| Commentaries: | Comments Shall enter into and successfully complete a sex offender treatment program. Shall have no contact with minors unless accompanied by a responsible adult who is aware of his convictions and has been approved in advance by his Community Corrections officer and his treatment provider. Shall have no direct or indirect with any victim or any victim family members. Shall not date women nor form relationships with families who have minor children, unless prior approval from his Community Corrections Officer. Shall not enter parks or playgrounds. Shall not loiter or frequent places where children tend to congregate, including, but not limited to Shopping Malls, Schools, Playgrounds, Parks, Public Pools, Skating Rinks, and Video Arcades. Shall not purchase, own, have in his possession or under his control any firearm . Shall not remain overnight in a residence where minor chiodren live or are spending the night. Shall not use, possess, consume any controlled substances without a lawfully issued prescription. Shall submit to polygraph exams as required. Whistman was convicted of 5 counts of Indecent Liberties on August 30, 1985 and was given a term of 30 years which was suspended by the court and he was placed on probation. Whistman remained in the Community from 1985 to 1990. He failed to abide by the conditions of supervision by having contact with minor children without appropriate supervision; and termination from his community based sexual treatment program. On August 27, 1990 the court recommended to the Board of Prison Terms and Parole a minimum term of 240 months. The court found the following aggravating factors to justify a recommended term beyond the standard range. Multiple counts per victim, used a position of trust, and not amenable to treatment. Whistman was involved in Little League Baseball and met 10 minor males ranging in ages 10 to 15 years. He would take the males on camping trips and on one occasion he took beer along and isolated one victim and sexually assaulted him. Whistman had stated that the abuse had been going on for six years. All of his victims were under the age of 14 and males. Whistman attended treatment while in the prison system. |
