SUBMITTED BY: MARTIN, PHILIP 0282 (AR08104939) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN DWELLING OR CURTILAGE THEREOF, LOCATED IN THE COUNTY AND STATE AFORESAID, THE PROPERTY OF THE VICTIM, AS OWNER OR CUSTODIAN THEREOF, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO WIT: ENTERING A RESIDENCE AND STEALING A T-SHIRT, IN VIOLATION OF FLORIDA STATE STATUTES 810.02(1) AND 810.02(3); AND DID UNLAWFULLY, WILLFULLY AND MALICIOUSLY INJURE OR DAMAGE CERTAIN PROPERTY OF THE VICTIM, TO-WIT: BREAKING A WINDOW PANE OF GLASS, SAID DAMAGE BEING OF A VALUE OF $200.00 OR LESS, IN VIOLATION OF FLORIDA STATUTES 806.13(1)(A) AND 806.13(1)(B)(1). ON 082808 AT APPROXIMATELY 1623 HOURS, I WAS DISPATCHED TO 35 SOUTH JEFFREY STREET IN BEVERLY HILLS IN REFERENCE TO A BURGLARY IN PROGRESS. UPON ARRIVAL, ON JEFFREY STREET I MADE CONTACT WITH THE HOMEOWNER'S SON, VICTIM TWO, WHO STATED THAT AN UNKNOWN FEMALE WAS INSIDE HIS RESIDENCE UPON HIM RETURNING TO THE RESIDENCE FROM SCHOOL TODAY. HE STATED THAT UPON BEING CONFRONTED BY HIM SHE LEFT THE RESIDENCE WALKING TOWARDS ROSE AVENUE FROM HIS RESIDENCE. VICTIM TWO FURTHER STATED THAT HE LOST SIGHT OF HER SOMEWHERE IN THE AREA OF ROSE AVENUE AND OSCEOLA STREET NEAR SOME HOUSES. HE PROVIDED A DESCRIPTION OF A WHITE FEMALE WEARING AN OLIVE GREEN SHIRT BLUE JEANS AND CARRYING TWO GREEN PLASTIC BAGS. AT THAT TIME, BASED ON THE INFORMATION I WENT AND ATTEMPTED TO LOCATE THIS FEMALE, HOWEVER, THIS ATTEMPT MET WITH NEGATIVE RESULTS IN LOCATING THE UNKNOWN FEMALE. I THEN RESPONDED BACK TO JEFFREY STREET TO MAKE CONTACT TO OBTAIN FURTHER INFORMATION. AT THAT TIME, THE HOMEOWNER HAD ALSO ARRIVED AT THE RESIDENCE. VICTIM TWO STATED THAT AT APPROXIMATELY 1630 HOURS HE RETURNED HOME FROM SCHOOL AND CAME THROUGH THE BACK DOOR OF HIS RESIDENCE. UPON ENTERING THE RESIDENCE HE SAW A WHITE FEMALE, WHICH HE DESCRIBED AS BEING PARTIALLY CLOTHED WEARING WHAT HE BELIEVED TO BE POSSIBLY PINK UNDERWEAR. HE STATED THAT THE UNKNOWN FEMALE WAS SITTING ON THE COUCH DRINKING A BEER WATCHING TELEVISION. HE STATED UPON THE UNKNOWN FEMALE SEEING HIM SHE BEGAN TO CLOTHE HERSELF TAKING A SHIRT THE BELONGED TO VICTIM TWO. VICTIM TWO DESCRIBED THAT SHIRT AS BEING AN OLIVE GREEN IN COLOR SHIRT WITH THE WORD OUTLOOK WRITTEN ON IT. HE ALSO STATED THAT THE UNKNOWN FEMALE (THE DEFENDANT) PUT ON HER JEANS AND APOLOGIZED SAYING THAT SHE DID NOT KNOW THE HOMEOWNER'S SON WAS GOING TO BE AT THE RESIDENCE. VICTIM TWO ASKED THE DEFENDANT WHO SHE WAS. AT WHICH TIME, HE STATED THAT SHE WAS A FRIEND OF HIS MOTHER'S. VICTIM TWO STATED THAT THE UNKNOWN FEMALE STARTED A SMALL CONVERSATION. VICTIM TWO STATED HE THEN WENT OUTSIDE AND ATTEMPTED TO CONTACT HIS MOM IN AN ATTEMPT TO VERIFY WHETHER OR NOT THIS FEMALE WAS SUPPOSED TO BE AT THEIR RESIDENCE. IT SHOULD BE NOTED THAT VICTIM TWO DOES NOT KNOW THE DEFENDANT NOR DID HE BELIEVE THAT HIS MOTHER HAD GIVEN HER PERMISSION TO BE AT THE RESIDENCE. IT WAS AT THAT TIME VICTIM TWO STATED TO THE SUSPECT THAT SHE WAS IN THE WRONG HOUSE AND VICTIM TWO STATED THAT SHE ADVISED SHE WAS FOR SURE AT THE RIGHT HOUSE. VICTIM TWO STATED THAT THE SUSPECT HAD TOLD HIM THAT HIS MOM'S NAME WAS JACKIE LYNN. THE SUSPECT BEGAN TO PACK HER STUFF AND LEFT OUT THE FRONT DOOR OF THE RESIDENCE. VICTIM TWO ALSO STATED THAT THE SUSPECT HAD TOLD HIM THAT SHE WAS 33 YEARS