| Probable cause affidavit: | SUBMITTED BY: COX, ANDY 0543 (AR09112153) did, knowing HIS driver's license or driving privilege had been cancelled, suspended or revoked, drive a motor vehicle upon the highways of this state while such license or privilege was cancelled, in violation of Florida Statute 322.34(2)(a). ON 120109, AT APPROXIMATELY 1350 HOURS, I OBSERVED A SILVER PICK-UP TRUCK LOADED DOWN with SCRAP METAL AND HOT WATER HEATERS. THE TAILGATE OF THE VEHICLE WAS DOWN, AND METAL WAS STICKING OUT BEYOND FOUR FEET WITH NO RED FLAG, AND THE ENTIRE LOAD WAS UNSECURE. THE TAILGATE WAS BLOCKING THE TOP PORTION OF THE TAG, WHERE I WAS UNABLE TO READ THE STATE. I THEN CONDUCTED A TRAFFIC STOP ON THE VEHICLE FOR THE VIOLATIONS. I MADE CONTACT WITH THE DRIVER/DEFENDANT, MR JOHN SURBER, AT WHICH TIME I ASKED HIM FOR HIS REGISTRATION, PROOF OF INSURANCE, AND DRIVER'S LICENSE. THE DEFENDANT THEN ADVISED ME THAT HIS LICENSE WAS SUSPENDED. A RECORDS CHECKED REVEALED THAT HIS LICENSE WAS SUSPENDED MULTIPLE TIMES, AND THAT HE WAS HABITUAL DRIVING WITH A SUSPENDED LICENSE. THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED (DOUBLE-LOCKED) BEHIND HIS BACK. HE WAS SECURED IN THE REAR SEAT OF MY PATROL VEHICLE, AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION, CITATION NUMBER 2018-FYA6 WITH A COURT DATE TO BE SET. THE DEFENDANT'S BOND WAS SET AT $2,000.00, PER THE BOND SCHEDULE. *NOT-EXEMPT* |
