Probable cause affidavit: SUBMITTED BY: MILLER, DAVID 1337 (AR15-14725) (15-52646) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: DOG WORTH $600.00 WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)(C)(1). ON 042415, I RESPONDED IN REFERENCE TO AN ANIMAL CONTROL ASSISTANCE LOCATED AT 8 JAMES COURT IN BEVERLY HILLS, IN REFERENCE THIS CASE NUMBER. PRIOR TO MY ARRIVAL, I MADE CONTACT WITH ANIMAL CONTROL OFFICER ANDES (0748), WHO ADVISED AN EMPLOYEE AT THE COUNTRY SIDE ANIMAL CLINIC NOTICED THE DOG MATCHING THE DESCRIPTION OF THE ONE TAKEN IN THIS CASE AND A MALE SUBJECT, LATER IDENTIFIED AS MR JOHN SPATARO, SPEAKING AT THE CLINIC ON HOW HE OBTAINED A DOG FROM THE WAL-MART PARKING LOT. UPON MY ARRIVAL AT 8 JAMES COURT, MR SPATARO/DEFENDANT ANSWERED THE DOOR AND WAS ADVISED TO COME OUTSIDE IN REFERENCE TO SPEAKING WITH ME ABOUT THIS CASE. THE DEFENDANT WAS THEN READ HIS MIRANDA RIGHTS FROM A PREPRINTED AGENCY ISSUED CARD AND AFTER ADVISING HE UNDERSTOOD HIS RIGHTS, HE WISHED TO SPEAK WITH ME. THE DEFENDANT ADVISED ON 042215, HE OBSERVED A WHITE DOG THAT RESEMBLED A BOXER THAT WAS OUTSIDE OF A VEHICLE WITH THE LEASH STILL ATTACHED. THE DEFENDANT ADVISED HE BELIEVED THIS WAS INHUMANE AND CRUEL TO THE ANIMAL SO HE REMOVED THE COLLAR AND LEASH AND TOOK THE DOG HOME. THE DEFENDANT THEN CONFIRMED HE MADE NO ATTEMPT TO CONTACT ANY ANIMAL SHELTERS OR ANIMAL CONTROL IN REFERENCE TO THE DOG. AT THAT TIME, THE DEFENDANT BROUGHT THE DOG OUTSIDE, WHERE POSSESSION OF THE DOG WAS TURNED OVER TO ANIMAL CONTROL OFFICER ANDES WHO RETURNED THE DOG TO THE VICTIM AT HIS RESIDENCE. THE DEFENDANT THEN ADVISED HE WOULD FILL OUT A SWORN WRITTEN STATEMENT, THAT WAS LATER TURNED INTO CITRUS COUNTY SHERIFF'S OFFICE RECORDS. UPON COMPLETION OF THE SWORN WRITTEN STATEMENT, THE DEFENDANT WAS THEN PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED) AND SECURED IN THE REAR OF MY PATROL VEHICLE. HE WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE.
