SUBMITTED BY: LAUGHLIN, JEREMY 0617 (AR10118053) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, WAL-MART, TO WIT: VARIOUS ARTICLES OF MEN'S CLOTHING, SAID PROPERTY BEING OF A VALUE OF $54.59, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTES 812.014(1) and 812.014(3)(a). ON 112210 AT APPROXIMATELY 1630 HOURS, I RESPONDED TO THE WAL-MART AT 2461 EAST GULF TO LAKE HIGHWAY, WHERE LOSS PREVENTION EMPLOYEES HAD DETAINED A SHOPLIFTER. UPON MY ARRIVAL I MADE CONTACT WITH LOSS PREVENTION OFFICER, WHO HAD OBSERVED THE DEFENDANT, MR JERRY BEVILLE, SELECTING VARIOUS ARTICLES OF MEN'S CLOTHING AND CONCEALING THEM ON HIS PERSON. MR BEVILLE THEN CONTINUED THROUGHOUT THE STORE, PASSING ALL POINTS OF SALE, AS THE LOSS PREVENTION OFFICER OBSERVED MR BEVILLE ATTEMPTING TO EXIT THE STORE. LOSS PREVENTION OFFICERS THEN MADE CONTACT WITH MR BEVILLE AND ESCORTED HIM INTO THE LOSS PREVENTION OFFICE. AT THAT TIME THE LOSS PREVENTION OFFICERS WERE ABLE TO RECOVER ONE MEN'S POLO SHIRT, ONE PAIR OF MEN'S CARPENTER PANTS, AND ONE GATER'S BASEBALL CAP. ALL ITEMS WERE RETURNED TO WAL-MART WITH TOTAL VALUE OF $54.59. THE LOSS PREVENTION OFFICER FILLED OUT A SWORN WRITTEN STATEMENT WHICH WAS COLLECTED AND TURNED OVER TO RECORDS. ALSO, A PROPERTY RECEIPT WAS COMPLETED FOR THE STOLEN RECOVERED ITEMS, which WAS SIGNED BY THE LOSS PREVENTION OFFICER AND HE WAS PROVIDED WITH A COPY. THE DEFENDANT WAS THEN PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED) AND TRANSPORTED TO THE DETENTION FACILITY. MR BEVILLE WAS ADVISED HE WAS BEING TRESPASSED FROM THE WAL-MART STORE, AT WHICH TIME HE ADVISED HE WAS SORRY FOR STEALING THE ITEMS. UPON ARRIVAL AT THE DETENTION FACILITY DEFENDANT'S BOND WAS SET AT $250.00. ALL PAPERWORK WILL BE TURNED IN TO RECORDS.
