Probable cause affidavit: SUBMITTED BY: PAYNE, JONATHAN 0305 (AR2542) THE DEFENDANT, MR JESSIE EUGENE BUTCHER, did unlawfully enter or remain in a certain conveyance, to-wit: A TWENTY FOOT IN LENGTH, ENCLOSED TRAILER, the property of HABITAT TO HUMANITY, without said person's consent, with the intent to commit an offense therein, to-wit: BURGLARY, and the said conveyance was not open to the public at the time, and MR WILLIAM ARON STOKES was not licensed or invited to enter or remain in said conveyance, in violation of Florida Statute 810.02. THE DEFENDANT, MR JESSIE EUGENE BUTCHER, did unlawfully enter or remain in a certain conveyance, to-wit: A TWENTY FOOT IN LENGTH, ENCLOSED TRAILER, the property of HABITAT TO HUMANITY, without said person's consent, with the intent to commit an offense therein, to-wit: BURGLARY, and the said conveyance was not open to the public at the time, and MR WILLIAM ARON STOKES was not licensed or invited to enter or remain in said conveyance, in violation of Florida Statute 810.02. THE DEFENDANT, MR JESSIE EUGENE BUTCHER, DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: HABITAT FOR HUMANITY, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN TWENTY THOUSAND DOLLARS ($20,000.00), TO WIT: MISCELLANEOUS TOOLS WORTH $2,250.00 WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014. THE DEFENDANT, MR JESSIE EUGENE BUTCHER, DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: HABITAT FOR HUMANITY, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN TWENTY THOUSAND DOLLARS ($20,000.00), TO WIT: MISCELLANEOUS TOOLS WORTH $2,250.00 WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014. ON 082812 AND 083012, HABITAT OF HUMANITY REPORTED THAT THEIR TWENTY FOOT TRAILER, WHICH WAS PARKED AT 8816 NORTH DELENE TERRACE IN CRYSTAL RIVER, HAD BEEN BROKEN INTO. EACH TIME THE TRAILER HAD BEEN BURGLARIZED. HABITAT FOR HUMANITY REPORTED THAT APPROXIMATELY $2,5000.00 WORTH OF TOOLS HAD BEEN STOLEN FROM THE TRAILER. ON 082812, IT WAS FOUND THAT NUMEROUS OLDER AND USED TOOLS, TO INCLUDE DRILLS, SAWS, AND OTHER MISCELLANEOUS TOOLS, HAD BEEN REMOVED FROM THE TRAILER. AFTER THE FIRST BURGLARY, HABITAT FOR HUMANITY THEN PURCHASED NUMEROUS NEW TOOLS, AND REPLACED THESE WITHIN THE SAME TRAILER, WHICH WAS THEN LOCKED AND SECURED. ON THE MORNING OF 083012, HABITAT FOR HUMANITY WORKERS DISCOVERED THAT UNKNOWN PERSONS HAD AGAIN ENTERED THE SAME TRAILER, AND REMOVED THE NEW REPLACEMENT TOOLS. A GAME SURVEILLANCE CAMERA WHICH HAD BEEN PREVIOUSLY INSTALLED IN THE AREA, REVEALED TWO INDIVIDUALS TO BE REMOVING ITEMS FROM THIS TRAILER DURING THE NIGHTTIME HOURS. UPON RECEIPT OF THIS INFORMATION, THIS DEPUTY PROCEEDED TO BOLO THE AREA OF THE INCIDENT. AN INDIVIDUAL MATCHING THE DESCRIPTION AND APPEARANCE OF THE SUBJECT CAPTURED ON THE GAME CAMERA, LATER IDENTIFIED AS DEFENDANT TWO, MR JESSIE EUGENE BUTCHER, WAS LOCATED AT 9052 NORTH RAINELLE AVENUE IN CRYSTAL RIVER. UPON BACKING UP DEPUTY COLEMAN (0247) AT THIS LOCATION, I OBSERVED A WHITE MALE, APPROXIMATELY SIX FEET IN HEIGHT, WITH A TATTOO ON THE LEFT SIDE OF HIS