SUBMITTED BY: PARSONS, WILLIAM 0358 (AR13-5334) DID UNLAWFULLY AND FELONIOUSLY SELL, MANUFACTURE OR DELIVER OR POSSESS WITH INTENT TO SELL, MANUFACTURE OR DELIVER OR CAUSE TO BE SOLD, MANUFACTURED OR DELIVERED TO ANOTHER PERSON, A CONTROLLED SUBSTANCE, TO WIT: METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(1)(A)(1). DID UNLAWFULLY HAVE IN HER POSSESSION LISTED PRECURSOR CHEMICALS OR ESSENTIAL CHEMICALS USED IN THE MANUFACTURING OF A CONTROLLED SUBSTANCE IN VIOLATION OF FLORIDA STATE STATUTE 893.149(1)(A) THESE CHEMICALS ARE CRITICAL TO THE CREATION OF THE CONTROLLED SUBSTANCE, TO WIT: AMMONIA NITRATE AND LITHIUM METAL. DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: SYRINGE, MOUNTAIN DEW BOTTLES, AND BAGGIES IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) ON 042213, CONTACT WAS MADE WITH PROBATION OFFICER RAINS WHO ADVISED THAT SHE HAD ACTIVE VIOLATION OF PROBATION WARRANTS FOR THE ARREST OF THE DEFENDANTS, MR BENJAMIN HOLIDAY AND MS JESSICA HOLLIDAY, DUE TO THEM HAVING POSITIVE TESTS FOR METHAMPHETAMINES. IT SHOULD BE NOTED THAT THE ORIGINAL CHARGES ON BOTH DEFENDANTS WAS IN REFERENCE TO MANUFACTURING METHAMPHETAMINES, POSSESSION OF A LISTED OR CONTROLLED CHEMICAL, AND POSSESSION OF METHAMPHETAMINES. OFFICER RAINS ASKED BOTH DEPUTY SMITH AND I IF WE WISHED TO ACCOMPANY HER TO THEIR NUMERICAL OF 5866 WEST JEDI COURT, DUNNELLON, IN REFERENCE TO ARRESTING THEM ON THE WARRANT AND TO SEE IF THEY WERE MANUFACTURING METHAMPHETAMINES AGAIN. DEPUTY SMITH AND I RESPONDED TO THE DEFENDANTSâ ADDRESS WITH OFFICER RAINS. UPON ARRIVAL, PROBATION OFFICER RAINS KNOCKED ON THE DOOR. BOTH DEFENDANTS ANSWERED THE DOOR, AND INVITED OFFICER RAINS INSIDE. AT THIS TIME, DEPUTY SMITH MADE CONTACT WITH BOTH DEFENDANTS AND ASKED THEM IF THEY MINDED LAW ENFORCEMENT COMING INSIDE AND THEY BOTH ADVISED THEY DID NOT MIND AT ALL. AT THIS TIME, IT WAS EXPLAINED TO BOTH DEFENDANTS BY OFFICER RAINS THAT SHE WAS DOING PROBATION CHECK. THEY WERE ASKED IF THERE WERE ANY WEAPONS IN THE RESIDENCE AND BOTH DEFENDANTS ADVISED THERE WAS A SHOTGUN AND AMMUNITION. THE SHOTGUN AND AMMUNITION WAS RETRIEVED BY OFFICER RAINS AND TURNED OVER TO ME. AT THIS TIME, DEPUTY SMITH ASKED BOTH DEFENDANTS IF THEY WOULD MIND DEPUTY SMITH AND I HELPING OFFICER RAINS WITH THE SEARCH OF THE RESIDENCE AND OUTSIDE. THEY BOTH ADVISED THEY DID NOT MIND. UPON CHECKING THE SIDE YARD, I OBSERVED SEVERAL HCL GENERATORS WHICH ARE USED FOR THE GASSING OFF OF METHAMPHETAMINE DURING THE MANUFACTURING PROCESS. IN A SHED TO THE REAR OF THE RESIDENCE, BATTERY CASINGS WERE LOCATED ON