Probable cause affidavit: SUBMITTED BY: ZAREK, MICHAEL 1359 (AR15-15852)(15-97293) DID UNLAWFULLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: A WHITE POWERED SUBSTANCE, YIELDING POSITIVE RESULTS FOR COCAINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 072515, I RESPONDED TO 507 SOUTH JACKSON STREET, IN REFERENCE TO A VERBAL DISTURBANCE. UPON ARRIVAL, I made CONTACT WITH MS CATHERINE MORRISON, IN REFERENCE TO A VERBAL DISPUTE BETWEEN HER AND THE DEFENDANT, MR JOHN SPAGNUOLO. WHILE INTERVIEWING MS MORRISON IN her BEDROOM SHE ADVISED THE DEFENDANT IS A COCAINE USER AND CURRENTLY HAS COCAINE IN HIS BEDROOM. MS MORRISON THEN PUSHED OPEN THE DEFENDANT’S DOOR AND IN PLAIN VIEW, ON TOP OF THE DEFENDANT’S DRESSER WAS A TRIPLE BEAN SCALE WITH A WHITE POWERED SUBSTANCE LOCATED ON TOP OF THE SCALE. DEPUTY HUNTER (0441) ASKED the DEFENDANT IF ANYTHING ILLEGAL WAS INSIDE OF THE RESIDENCE, TO WHICH THE DEFENDANT REPLIED NO THERE WAS NOT. DEPUTY HUNTER THEN ASKED the DEFENDANT IF HE KNEW WHAT THE WHITE POWDERED SUBSTANCE IN HIS BEDROOM WAS, AND THE DEFENDANT REPLIED THE SUBSTANCE WAS A “MOCK COCAINE” POWDER THAT HE SNORTS TO GET HIGH, BUT WAS NOT COCAINE. the DEFENDANT STATED HE PURCHASED THE SUBSTANCE FROM THE INTERNET AND BOUGHT “AN EIGHTH, APPROXIMATELY $140.00.” THE DEFENDANT CONSENTED TO ALLOWING US TO ENTER HIS BEDROOM OF THE RESIDENCE AND TO TEST THE SUBSTANCE FOR COCAINE. DEPUTY MARSHALL (1336) ARRIVED ON SCENE with aN AGENCY ISSUED COCAINE TEST KIT. AT THAT TIME, DEPUTY MARSHALL TESTED THE POWERED SUBSTANCE, LOCATED ON TOP OF THE SCALE, LOCATED IN the DEFENDANT’S BEDROOM. the WHITE POWDERED SUBSTANCE YIELDED POSITIVE FOR COCAINE. THE DEFENDANT WAS THEN READ MIRANDA VIA PREPRINTED AGENCY CARD BY DEPUTY MARSHALL, AT 0053 HOURS. the DEFENDANT STATED THAT HE UNDERSTOOD HIS RIGHTS AND WISHED TO SPEAK WITH ALL DEPUTIES ON SCENE. DEPUTY MARSHALL ASKED THE DEFENDANT WHAT THE WHITE POWDERED SUBSTANCE WAS, THE DEFENDANT STATED THAT THE COCAINE IS A “MOCK COCAINE” SUBSTANCE THAT HE PURCHASED FROM THE INTERNET. DEPUTY MARSHALL THEN ASKED the DEFENDANT IF THE WHITE POWDERED SUBSTANCE THAT TESTED POSITIVE FOR COCAINE WAS INDEED HIS AND NO ONE ELSE’S, the DEFENDANT AGAIN STATED THE COCAINE WAS HIS AND HE PURCHASED IT FROM THE INTERNET. I INFORMED the DEFENDANT HE WAS BEING PLACED UNDER ARREST AND HE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK. THE DEFENDANT WAS SEARCHED AND IN HIS FRONT RIGHT CHANGE POCKET WAS A SMALL WAX PAPER PACKAGE, WHICH LATER TESTED POSITIVE FOR COCAINE. THE POWERED SUBSTANCE ON TOP OF the TRIPLE BEAN SCALE WAS PLACED INSIDE OF A CLEAN CELLOPHANE BAGGY, PROVIDED BY MS MORRISON, and HAD A TOTAL PACKAGE WEIGHT WITH THE BAG OF APPROXIMATELY 1.3 GRAMS. THE WHITE POWERED SUBSTANCE IN THE DEFENDANT’S FRONT RIGHT CHANGE POCKET WRAPPED IN A SMALL WAX PAPER PACKAGE WAS ALSO TESTED USING AN AGENCY ISSUED COCAINE TEST KIT, AND YIELDED A POSITIVE FOR COCAINE. THE COCAINE AND SMALL WAX PAPER PACKAGE HAD A TOTAL PACKAGE WEIGHT OF APPROXIMATELY 3.0 GRAMS. CRIME SCENE TECHNICIAN REPORT (CST) WAS DONE BY DEPUTY HUNTER. PHOTOGRAPHS WERE TAKEN OF THE COCAINE, AS WELL AS THE AGENCY ISSUED TEST KITS, SEE CRIME SCENE TECHNICIAN REPORT (CST) FOR FURTHER. THE DEFENDANT WAS PLACED IN the REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED to the CITRUS COUNTY DETENTION FACILITY AND CHARGED WITH ONE COUNT OF POSSESSION OF COCAINE LESS THAN 28 GRAMS. BOND WAS SET AT $2,000.00, PER THE BOND SCHEDULE. the CELLOPHANE WRAPPER CONTAINING 1.3 GRAMS OF COCAINE, ALONG WITH THE SMALL WAX PAPER PACKAGE OF COCAINE with a TOTAL APPROXIMATE WEIGHT OF 3.0 GRAMS WAS PACKAGED AND TURNED IN TO EVIDENCE with A TOTAL COMBINED WEIGHT OF 4.3 GRAMS, WITHOUT THE EVIDENCE PACKAGING. the DEFENDANT HAD $2,053.00 IN CASH ON HIM, WHICH WAS LEFT WITH MS MORRISON, PER THE DEFENDANT’S REQUEST, SEE DEPUTY MARSHALL AND DEPUTY HUNTER’S SUPPLEMENT FOR FURTHER.