NECK, SPEAKING WITH DEPUTY COLEMAN. THIS SUBJECT DID MATCH THE APPEARANCE OF THE INDIVIDUAL IN THE PHOTOGRAPHS I HAD SEEN TAKEN FROM THE GAME CAMERA AT THE INCIDENT LOCATION. AT THAT TIME, DEPUTY COLEMAN ADVISED THAT AN INDIVIDUAL AT THE RESIDENCE HAD REVIEWED THE PHOTOGRAPHS, AND ADVISED THAT THEY WERE DEFENDANT TWO, MR JESSIE EUGENE BUTCHER, AND THE TALL MALE WHICH DEPUTY COLEMAN WAS SPEAKING WITH, LATER IDENTIFIED AS MR WILLIAM ARON STOKES., I AND DEPUTY COLEMAN THEN MADE CONTACT WITH DEFENDANT TWO, MR BUTCHER, WHO WAS READ HIS MIRANDA WARNING VIA PREPRINTED CARD. HE ADVISED THAT HE DID UNDERSTAND HIS RIGHTS, AND WISHED TO SPEAK WITH THIS DEPUTY. DEFENDANT BUTCHER ADVISED THAT DEFENDANT ONE, MR STOKES, AND HE HAD BROKEN INTO THE HABITAT FOR HUMANITY TOOL STORAGE TRAILER ON TWO SEPARATE OCCASIONS. HE ADVISED THAT THEY HAD HIDDEN THE STOLEN PROPERTY IN A WOODEN AREA NEAR THE HABITAT TRAILER. DEFENDANT ONE WAS ALSO READ HIS MIRANDA WARNING VIA PREPRINTED CARD, BY DEPUTY COLEMAN, AND ADVISED THAT HE UNDERSTOOD HIS RIGHTS AND WISHED TO SPEAK WITH THIS DEPUTY. DEFENDANT ONE, MR STOKES, CORROBORATED DEFENDANT TWO’S STATEMENTS. BOTH DEFENDANTS AGREED TO SHOW THIS DEPUTY THE LOCATION OF THE STOLEN PROPERTY. AT THIS TIME, BOTH DEFENDANTS WERE PLACED UNDER ARREST, AND BOTH DEFENDANTS WERE PLACED INTO HANDCUFFS. THEY WERE THEN TRANSPORTED TO THE INCIDENT LOCATION AT 8816 NORTH DELENE TERRACE IN CRYSTAL RIVER. BOTH DEFENDANTS SHOWED THIS DEPUTY VARIOUS AREAS IN THE PALMETTO BUSHES WHERE STOLEN PROPERTY HAD BEEN HIDDEN. THIS STOLEN PROPERTY WAS COLLECTED, AND LATER TURNED OVER TO HABITAT FOR HUMANITY BY THIS DEPUTY. HABITAT FOR HUMANITY REPRESENTATIVE POSITIVELY IDENTIFIED ALL PROPERTY AS PROPERTY WHICH HAD BEEN STOLEN FROM THE TRAILER. BOTH DEFENDANTS WERE THEN TRANSPORTED BACK TO 9052 NORTH RAINELLE AVENUE IN CRYSTAL RIVER. WHILE AT THE RESIDENCE, A LARGE RED COOLER WHICH HAD BEEN ALSO STOLEN FROM THE TRAILER AT THE INCIDENT LOCATION, WAS FOUND INSIDE OF THE DEFENDANTS’ RESIDENCE. INSIDE OF THE RESIDENCE WAS ALSO FOUND A STRIPED CAMOUFLAGE SHIRT, WHICH MATCHED THE CLOTHING DEFENDANT ONE HAD BEEN WEARING IN THE GAME CAMERA PHOTOGRAPHS. BOTH DEFENDANTS WERE THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. WHILE ON AUDIOTAPE, MIRANDA WAS READ ONCE MORE TO BOTH DEFENDANTS, WHO BOTH ADVISED THAT THEY DID UNDERSTAND THEIR RIGHTS AND WISHED TO SPEAK WITH LAW ENFORCEMENT. THE DEFENDANTS FURTHER STATED THAT THEY HAD USED ALLEN WRENCHES TO REMOVE AND REPLACE THE HINGES FROM THE HABITAT FOR HUMANITY’S TRAILER DOOR, TO GAIN ACCESS TO THE PROPERTY. BOTH DEFENDANTS ADVISED THAT THE SECOND TIME THEY HAD BROKEN INTO THE TRAILER, THEY WERE ORIGINALLY GOING TO REMOVE THE PROPERTY AND TOOLS THAT THEY HAD MISSED THE FIRST TIME. HOWEVER, UPON REALIZING THAT THE PROPERTY THEY HAD STOLEN TWO NIGHTS AGO HAD BEEN REPLACED ALREADY BY NEW TOOLS, THEY REMOVED THESE ITEMS INSTEAD. EACH DEFENDANT WAS CHARGED WITH TWO COUNTS OF BURGLARY TO AN UNOCCUPIED CONVEYANCE, AS WELL AS TWO COUNTS OF GRAND THEFT. DEFENDANT MR JESSIE EUGENE BUTCHER’S BOND WAS SET AT ROR.
