SUBMITTED BY: CLARK, CORRY 0711 (AR16-17804) DID, KNOWING HIS DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). ON 010116 AT APPROXIMATELY 1023 HOURS, I WAS TRAVELING EASTBOUND ON HIGHWAY 44 WEST. WHILE STOPPED FOR THE TRAFFIC LIGHT AT INDEPENDENCE HIGHWAY AND HIGHWAY 44 WEST, I OBSERVED A RED IN COLOR FORD EXPLORER IN FRONT OF ME WITH TEMP TAG OF BNQ1163. AT THAT TIME, I OBSERVED THE TAG EXPIRATION DATE OF 123015. AT THAT TIME, I RAN THE TAG THROUGH FCIC/NCIC FOR VERIFICATION, WHICH VERIFIED THAT THE TAG WAS EXPIRED ON THAT DATE. UPON THE TRAFFIC SIGNAL CHANGING TO GREEN, I OBSERVED THE EXPLORER CHANGE TO THE OUTSIDE LANE, AT WHICH TIME, I INITIATED A TRAFFIC STOP AND OBSERVED THE VEHICLE PULL INTO O'REILLY'S AUTO PARTS, LOCATED AT 2313 HIGHWAY 44 WEST, INVERNESS. UPON MAKING CONTACT WITH THE DRIVER/DEFENDANT, MR JEFFREY MARCH, I ADVISED HIM FOR THE REASON FOR THE TRAFFIC STOP, AT WHICH TIME, HE STATED THAT THE VEHICLE BELONGED TO HIS GIRLFRIEND, MS CHARLOTTE TURNER, WHO WAS IN THE PASSENGER SEAT OF THE VEHICLE. HE ADVISED THAT SHE THOUGHT THE TAG EXPIRED AT THE END OF JANUARY OF 2016. I THEN ASKED THE DEFENDANT FOR HIS LICENSE AND VEHICLE REGISTRATION, AT WHICH TIME, HE STATED THAT HE WAS ONLY DRIVING DUE TO MS TURNER HAVING DRANK ALCOHOL THE NIGHT BEFORE. HE THEN STATED THAT HE DID NOT HAVE HIS IDENTIFICATION WITH HIM. I ASKED IF HE HAD A VALID FLORIDA DRIVER'S LICENSE, TO WHICH HE STATED THAT IT WAS NOT VALID ALTHOUGH ALL HE NEEDED TO DO WAS PAY TO HAVE IT REINSTATED. AT THAT TIME, I ASKED THE DEFENDANT ONCE AGAIN IF HE HAD A VALID DRIVER'S LICENSE, TO WHICH HE STATED NO, IT WAS SUSPENDED. UPON RUNNING THE DEFENDANT THROUGH THE CITRUS COUNTY SHERIFF'S OFFICE TELETYPE, I WAS ADVISED THAT THE DEFENDANT DID HAVE A SUSPENDED DRIVER'S LICENSE. TELETYPE ADVISED THAT HE ONLY HAD A VALID IDENTIFICATION CARD. UPON RUNNING THE DEFENDANT THROUGH FCIC/NCIC, I DISCOVERED THAT ON 052311, THE DEFENDANT'S DRIVER'S LICENSE WAS SUSPENDED FOR REFUSAL TO SUBMIT TO THE LAWFUL TEST OF BREATH/URINE/BLOOD. ON 042715, IT SHOWED THAT THE DEFENDANT HAD A SUSPENDED LICENSE FOR FAILURE TO APPEAR ON A TRAFFIC SUMMONS FOR TWO SEPARATE TRAFFIC SUMMONS; THE FIRST ONE BEING A0SBJ2P AND THE SECOND WAS A0SBJ3P. UPON FURTHER SPEAKING WITH THE DEFENDANT, HE ADVISED THAT HE CURRENTLY RESIDED IN LEESBURG, FLORIDA. I ADVISED THAT DUE TO THE INFORMATION THAT I OBTAINED HE WAS BEING PLACED UNDER ARREST FOR DRIVING ON A SUSPENDED LICENSE KNOWINGLY. HE RECEIVED A UNIFORM TRAFFIC CITATION, NUMBER A1P2HCP, WITH A COURT DATE OF 012116 AT 1300 HOURS, FOR DRIVING ON A SUSPENDED LICENSE KNOWINGLY, ALONG WITH A WRITTEN WARNING, NUMBER 402403B, FOR THE EXPIRED VEHICLE REGISTRATION. THE DEFENDANT WAS PLACED IN HANDCUFFS (DOUBLE LOCKED) AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE. THE DEFENDANT WAS READ MIRANDA VIA A PREPRINTED MIRANDA CARD. HE ADVISED THAT HE UNDERSTOOD HIS RIGHTS AND THAT HE DID NOT WISH TO SPEAK WITH ME. HE WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. HIS BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. THE VEHICLE WAS TURNED OVER TO MS TURNER'S POSSESSION AND SHE WAS GOING TO CONTACT A FAMILY MEMBER TO COME AND RETRIEVE HER AND THE VEHICLE. |