THE GROUND AND IN THE FIRE PIT, A WATER AMPLE FROM A COLD PACK WAS LOCATED ON A SHELF AND A ONE POT METHAMPHETAMINE COOK WAS LOCATED ON A BOOK SHELF. ALSO AT THE BOTTOM OF THE BOOKSHELF WAS A BLACK BOOK BAG WHICH CONTAINED ANOTHER HCL GENERATOR WHICH STILL CONTAINED THE TUBING, A CONTAINER OF RED DEVIL LYE, A CONTAINER OF LIQUID FIRE, EMPTY GLASS MASON JAR, EMPTY LITHIUM BATTERY PACKAGE AND A CONTAINER OF SALT. AT THIS TIME, DEPUTY SMITH MADE CONTACT BACK WITH BOTH DEFENDANTS. STARTING WITH DEFENDANT BENJAMIN HOLLIDAY, DEPUTY SMITH CONDUCTED A DIGITALLY RECORDED INTERVIEW. DEFENDANT BENJAMIN HOLLIDAY WAS READ HIS MIRANDA WARNING VIA PRE-PRINTED, AGENCY ISSUED CARD. WHEN ASKED IF HE UNDERSTOOD HIS RIGHTS, HE ADVISED HE DID AND WHEN HE WAS ASKED IF HE STILL WISHED TO TALK TO DEPUTY SMITH HE ADVISED HE DID. DEPUTY SMITH FIRST BEGAN THE INTERVIEW BY DISCUSSING THAT THE DEFENDANTS HAD GIVEN US PERMISSION TO SEARCH WITH OFFICER RAINS WHEN SHE CONFIRMED. IT WAS ALSO EXPLAINED TO HIM DURING THIS SEARCH THAT AT ANY GIVEN TIME HE COULD ASK FOR THE SEARCH TO STOP AND IT WOULD BE AND HE WAS PRESENT AT THE SEARCH. DEFENDANT BENJAMIN HOLLIDAY ADVISED HE UNDERSTOOD THIS AND HE WISHED TO COOPERATE. HE FURTHER ADVISED THAT SINCE HIS ARREST HE CONTINUED TO USE METHAMPHETAMINES BUT HAD BEEN CLEAN NOW FOR APPROXIMATELY TWO AND A HALF WEEKS. WHEN CONFRONTED ABOUT THE ITEMS IN THE SHED, HE ADVISED THAT HE AND A SECOND SUBJECT MADE ARRANGEMENTS FOR THE OTHER SUBJECT TO MANUFACTURE AT THE RESIDENCE IN THE SHED IN EXCHANGE FOR DEFENDANT BENJAMIN HOLLIDAY AND DEFENDANT JESSICA HOLLIDAY TO BE GIVEN THE LEFT OVER METHAMPHETAMINE THAT WAS CAUGHT IN THE COFFEE FILTERS. WHEN DEFENDANT BENJAMIN HOLLIDAY WAS ASKED IF HIS FINGER PRINTS WOULD BE ON ANY OF THE ITEMS IN THE SHED, HE ADVISED HIS PRINTS WOULD BE ON ALL OF THE ITEMS DUE TO HIM GATHERING ALL THE ITEMS UP AT THE COMPLETION OF THE MANUFACTURING PROCESS AND PUTTING THEM WHERE THEY BELONG. WHEN ASKED HOW MUCH DOPE HE HAD GOTTEN OUT OF THE FILTERS. HE ADVISED APPROXIMATELY ONE QUARTER TO ONE HALF GRAM. DEFENDANT BENJAMIN HOLLIDAY FURTHER ADVISED THAT WHEN HE WAS USING THE METHAMPHETAMINE BOTH DEFENDANTS WERE STILL USING SYRINGES AND THERE STILL COULD BE SOME OF THEM LYING AROUND THE RESIDENCE. DEFENDANT BENJAMIN HOLLIDAY ALSO ADVISED OF A GLASS CONTAINER IN A BATHROOM CLOSET WHICH WAS USED TO PUT THE FILTERS IN AND SQUEEZE THE METH OUT OF. AT THIS TIME, DEPUTY SMITH CONDUCTED A DIGITALLY TAPED INTERVIEW WITH DEFENDANT JESSICA HOLLIDAY. SHE WAS HER MIRANDA WARNING FROM A PRE PRINTED, AGENCY ISSUED CARD. WHEN ASKED