SUBMITTED BY: LAMBERT, BOBBY 0480 (AR091118960) DID UNLAWFULLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: THE DEFENDANT HAD IN HER POSSESSION SIX PLASTIC BAGGIES CONTAINING PARAPHERNALIA AND COCAINE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1) (B) ON 111309 AT APPROXIMATELY 2000 HOURS, I OBSERVED A BLACK CHEVROLET PICKUP TRUCK, BEARING FLORIDA TAG NUMBER 2746GN, TRAVELING EAST ON HIGHWAY 44. THIS VEHICLE WAS TRAVELING AT A SPEED GREATER THAN THE POSTED 45 MILES PER HOUR. I POSITIONED MY PATROL VEHICLE BEHIND THIS PICKUP TRUCK, AND BEGAN TO PACE THE VEHICLE'S SPEED, WHERE I CONTINUED TO FOLLOW THE VEHICLE FROM THE INTERSECTION OF HIGHWAY 44 AND TURKEY OAK. I THEN OBSERVED A SPEED READING OF 58 MILES PER HOUR ON MY ODOMETER, ALONG WITH A VISIBLE DISPLAY WHICH READ 58 ON MY RADAR. THE VEHICLE CONTINUED TO TRAVEL AT THAT SPEED UNTIL I INITIATED A TRAFFIC STOP BY ACTIVATING MY OVERHEAD LIGHTS ON THE VEHICLE ON HIGHWAY 44, APPROXIMATELY ONE SQUARE MILE WEST OF HIGHWAY 486. AFTER MAKING THE TRAFFIC STOP, I APPROACHED THE DRIVER'S SIDE OF THE VEHICLE, WHERE I MADE CONTACT WITH THE DRIVER/WITNESS. I INFORMED HER OF THE REASON FOR THE TRAFFIC STOP, IN WHICH THE DRIVER/WITNESS STATED THAT SHE WAS NOT AWARE OF HER SPEED, AND THAT SHE HAD JUST PUT NEW RIMS ON HER VEHICLE, WHICH MAY HAVE MADE HER SPEED OFF. AFTER OBTAINING THE DRIVER INFORMATION, I OBSERVED THE PASSENGER SITTING IN THE FRONT SEAT AND HOLDING A BLACK PURSE. I THEN REQUESTED HER INFORMATION, RESULTING IN HER OBTAINING HER FLORIDA IDENTIFICATION FROM THE SAME BLACK PURSE, WHICH REVEALED HER IDENTITY AS MS JESSICA FLONES. I THEN RETURNED TO MY AGENCY VEHICLE TO CHECK THE DRIVER'S LICENSE STATUS, ALONG WITH ISSUING HER A CITATION FOR THE UNLAWFUL SPEED. AS I STARTED THE CITATION, DEPUTY TACKETT ARRIVED WITH CANINE DEPUTY PRIEST. DEPUTY TACKETT DEPLOYED CANINE PRIEST, AFTER WHICH HE ADVISED ME THAT DEPUTY PRIEST DID ALERT TO THE VEHICLE, INDICATING THAT THERE WAS SOME TYPE OF NARCOTIC ODOR ON OR IN THE VEHICLE. I CONTINUED TO COMPLETE THE CITATION, WHILE DEPUTY TACKETT REMOVED THE OCCUPANT'S OF THE VEHICLE AND CONDUCTED A SEARCH. I ISSUED THE DRIVER A FLORIDA TRAFFIC CITATION FOR UNLAWFUL SPEED, AND AT THAT TIME, DEPUTY TACKETT INFORMED ME THAT HE HAD LOCATED DRUG PARAPHERNALIA THAT WAS FOUND IN THE SAME BLACK PURSE THAT DEFENDANT FLONES HAD REMOVED HER IDENTIFICATION FROM. DEPUTY TACKETT SHOWED ME A PINK HAND POUCH LOCATED IN THE PURSE, CONTAINING FIVE PLASTIC BAGGIES, ALONG WITH ONE BLUE PLASTIC BAGGIE. LOCATED IN THE BLUE BAGGIE WAS A SMALL WHITE POWDER RESIDUE (ALONG WITH ONE STRAW) THAT DUE TO MY PAST TRAINING AND EXPERIENCE, I RECOGNIZED THESE ITEMS TO BE CONSISTENT WITH USE OF COCAINE. I CONDUCTED A FIELD TEST ON THE HOOD OF MY AGENCY VEHICLE, WHICH YIELDED POSITIVE RESULTS FOR COCAINE. AT THAT TIME, DEFENDANT/ FLONES WAS STANDING NEXT TO ME, AND HER EXCUSE WAS THAT THE OBJECTS AND THE POUCH DID NOT BELONG TO HER, AND SHE HAD SEEN THE POUCH LYING ON THE FLOORBOARD OF THE VEHICLE WHEN SHE ENTERED IT, PICKED IT UP AND PLACED THE ITEMS IN HER PURSE. THE DEFENDANT WAS PLACED IN HANDCUFFS (DOUBLE LOCKED) BEHIND HER BACK, AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING WHERE HER BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. THE VEHICLE WAS RELEASED BACK TO THE DRIVER ON SCENE, AND ALL COLLECTED EVIDENCE WAS LATER SUBMITTED TO THE CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE LOCKER. *NOT-EXEMPT* |
