Probable cause affidavit: |
SUBMITTED BY: CHENOWETH, JACOB 0708 (AR13-7387) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF THE VICTIM, WALMART, TO WIT: A DIGITAL TELEVISION CONVERTER, CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTE 812.015. ON 092213 AT APPROXIMATELY 1516 HOURS, I WAS DISPATCHED TO 6885 SOUTH SUNCOAST BOULEVARD IN HOMOSASSA, WALMART, IN HOMOSASSA IN REFERENCE TO A THEFT THAT HAD ALREADY OCCURRED AND A SUSPECT WAS DETAINED. UPON ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT, LOSS PREVENTION OFFICER MR NOLEN LAW, WHO ADVISED THAT ON 092213, HE OBSERVED A MALE SUBJECT, LATER IDENTIFIED AS THE DEFENDANT, MR JEFFREY RICHARD YUNK, DISPLAYING SUSPICIOUS BEHAVIOR. THE COMPLAINANT ADVISED THAT THE DEFENDANT SELECTED A DIGITAL TELEVISION CONVERTER AND AN INDOOR ANTENNA FROM THE ELECTRONICS SECTION OF THE STORE. THE COMPLAINANT CONTINUED FLOOR SURVEILLANCE AS THE SUSPECT WENT TO THE PET SECTION, WHERE HE OPENED THE BOX OF THE TELEVISION CONVERTER AND PLACED THE MAIN PORTION IN THE FRONT OF HIS PANTS AND THE REMOTE AND POWER CORD IN HIS LEFT FRONT CARGO POCKET. THE SUSPECT THEN PROCEEDED TO THE FRONT OF THE STORE, WHERE HE PURCHASED THE INDOOR ANTENNA AND DID NOT MAKE ANY ATTEMPT TO PAY FOR THE TELEVISION CONVERTER. THE SUSPECT THEN EXITED THE STORE PASSING ALL POINTS OF SALE WITHOUT ATTEMPTING TO PAY FOR THE CONCEALED MERCHANDISE. THE COMPLAINANT ADVISED HE APPROACHED THE SUSPECT AND IDENTIFIED HIMSELF AS THE LOSS PREVENTION OFFICER AND ADVISED HIM OF THE REASON FOR THE STOP. THE SUSPECT THEN SURRENDERED THE MERCHANDISE AND HE WAS ESCORTED TO THE LOSS PREVENTION OFFICE AND THE SHERIFFâS OFFICE WAS CONTACTED. THE COMPLAINANT COMPLETED A SWORN WRITTEN STATEMENT, WHICH WILL BE TURNED IN TO THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO) RECORDS DIVISION. THE TOTAL AMOUNT OF THE TELEVISION CONVERTER WAS $49.87. I THEN VIEWED THE SURVEILLANCE VIDEO FROM THE STORE, WHICH CORROBORATED THE COMPLAINANTâS STORY. A COPY OF THE SURVEILLANCE VIDEO WAS COLLECTED AND WILL BE TURNED IN TO THE EVIDENCE DIVISION. MR YUNK SPONTANEOUSLY UTTERED THAT HE HAD MADE A STUPID MISTAKE AND HAD THE MONEY IN HIS POCKET TO PAY FOR THE MERCHANDISE. I THEN ASKED THE COMPLAINANT IF THEY WISHED TO PURSUE CHARGES AND HE REPLIED YES. I ADVISED THE DEFENDANT HE WAS NOW BEING PLACED UNDER ARREST FOR PETIT RETAIL THEFT. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY (CCDF) FOR BOOKING AND PROCESSING. THE DEFENDANTâS BOND WAS SET AT $250.00 PER THE BOND SCHEDULE. |