IF SHE UNDERSTOOD HER RIGHTS SHE ADVISED SHE DID AND WHEN ASKED IF SHE STILL WANTED TO SPEAK WITH DEPUTY SMITH SHE ADVISED SHE DID. DEFENDANT JESSICA HOLLIDAY ALSO WAS VERY HONEST AND STRAIGHT FORWARD. SHE ADVISED BOTH HER AND HER HUSBAND CONTINUED TO USE METHAMPHETAMINE SINCE THEIR LAST ARREST AND THEIR PREFERRED WAY OF USING IT WAS USING SYRINGES. DEFENDANT JESSICA HOLLIDAY ALSO STATED THEY HAD BEEN CLEAN FOR APPROXIMATELY TWO AND A HALF WEEKS AND THE LAST METHAMPHETAMINE THAT THEY USED CAME FROM THE COOK THAT HER HUSBAND AND THE OTHER UNKNOWN INDIVIDUAL CONDUCTED IN THE SHED. DEFENDANT JESSICA HOLLIDAY FURTHER ADVISED THAT THE DEAL WITH THE COOK WAS THAT WHEN THE COOK WAS COMPLETED THAT HER AND HER HUSBAND WOULD RECEIVE THE COFFEE FILTERS WHICH WERE SATURATED WITH METHAMPHETAMINE. WHEN ASKED IF HER FINGERPRINTS WOULD BE ON ANY OF THE ITEMS IN THE SHED, SHE ADVISED NO JUST HER HUSBAND AND THE OTHER MALE HANDLED THE MANUFACTURING PROCESS. SHE ALSO ADVISED THERE STILL MIGHT BE SOME SYRINGES AROUND THE RESIDENCE. UPON COMPLETING THIS INTERVIEW, A SEARCH OF THE RESIDENCE DID LEAD TO THE DISCOVERY OF THE FOLLOWING ITEMS: LOCATED IN THE MASTER BATHROOM UNDERNEATH THE SINK WAS A ROUND DEVICE USED TO CRUSH THE EPHEDRINE THIS DEVICE DID HAVE WHITE RESIDUE ON IT WHICH TESTED POSITIVE FOR EPHEDRINE, ALSO LOCATED UNDER THE SINK A PLASTIC CONTAINER OF COLEMAN FUEL, AN EMPTY CONTAINER OF LYE, AN EMPTY LITHIUM BATTER PACKAGE, COFFEE FILTERS. LOCATED IN THE BEDROOM WAS A RED COLORED TACKLE BOX WHICH CONTAINED COFFEE FILTERS, SUDAFED BOXES WITH BLISTER PACKS, LYE, FUNNELS, COLD PACKS, EMPTY LITHIUM BATTERY CASINGS AND STRIPS. ALSO PROBATION OFFICER RAINS POINTED OUT A PAIR OF NUNCHUCKS, TWO KNIVES AND A BULLET BELT WHICH CONTAINED NUMEROUS SHOT GUN SHELLS AND A KNIFE. IN A SECONDARY BEDROOM, A BOX WAS LOCATED WHICH CONTAINED NUMEROUS COFFEE FILTERS WHICH CONTAINED METHAMPHETAMINE RESIDUE, NUMEROUS PIECES OF LITHIUM STRIPS AND LITHIUM BATTERY CASINGS. ALL THESE ITEMS WERE TAKEN INTO EVIDENCE. ALL ITEMS DEEMED HAZARDOUS WERE SEGREGATED, NEUTRALIZED AND TURNED IN TO THE LANDFILL FOR DESTRUCTION. ALL OTHER ITEMS DEEMED SAFE THE SHOTGUN, AMMUNITION, SYRINGE, KNIVES, NUNCHUCKS, ALSO APPROXIMATELY 145 GRAMS OF METHAMPHETAMINE OIL WHICH DID FIELD TEST POSITIVE WAS RETRIEVED FROM THE ONE POT METHAMPHETAMINE COOK FROM THE SHED WERE TURNED IN TO EVIDENCE. BOTH DEFENDANTS WERE ARRESTED HANDCUFFED (DOUBLE LOCKED) AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WITH OUT INCIDENT. BOTH DEFENDANTSâ BONDS WERE SET AT $150,500.00 EACH PER THE BOND SCHEDULE. |
