Probable cause affidavit: SUBMITTED BY: HRYC, CHRISTOPHER 0701 (AR13-8495) ON 122713, AT APPROXIMATELY 0046 HOURS, I CONDUCTED A TRAFFIC STOP ON A RED IN COLOR, CHRYSLER CONVERTIBLE, BEARING FLORIDA LICENSE PLATE NUMBER 0284IV, FOR INOPERABLE TAG LIGHT. UPON ARRIVING AT THE INTERSECTION OF SOUTH SUNCOAST BOULEVARD AND WEST HIGHLAND STREET, I MADE CONTACT WITH THE DRIVER, MS ORLANDO GARCIA, AND ADVISED HIM OF THE REASON FOR THIS TRAFFIC STOP. I ASKED MR GARCIA IF THERE WAS ANYTHING ILLEGAL IN HIS VEHICLE, TO WHICH HE ADVISED THAT THERE WAS NOT, AND ASKED IF I WOULD LIKE TO SEARCH THE VEHICLE. MR GARCIA AND THE PASSENGER OF THE VEHICLE, LATER IDENTIFIED AS THE DEFENDANT, MR JESS ROBERT DONLEY, STEPPED OUT OF THE VEHICLE, AND WERE BOTH PATTED DOWN FOR WEAPONS AND CONTRABAND. I THEN BEGAN TO SEARCH THE VEHICLE, AND I LOCATED IN THE PASSENGER’S SIDE SEAT A POOL CUE CASE. UPON PICKING IT UP, I ASKED WHO IT BELONGED TO, AND THE DEFENDANT ADVISED THAT IT WAS HIS. I ASKED THE DEFENDANT IF EVERYTHING INSIDE BELONGED TO HIM, TO WHICH HE STATED THAT IT DID. I ASKED THE DEFENDANT IF THERE WAS ANYTHING ILLEGAL IN THE POOL CUE CASE, AND HE ADVISED THAT THERE WAS A SMALL AMOUNT OF CANNABIS INSIDE OF AN INTERIOR POCKET. I THEN OPENED THE CASE, AND IN THE POCKET ON THE FRONT OF THE CASE, I IMMEDIATELY OBSERVED A PACK OF ROLLING PAPERS, AS WELL AS A SMALL PLASTIC BAGGIE, CONTAINING A GREEN LEAFY SUBSTANCE. BASED ON MY TRAINING AND EXPERIENCE, I BELIEVED THIS SUBSTANCE TO BE CANNABIS. THE DEFENDANT THEN ASKED IF I COULD GIVE HIM A BREAK AND JUST LET HIM GO, TO WHICH I ADVISED THAT I COULD NOT. I COLLECTED THE ROLLING PAPERS AND CANNABIS. THE CANNABIS WAS FIELD TESTED, UTILIZING AN AGENCY ISSUED FIELD TEST KIT, AND YIELDED A POSITIVE RESULT FOR THE PRESENCE OF CANNABIS. IT WAS ALSO WEIGHED, AND FOUND TO WEIGH 1.4 GRAMS. THE DEFENDANT WAS THEN ISSUED A NOTICE TO APPEAR (NTA) CITATION, BEARING CITATION NUMBER 20295, FOR POSSESSION OF DRUG PARAPHERNALIA, AND POSSESSION OF LESS THAN TWENTY GRAMS OF CANNABIS, WITH A MANDATORY COURT APPEARANCE OF 012314 AT 1300 HOURS, AT THE CITRUS COUNTY COURTHOUSE. THE DEFENDANT WAS EXPLAINED THE TERMS OF THE CITATION, AND ADVISED THAT HE UNDERSTOOD. THE DEFENDANT SIGNED THE CITATION AND WAS PROVIDED A COPY. HE WAS THEN RELEASED ON HIS OWN RECOGNIZANCE. MR GARCIA WAS ISSUED A CITRUS COUNTY SHERIFF'S OFFICE WRITTEN WARNING, WARNING NUMBER 378841B, FOR THE INOPERABLE TAG LIGHT. NO OTHER CONTRABAND WAS FOUND IN THE VEHICLE. THE EVIDENCE WAS PACKAGED AND LATER SUBMITTED TO EVIDENCE.
