Probable cause affidavit: SUBMITTED BY: VENTIMIGLIA, LISA 0621 (AR11123017) THE DEFENDANT DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HER NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193(1) On 100411at 0343 hours while on routine patrol of South US Highway 41, I observed tree limbs in the roadway next to the mediAN across from SUMTER ELECTRIC COOPERATIVE (SECO.) As I checked the mediAN, I observed thAT THE 'Do Not Enter' sign HAD BEEN severed at the base and the center of the mediAN's foliage was also scattered across the westbound lane, next to the mediAN. I observed a mark at the curb in front of where the sign had been posted. The damage appeared to be made by a vehicle traveling westbound. At the opposite end of the mediAN, I observed more foliage and fluid on South US Highway 41 in the westbound lane closesT to the mediAN. I removed the tree limbs from the road and BOLO'd for a vehicle with front end damage. At 0356 hours, as I approached Eden Drive, I heard a loud noise which sounded like a fender rubbing. I looked in the direction of the noise and saw a 2002 Chrysler van, green in color, with heavy damage to the right front fender and windshield, pulling out of the Kangaroo Gas Station onto Eden Drive. I pulled up next to the van with my vehicle's emergency lights on AND observed a female driving the vehicle. The driver did not acknowledge my presence until I knocked on the driver's window. The driver was slow to react to my knocking on her window so I opened her door. I asked her if she was okAY and what happen tonight. The driver was later identified by running the vehicle tag and matching the registered owner through D.A.V.I.D., as MS Jennifer Sheryl Spaulding, because she refused to tell me her name. When I asked Ms Spaulding if she was okAY, she looked down at the floor between the seat. I was able to see a liter bottle of WoodBridge wine lying on its side which still had about TWO inches of wine left in the bottle. I asked Ms Spaulding if she was hurt or if she was currently on any medication, to which she answered "no." I asked Ms Spaulding again if she would tell me what HAD happenED to her vehicle. She did not respond to my questions. I asKED MS SPAULDING IF SHE HAD BEEN DRINKING TONIGHT AS I could smell a heavy odor of an alcoholic beverage coming from her breath as she spoke. Her eyes appeared red and glassy, HER SPEECH WAS SLURRED AND SHE WAS NOT WEARING ANY SHOES. WHEN I ASKED HER WHERE HER SHOES WERE LOCATED, SHE SAID "AT A FRIENDS." I ASKED WHERE THE FRIEND WAS LOCATED, TO WHICH SHE SAID BEHIND APPLEBEE'S. I ASKED HER WHERE SHE WAS GOING AT THIS TIME OF NIGHT AND SHE SAID SHE WAS GOING HOME AND POINTED. I ASKED HER WHERE HER HOME WAS LOCATED AND SHE SAID "JUST RIGHT OVER THERE." I AGAIN ASKED WHERE WAS HOME AND SHE SAID "RIGHT OVER THERE." I then asked Ms Spaulding if she would submit to A SERIES OF field sobriety TASKS, TO WHICH SHE refused, at which TIME she was placed under arrest FOR DRIVING UNDER THE INFLUENCE. SHE WAS handcuffed (double locked) BEHIND HER BACK, SECURED IN THE REAR SEAT OF MY PATROL VEHICLE and transported to THE CITRUS COUNTY DETENTION FACILITY without incident. PRIOR TO LEAVING THE SCENE, DEFENDANT SPAULDING'S VEHICLE WAS TOWED BY ED'S TOWING. UPON ARRIVAL, DEFENDANT SPAULDING was turned over to staff FOR FURTHER PROCESSING. DEFENDANT SPAULDING WAS READ HER IMPLIED CONSENT AND MIRANDA WARNINGS BY THE INTOXILYZER OPERATOR. DEFENDANT SPAULDING REFUSED TO SUBMIT TO THE APPROVED TEST OF HER BREATH FOR THE PURPOSE OF DETERMINING THE ALCOHOL CONTENT OF HER BLOOD. DEFENDANT SPAULDING WAS CHARGED WITH DRIVING UNDER THE INFLUENCE WITH A $500.00 BOND, PER THE BOND SCHEDULE. SHE WAS ISSUED A FLORIDA DUI UNIFORM TRAFFIC CITATION, CITATION NUMBER 7169-XDO4 WITH A MANDATORY COURT APPEARANCE ON 102011 AT 1300 HOURS AT THE CITRUS COUNTY COURTHOUSE.
