SUBMITTED BY: SEFFERN, JONATHAN 0623 (AR15-14735) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: 0.5 GRAMS OF METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A); AND DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: METHAMPHETAMINE PIPE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B); AND DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WALMART, TO WIT: FISHING ITEMS, WOMEN'S UNDERGARMENTS, WOMEN'S CLOTHING, VIDEO GAMES, CANDY, SUNGLASSES, AND COSMETIC ITEMS, CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $300.00, WITH A PRIOR CONVICTION, IN VIOLATION OF FLORIDA STATE STATUTES 812.015, 812.014(1), AND 812.014(3)(B). ON 04252015 I RESPONDED TO THE INVERNESS WAL-MART LOCATED AT 2461 EAST GULF TO LAKE HIGHWAY INVERNESS, FLORIDA 34453 IN REFERENCE TO A RETAIL THEFT THAT HAD JUST OCCURRED. UPON ARRIVAL I MADE CONTACT WITH LOSS PREVENTION OFFICERS WHO ADVISED THAT A WHITE FEMALE SUSPECT HAD ENTERED THE STORE AND BEGAN DISPLAYING SUSPICIOUS BEHAVIORS. AT THAT TIME THE BEGAN CONDUCTING FLOOR SURVEILLANCE MONITORING THE SUSPECT. DURING THEIR SURVEILLANCE THEY OBSERVED THE SUSPECT CONCEAL ITEMS IN HER BAG AND IN A PLASTIC WAL-MART BAG THAT SHE WAS CARRYING. THEY STATED THAT THE SUSPECT SELECTED FISHING ITEMS, WOMENâS UNDER GARMENTS, WOMENâS SHIRTS, COSMETIC ITEMS, VTECH VIDEO GAMES, CANDY AND SUNGLASSES. LOSS PREVENTION OFFICERS STATED THAT AT THAT POINT THE SUSPECT BEGAN WALKING TOWARDS THE STORE EXIT AND PASSED ALL POINTS OF SALE AND FAILED TO MAKE ANY ATTEMPT TO PAY FOR THE MERCHANDISE. THEY STATED THAT AT THAT POINT THEY ATTEMPTED TO STOP THE SUSPECT; HOWEVER, SHE TOOK FLIGHT ON FOOT INTO THE PARKING LOT AND ENTERED A MINIVAN WHICH QUICKLY DEPARTED. AT THAT TIME THEY WERE ABLE TO PROVIDE ME WITH SECURITY SURVEILLANCE VIDEO AND SHOW ME A STILL PHOTOGRAPH OF THE SUSPECT. I THEN BEGAN BOLOING THE AREA FOR THE SUSPECT VAN. WHILE DOING SO DISPATCH ADVISED THAT THEY RECEIVED A CALL THAT THE SUSPECT HAD BEEN DROPPED OFF NEAR BELMONT HILLS SUBDIVISION. AT THAT TIME I RESPONDED TO THAT LOCATION WHICH IS LESS THAN ONE MILE FROM WAL-MART. UPON ARRIVAL I LOCATED THE SUSPECT NEAR THE INTERSECTION. SHE WAS CARRYING A WHITE BAG AND A PLASTIC WAL-MART BAG. I THEN ASKED HER WHAT SHE WAS DOING AT WHICH TIME SHE EXPLAINED THAT SHE KNEW SHE WAS IN TROUBLE FOR STEALING THE MERCHANDISE AND WAS GOING TO GO BACK TO WAL-MART AND PAY FOR IT. I THEN ASKED FOR HER IDENTIFICATION TO WHICH SHE PROVIDED ME WITH A GOVERNMENT MONEY CARD BEARING THE NAME JESSICA SIMON. I WAS THEN ABLE TO CONFIRM THROUGH DRIVERS AND VEHICLE INFORMATION DATABASE (D.A.V.I.D) HER IDENTITY AS JESSICA SIMON LATER IDENTIFIED AS THE DEFENDANT. I THEN ASKED IF I COULD LOOK THROUGH HER BAGS FOR THE STOLEN MERCHANDISE TO WHICH SHE ADVISED YES. WHILE COLLECTING THE MERCHANDISE FROM BOTH BAGS I OBSERVED A SMALL CLEAR PLASTIC BAGGIE LOOSE IN THE BOTTOM OF THE WHITE BAG THAT CONTAINED A CRYSTALLINE SUBSTANCE WITHIN THAT I WAS ABLE TO IDENTIFY AS METHAMPHETAMINES THROUGH MY TRAINING AND EXPERIENCE. THE SUBSTANCE WAS FIELD TESTED UTILIZING A PRESUMPTIVE FIELD TEST KIT WHICH YIELDED A POSITIVE RESULT FOR THE PRESENCE OF METHAMPHETAMINES. I ALSO LOCATED A GLASS METHAMPHETAMINE PIPE WHICH WAS WRAPPED IN A BLUE CLOTH BANDANA WHICH WAS LOOSE IN THE WHITE BAG. ALL OF THE MERCHANDISE THAT WAS DESCRIBED BY LOSS PREVENTION OFFICERS WAS LOCATED AND LATER TURNED BACK OVER TO WAL-MART, AND TOTALED $195.81. AT THAT TIME THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED BEHIND HER BACK (DOUBLE LOCKED) AND SECURED IN THE REAR SEAT OF PATROL CAR. THE NARCOTICS WERE COLLECTED AND PACKAGED FOR LATER SUBMISSION INTO EVIDENCE. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL THE DEFENDANT WAS TURNED OVER TO DETENTION FACILITY STAFF AND SHE WAS CHARGED WITH ONE COUNT OF POSSESSION OF A CONTROLLED SUBSTANCE, ONE COUNT OF PARAPHERNALIA AND ONE COUNT OF RETAIL PETITE THEFT WITH A TOTAL BOND AMOUNT OF $4000.00 TYPED BY: SEFFERN, JONATHAN 0623 |
