS SUSPENDED. THE DEFENDANT WAS THEN HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND SECURED IN THE REAR OF MY PATROL VEHICLE. THE DEFENDANT REQUESTED TO MAKE CONTACT WITH HIS WIFE TO LET HER KNOW OF HIS ARREST WHICH I ALLOWED. THE DEFENDANT THEN CONTACTED HIS WIFE, ADVISED HER OF HIS ARREST AND ASKED HER TO RESPOND TO SCENE AND RETRIEVE THE VEHICLE. I ADVISED THE DEFENDANT THAT HIS KEYS; WALLET AND CELLULAR TELEPHONE WOULD BE TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY AND TURNED OVER TO DETENTION STAFF. I ASKED THE DEFENDANT IF HE UNDERSTOOD THE REASON HE WAS BEING PLACED UNDER ARREST, TO WHICH HE STATED YES. I ASKED THE DEFENDANT IF HE BELIEVED HE HAD BEEN TREATED FAIRLY BY THIS AGENCY, TO WHICH HE STATED YES, WE WERE JUST DOING OUR JOBS. I THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL, THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION, A1P26DP, FOR DRIVING WHILE LICENSE SUSPENDED WITH A MANDATORY COURT HEARING OF 111615 AT 0815 HOURS. THE DEFENDANT WAS ALSO ISSUED WARNING, 402524B, FOR RUNNING A STOP SIGN. ALL THE DEFENDANT’S PROPERTY WAS TURNED OVER TO DETENTION STAFF. ALL NECESSARY PAPERWORK WAS COMPLETED FOR SUBMISSION TO RECORDS. THE DEFENDANT’S BOND WAS SET AT $500.00 PER THE BOND SCHEDULE FOR THE ABOVE LISTED CHARGE. NO FURTHER BY THIS DEPUTY.
