SUBMITTED BY: ROUSH, SCOTT 0436 (AR11120709) did commit certain acts which are of such a nature as to corrupt the public morals or outrage the sense of public decency or affect the peace and quiet of a person who may witness them, or did engage in brawling or fighting, or in such conduct as to constitute a breach of the peace or disorderly conduct, in that THE DEFENDANT DID EXPOSE HIMSELF AND URINATE IN A PUBLIC PLACE, in violation of Florida Statute 877.03. DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY ROUSH, WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: THE DEFENDANT DID FLEE FROM DEPUTY ROUSH WHEN DIRECTED TO STOP AFTER URINATING IN A PUBLIC PLACE, WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02. ON 051111 WEDNESDAY, 051111, I OBSERVED A WHITE MALE SUBJECT, LATER IDENTIFIED AS THE DEFENDANT, JOHN JONES, DATE OF BIRTH, 091156, WALKING THROUGH THE INVERNESS GOVERNMENT CENTER PARKING LOT WHILE FUMBLING WITH HIS PANTS ZIPPER. AT THAT TIME I OBSERVED DEFENDANT JONES STOP IN THE MIDDLE OF THE GOVERNMENT CENTER PARKING LOT WHERE HE THEN URINATED IN FRONT OF PEOPLE/ WITNESSES. AS I APPROACHED THE DEFENDANT AND IDENTIFIED MYSELF AS A DEPUTY SHERIFF, I ALSO DIRECTED THE DEFENDANT TO STOP AS HE WAS WALKING WEST THROUGH THE PARKING LOT. AT THAT TIME HE LOOKED AT ME AND STATED, "NO", LOUDLY. HE THEN BEGAN TO RUN NORTH ONTO TOMPKINS STREET WHILE YELLING, "FUCK YOU, I HAVE IMMUNITY". HE THEN STOPPED IN THE MEDIAN AND TURNED TOWARD ME YELLING, "FUCK YOU", ASSUMED A FIGHTING STANCE AND RAISED ONE OF HIS ARMS TOWARDS ME. AT THAT TIME I TOOK HIM IN TO CUSTODY WHILE ESCORTING HIM TO THE GROUND. DETECTIVE WILSON, DEPUTY KANEHL AND DEPUTY DIXON THEN ARRIVED AND ASSISTED IN HANDCUFFING THE DEFENDANT, WHO WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY BY DEPUTY CUTLET.
