SUBMITTED BY: LAUGHLIN, JEREMY 0617 (AR15-16530) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: 0.5 GRAMS OF COCAINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: 19 GRAMS OF CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A BLUE AND WHITE GLASS PIPE, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). ON 092215, I WAS CONDUCTING TRAFFIC ENFORCEMENT IN THE AREA OF HIGHWAY 44 EAST WHEN I OBSERVED A FOUR-DOOR SILVER VEHICLE TRAVELING WESTBOUND TOWARDS INVERNESS. AS THE VEHICLE PASSED, I DID NOT OBSERVE A VEHICLE TAG LIGHT. A TRAFFIC STOP WAS CONDUCTED AT THAT TIME IN the AREA OF HIGHWAY 44 EAST AND WASHINGTON AVENUE ON A SILVER FOUR-DOOR MERCURY BEARING LICENSE PLATE NUMBER BYHM13. UPON MAKING CONTACT WITH THE DRIVER, I INFORMED HIM OF THE TRAFFIC INFRACTION AND REQUESTED HIS DRIVER'S LICENSE AND VEHICLE INFORMATION. DURING THIS TIME, I SMELLED THE ODOR OF FRESH CANNABIS EMITTING FROM the VEHICLE AT WHICH TIME I REQUESTED ANOTHER UNIT TO RESPOND TO MY LOCATION. UPON ARRIVAL OF THE OTHER UNIT, I HAD THE DRIVER EXIT THE VEHICLE and QUESTIONED HIM ABOUT THE SMELL OF CANNABIS EMITTING FROM HIS VEHICLE. THE DRIVER ADVISED THAT A PASSENGER HAD CANNABIS EARLIER IN the VEHICLE. THE DRIVER WAS PATTED DOWN WITH NO CONTRABAND LOCATED. I MADE CONTACT WITH the PASSENGER IDENTIFIED AS THE DEFENDANT, MS JESSICA SEXTON. UPON THE DEFENDANT EXITING THE PASSENGER DOOR OF THE VEHICLE, SHE HAD AN OBVIOUS BULGE IN the FRONT OF HER JEANS AT WHICH TIME she WAS ADVISED TO REMOVE THE CONTRABAND. SHE REMOVED A PLASTIC BAGGIE CONTAINING A GREEN LEAFY SUBSTANCE AND A BLUE AND WHITE GLASS SMOKING PIPE. THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED, (DOUBLE LOCKED), BEHIND HER BACK AT WHICH TIME SHE WAS WALKED TO THE BACK OF MY PATROL VEHICLE. SHE WAS ASKED IF SHE HAD ANY FURTHER CONTRABAND ON HER PERSON TO which SHE REPLIED SHE DID. THE DEFENDANT REMOVED A SMALL PLASTIC BAGGING FROM HER BRA THAT CONTAINED A WHITE POWDERY SUBSTANCE TO which SHE ADVISED WAS COCAINE. A SEARCH OF THE VEHICLE YIELDED NO FURTHER CONTRABAND AND THE DRIVER WAS RELEASED FROM the SCENE WITH A WARNING, NUMBER 388963b. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE COCAINE WEIGHT WAS 0.5 GRAMS AND THE CANNABIS WEIGHED A TOTAL OF 19 GRAMS. the DEFENDANT'S BOND WAS SET AT $4,000.00, PER THE BOND SCHEDULE. the CONTRABAND WAS TURNED IN TO EVIDENCE. |
