SAID PROPERTY BEING OF A VALUE OF $136.74 TO WIT: A COOKWARE SET, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HER OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, AND THE PROPERTY STOLEN WAS VALUED AT $100.00 OR MORE BUT LESS THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTE, 812.014(2)(E). ON 120116, I RESPONDED TO THE WALMART STORE LOCATED AT 1936 NORTH LECANTO HIGHWAY IN LECANTO, IN REFERENCE TO A RETAIL THEFT THAT HAD ALREADY OCCURRED. UPON ARRIVAL, I MADE CONTACT WITH THE STORE’S LOSS PREVENTION OFFICER, MR PATRICK HENRY, (COMPLAINANT). HE ADVISED THAT HE WAS REVIEWING THE MERCHANDISE RETURNS, AT WHICH TIME HE REVIEWED A RETURN THAT HAD NO RECEIPT. HE THEN COMPARED THE MERCHANDISE LISTED IN THE RECEIPT TO A RETURN THAT OCCURRED ON 112516, AT APPROXIMATELY 2220 HOURS. IN THE VIDEO FOOTAGE, THE DEFENDANT IS OBSERVED ENTERING THE STORE AT APPROXIMATELY 2214 HOURS; SELECTING A SHOPPING CART AND WALKING DIRECTLY TO THE HOUSEWARE’S DEPARTMENT. THE DEFENDANT IS SEEN SELECTING A BOX OF COOKWARE AND PROCEEDING TO THE CUSTOMER SERVICE AREA WHERE NO EMPLOYEES WERE CURRENTLY WORKING. THE DEFENDANT THEN MADE CONTACT WITH THE CASHIER AT THE SELF CHECK OUT AREA, WHERE SHE RETURNED THE BOX OF COOKWARE AND RECEIVED A GIFT CARD IN THE AMOUNT OF $136.74. THE DEFENDANT WAS IDENTIFIED AS MS JOANNE WHITLOCK BY THE IDENTIFICATION SHE PRESENTED AT THE TIME OF THE RETURN. THE DEFENDANT THEN EXITED THE STORE AT APPROXIMATELY 2221 HOURS. ON 120916, I MADE CONTACT WITH THE DEFENDANT AT HER RESIDENCE LOCATED AT 6 SOUTH COLUMBUS STREET IN BEVERLY HILLS. I CONDUCTED A POST MIRANDA INTERVIEW WITH THE DEFENDANT, AT WHICH TIME SHE DENIED ANY KNOWLEDGE OF MAKING A RETURN. I ADVISED THE DEFENDANT THAT SHE WAS BEING PLACED UNDER ARREST FOR ONE COUNT OF RETAIL PETIT THEFT, WHERE SHE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK AND SEATED IN THE REAR OF MY PATROL VEHICLE FOR TRANSPORT TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL, THE DEFENDANT WAS TURNED OVER TO DETENTION STAFF FOR BOOKING AND PROCESSING. THE DEFENDANT’S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE FOR THE LISTED CHARGE.