OF AGE AND HE ALSO AT THAT TIME PROVIDED FURTHER INFORMATION ON THE DESCRIPTION OF THE SUSPECT AS POSSIBLY HAVING A MOLE ON HER FACE, HOWEVER, HE COULD NOT REMEMBER WHICH SIDE. VICTIM TWO ALSO STATED THAT THE SUSPECT APPEARED TO BE INTOXICATED. AT THAT TIME, I ENTERED THE RESIDENCE. WHILE INSIDE THE RESIDENCE I LOCATED AN OPEN BUD LIGHT BOTTLE NEAR THE FRONT COUCH IN THE LIVING ROOM AREA OF THE RESIDENCE. I ALSO LOCATED A PACK OF CAMEL CIGARETTES ON THE COUNTER NEAR THE KITCHEN AS WELL AS ALSO LOCATING A GREEN PLASTIC BAG NEAR THE COUCH IN THE LIVING ROOM. I ALSO OBSERVED A BROKEN FRONT WINDOW WHICH HAD GLASS SHARDS ON THE OUTSIDE AS WELL AS THE INSIDE OF THE RESIDENCE. ALSO LOCATED INSIDE THE HOUSE ON THE COUCH WAS A TAN SPAGHETTI STRAP TYPE TANK TOP ON THE COUCH THAT DID NOT BELONG TO VICTIM ONE OR VICTIM TWO. CRIME SCENE TECHNICIAN (CST) HUTCHINSON RESPONDED TO THE SCENE TO TAKE PHOTOGRAPHS AS WELL AS COLLECT THE EVIDENCE LEFT BEHIND BY THE SUSPECT. IT SHOULD ALSO BE NOTED THAT IT APPEARED ALONG THE FRONT STOOP AREA OF THE RESIDENCE THAT SOMEONE HAD POSSIBLY DEFECATED ON THE PATIO. I SPOKE WITH VICTIM ONE, THE HOMEOWNER, WHO STATED THAT SHE HAD NOT GIVEN ANYONE PERMISSION TO BE IN HER RESIDENCE AND THAT ALSO SHE HAD RECEIVED A TELEPHONE CALL AT WORK TODAY FROM AN UNKNOWN PERSON. SHE FURTHER STATED THAT SHE DOES NOT DRINK AND THE BRAND OF CIGARETTES FOUND IN THE RESIDENCE DID NOT BELONG TO HER AS SHE SMOKES A DIFFERENT BRAND OF CIGARETTES. PRIOR TO THIS DEPUTY COMPLETING THE REPORT A CALL CAME IN FROM 33 SOUTH OSCEOLA STREET IN BEVERLY HILLS WHERE A FEMALE HAD COME TO THIS RESIDENCE AND STATED TO THE HOMEOWNER THAT DEPUTIES WERE LOOKING FOR HER. AT THAT TIME, CORPORAL CORBIN RESPONDED TO THAT ADDRESS AND MADE CONTACT WITH THE SUSPECT. IT SHOULD BE NOTED THAT THE SUSPECT WAS WEARING AN OLIVE GREEN T-SHIRT WITH THE PRINT OF OUTLOOK ACROSS IT AS WELL AS BLUE JEANS. THE SUSPECT ALSO HAD A MOLE ON THE RIGHT SIDE OF HER NOSE CONSISTENT WITH WHAT VICTIM TWO HAD STATED. AT THAT TIME, CORPORAL CORBIN PLACED THE SUSPECT UNDER ARREST AND TRANSPORTED HER TO THE CITRUS COUNTY DETENTION FACILITY. CORPORAL CORBIN ADVISED ME THAT HE HAD READ THE SUSPECT HER RIGHTS. AT WHICH TIME, SHE AGREED TO SPEAK WITH US. THE SUSPECT STATED THAT SHE HAD GONE TO THE AREA OF BEVERLY HILLS AND WAS DROPPED OFF AT A FRIEND'S RESIDENCE WHERE SHE STATED THAT SHE WAS INTRODUCED TO A GUY NAMED MIKE. THE SUSPECT STATED THAT UPON VICTIM TWO COMING INTO THE RESIDENCE SHE GOT SCARED AND SHE BROKE OUT THE FRONT WINDOW TO GET AWAY. SHE REPEATEDLY STATED THAT SHE HAD PERMISSION TO BE INSIDE THE RESIDENCE, HOWEVER, NO ONE BY THE NAME OF MIKE RESIDES AT THIS RESIDENCE. I ASKED THE SUSPECT IF SHE HAD BEEN DRINKING TODAY, TO WHICH SHE STATED YES. AT WHICH TIME, SHE STATED SHE HAD A BOTTLE OF JACK DANIELS AS WELL AS BEER. I ASKED THE SUSPECT IF SHE DRANK CANS OR BOTTLES, TO WHICH SHE STATED SHE HAD HAD BOTTLES OF BUD. THE SUSPECT WAS CHARGED WITH ONE COUNT OF BURGLARY AS WELL AS ONE COUNT OF CRIMINAL MISCHIEF FOR THE BROKEN WINDOW TO THE RESIDENCE. THE BOND WAS SET AT $5,500.00 FOR BOTH CHARGES PER THE BOND SCHEDULE. WHILE AT THE DETENTION FACILITY THE SHIRT THAT THE SUSPECT WAS WEARING WAS TAKEN AND WILL BE TURNED IN TO EVIDENCE. A PROPERTY RECEIPT WAS COMPLETED AND WILL ALSO BE TURNED IN TO EVIDENCE. *NOT-EXEMPT* |
