\tSUBMITTED BY: SCHAFFER, HEATH 0652 (AR15-14144) (15-26924) \tdid then and there unlawfully carry a concealed weapon or electric weapon or device on or about HIS person, to wit: A 14" FIXED BLADED KNIFE, in violation of Florida Statute 790.01(1); AND \t DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: BRASS SMOKING PIPE WITH CANNABIS RESIDUE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B). ON 022715 AT APPROXIMATELY 2316 HOURS, WHILE TRAVELING NORTHBOUND ON SOUTH FLORIDA AVENUE, NEAR EAST CAMELLIA LANE, IN FLORAL CITY, I OBSERVED A WHITE MALE, LATER IDENTIFIED AS, MR JESSIE PRIVE, TO BE RIDING HIS BICYCLE SOUTHBOUND ON THE NORTHBOUND SHOULDER OF THE ROAD. I OBSERVED THAT MR PRIVE DID NOT HAVE HEAD OR TAIL LIGHTS ON HIS BICYCLE. I MADE A U-TURN AND ATTEMPTED TO CONDUCT A TRAFFIC STOP ON HIM. AS I PULLED BEHIND MR PRIVE I ACTIVATED MY OVERHEAD EMERGENCY LIGHTS, AT WHICH POINT I OBSERVED MR PRIVE TO REACH INTO HIS RIGHT JACKET POCKET AND THROW AN UNKNOWN WHITE OBJECT INTO A NEAR BY PARKING LOT WITH HIS RIGHT HAND. MR PRIVE CONTINUED TO PEDAL HIS BICYCLE SOUTHBOUND AND STOPPED APPROXIMATELY, 100 YARDS FROM WHERE HE THREW THE OBJECT. WHILE STOPPING HIS BICYCLE, I OBSERVED A LONG SILVER AND BLACK OBJECT FALL FROM HIS PERSON. AS WE BOTH STOPPED I ORDERED MR PRIVE TO THE GROUND AND SECURED HIM IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK. I THEN WALKED BACK TO FIND THE SILVER OBJECT AND SAW IT TO BE A 14 INCH, FIXED BLADED SURVIVAL KNIFE, WITH A BLACK TAPE HANDLE. I REQUESTED DEPUTY POLLARD TO STAY WITH MR PRIVE WHILE I WENT BACK TO LOOK IN THE PARKING LOT FOR THE UNKNOWN WHITE OBJECT THAT I SUSPECTED TO BE NARCOTICS. AFTER SEARCHING THE AREA I WAS UNABLE TO LOCATE THE ITEM AND RETURNED TO SEARCH MR PRIVEâS BOOK BAG FOR ADDITIONAL CONCEALED WEAPONS. DURING THE SEARCH, I LOCATED A METAL PAIR OF NUNCHUKS AND BRASS SMOKING PIPE WITH CANNABIS RESIDUE. I MADE CONTACT WITH MR PRIVE, WHO WAS SEATED IN THE REAR OF DEPUTY POLLARDâS PATROL VEHICLE. I READ HIM HIS MIRANDA RIGHTS VIA MY PREPRINTED CARD. MR PRIVE ADVISED THAT HE WOULD SPEAK WITH ME AND I BEGAN QUESTIONING HIM ABOUT THE OBJECT THAT HE THREW FROM HIS JACKET. MR PRIVE DENIED THROWING ANY OBJECTS, EVEN AFTER I SHOWED HIM MY DASH CAM FOOTAGE OF HIM DOING SO. MR PRIVE WAS QUESTIONED ABOUT THE KNIFE AND NUNCHUKS, HE ADVISED HE KEEPS THEM FOR PROTECTION. MR PRIVE WAS QUESTIONED ABOUT THE BRASS SMOKING PIPE AND ASKED IF HE SMOKES MARIJUANA FROM IT AND HE SAID YES. ALL OF THE PROPERTY WAS COLLECTED AND LATER TURNED IN TO EVIDENCE. THIS CASE WILL REMAIN OPEN PENDING FURTHER INVESTIGATION. MR PRIVE WAS RELEASED ON SCENE. ON 030615, AFTER MY INVESTIGATION WAS COMPLETED, CONTACT WAS MADE WITH MR PRIVE AT 8017 EAST SKYLINE LANE IN FLORAL CITY, AT WHICH TIME HE WAS PLACED UNDER ARREST FOR CARRYING A CONCEALED WEAPON AND POSSESSION OF PARAPHERNALIA. HE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. BOND WAS SET AT $1,000.00 FOR EACH CHARGE WITH A TOTAL BOND OF $2,000.00 PER THE BOND SCHEDULE. |
