Probable cause affidavit: SUBMITTED BY: BONURA, MATTHEW 0334 (AR10115546) UNLAWFULLY ENDANGER THE SAFETY OF ANOTHER OR THEIR PROPERTY WHILE INTOXICATED OR DID WHILE INTOXICATED OR DRINKING AN ALCOHOLIC BEVERAGE IN A PUBLIC PLACE CAUSE A PUBLIC DISTURBANCE, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 856.011. DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY BONURA, WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: CONDUCTING A TRAFFIC STOP WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02. DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY BONURA, DEPUTY S PHILLIPS, DEPUTY CONLEY, DEPUTY S SMITH, WHO WERE THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: AFFECTING AN ARREST WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02. ON 062610 AT APPROXIMATELY 1800 HOURS, I WORKING A SPECIAL DETAIL DOWN IN HOMOSASSA AT 5290 SOUTH CHEROKEE WAY. WHILE ON THIS DETAIL, I OBSERVED A TRAFFIC VIOLATION AND WAS ISSUING A WARNING TO THE DRIVER. WHILE ISSUING THIS WARNING, THE DEFENDANT, MR JEFFREY CONNLEY, APPROACHED MYSELF WITH A GLASS BEAR BOTTLE IN HIS HAND AND WAS STANDING APPROXIMATELY ONE INCH AWAY FROM THE LEFT SIDE OF MY ARM. I THEN ASKED THE DEFENDANT WHAT HE WAS DOING, HE ADVISED NOTHING AND CONTINUED TO STARE AT ME. AT THAT TIME, I DETECTED A STRONG ODOR OF ALCOHOL AND COULD TELL THAT THE DEFENDANT WAS INTOXICATED. FEELING UNCOMFORTABLE AND UNSAFE WITH THIS DEFENDANT STANDING SO CLOSE TO ME WITH A GLASS BEER BOTTLE AND NOT KNOWING WHAT HIS INTENTIONS WERE, I THEN BEGAN TO GIVE HIM INSTRUCTIONS TO MOVE AWAY FROM MYSELF AND LEAVE THE AREA. THE DEFENDANT ADVISED THAT HE DID NOT HAVE TO. I THEN GAVE THE DEFENDANT THE SAME INSTRUCTIONS AGAIN RAISING MY VOICE, THE DEFENDANT THEN AGAIN REFUSED. AFTER SEVERAL ATTEMPTS TO GET THE DEFENDANT TO LEAVE, HE THEN WALKED BEHIND ME AND AGAIN FEELING UNSAFE AND UNCOMFORTABLE WITH THE DEFENDANT BEHIND ME WITH A GLASS BEER BOTTLE, I TURNED TO FACE HIM. HE THEN CONTINUED TO ARGUE WITH MYSELF EACH TIME I GAVE HIM A COMMAND TO LEAVE. AT THIS TIME, I NOW HAD MY BACK TO THE DRIVER OF THE VEHICLE I WAS ISSUING A WARNING TO. AT THAT TIME, IT WAS THEN OBVIOUS THAT THE DEFENDANT WAS NOT GOING TO LEAVE THE AREA, I THEN CALLED FOR THE ASSISTANCE OF DEPUTY S PHILLIPS OVER TO MY LOCATION. I THEN TOLD THE DEFENDANT THAT HE WAS BEING PLACED UNDER ARREST FOR OBSTRUCTING ME WHILE I WAS ATTEMPTING TO ISSUE OUT A CITATION. AT THAT TIME, I INSTRUCTED THE DEFENDANT TO TURN AROUND AND PLACE HIS HANDS BEHIND HIS BACK. I THEN GRABBED A HOLD OF BOTH HIS FINGERS, AT THAT TIME; THE DEFENDANT JERKED AWAY FROM ME, GRABBING HOLD OF A GOLF CART. AT THAT TIME DEPUTY PHILLIPS AND I ATTEMPTED TO TAKE THE DEFENDANT TO THE GROUND AND PLACE HIM IN HANDCUFFS. THE DEFENDANT CONTINUED TO STRUGGLE AND RIPPED LOOSE THE REAR SEAT OF THE GOLF CART HE WAS HOLDING. ONCE THE GOLF CART SEAT CAME LOOSE, WE WERE ABLE TO TAKE THE DEFENDANT TO THE GROUND. THE DEFENDANT CONTINUED TO STRUGGLE AND AT THAT TIME, WE WERE ASSISTED BY DEPUTY CONLEY AND DEPUTY S SMITH. STILL, WHILE WE WERE ATTEMPTING TO GET THE DEFENDANT 'S ARMS BEHIND HIM HE CONTINUED TO STRUGGLE AND RESIST ALL OF OUR ATTEMPTS. AT THAT TIME, DEPUTY S SMITH GAVE VERY CLEAR INSTRUCTIONS TO THE DEFENDANT TO PLACE HIS HANDS BEHIND HIS BACK OR HE WOULD BE TASED. THE DEFENDANT DID NOT COMPLY AND DEPUTY SMITH DRIVE STUNNED THE DEFENDANT THREE TIMES IN HIS LOWER BACK. WE WERE THEN ABLE TO GET THE DEFENDANT IN HANDCUFFS. THE DEFENDANT THEN ASKED IF HE COULD BE RELEASED AND WALK AWAY. I INFORMED THE DEFENDANT THAT WE COULD NOT DO THAT. THE DEFENDANT WAS THEN ESCORTED OVER TO MY PATROL VEHICLE AND SECURED IN THE REAR SEAT. THE DEFENDANT THEN STATED TO ME, THAT HE WAS STUPID AND SHOULD HAVE JUST WALKED AWAY. THE DEFENDANT THEN AGAIN ASKED IF HE COULD BE RELEASED AND COULD WE FORGET THE WHOLE THING. I INFORMED THE DEFENDANT THAT I HAD GIVEN HIM SEVERAL OPTIONS TO LEAVE AND IF HE WOULD HAVE JUST LEFT, HE WOULD NOT HAVE BEEN IN THE SITUATION HE WAS IN NOW. AT THAT TIME, THE DEFENDANT STATED THAT HE WAS IN THE WRONG AND HE APOLOGIZED. AT THAT TIME, I THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY (CCJ) FOR BOOKING AND PROCESSING. THE DEFENDANT WAS CHARGED WITH ONE COUNT OF DISORDERLY INTOXICATION AND TWO COUNTS FOR RESISTING ARREST. THE DEFENDANT'S BOND SET AT A TOTAL OF $1,150.00 PER THE BOND SCHEDULE. *NOT-EXEMPT*
