Probable cause affidavit: SUBMITTED BY: DAVIS, JAMES 0525 (AR07004410) did unlawfully and knowingly have in HIS actual or constructive possession a controlled substance, to-wit: Cannabis, commonly referred to as Marijuana, in an amount in excess of twenty grams BUT UNDER FIFTY POUNDS, in violation of Florida Statutes 893.13(6)(a). ON 081007, I RESPONDED AS BACK UP TO DEPUTY BRUNK'S TRAFFIC STOP AT HIGHWAY 491 AND FERO'S FUNERAL HOME. UPON ARRIVAL, DEPUTY BRUNK HAD THE DRIVER/DEFENDANT (MR JONATHAN ELLISON V) DETAINED. AT THAT TIME, DEPUTY BRUNK ADVISED ME THAT THE DEFENDANT WAS IN POSSESSION OF MARIJUANA OVER TWENTY GRAMS. THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED (DOUBLE-LOCKED) AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE. DEPUTY BRUNK FURTHER EXPLAINED THAT WHILE RUNNING RADAR, HE CLOCKED THE DEFENDANT TRAVELING FIFTY-FIVE MILES PER HOUR INA POSTED FORTY-FIVE MILES PER HOUR SPEED ZONE. HE STATED THAT HE THEN CONDUCTED A TRAFFIC STOP ON THE DEFENDANT'S VEHICLE, A 1992 MERCURY FOUR DOOR BEARING FLORIDA TAG NUMBER R259RN. DURING THE TRAFFIC STOP, DEPUTY BRUNK ADVISED THAT HE DEPLOYED CANINE AJAX TO PERFORM AN EXTERIOR SNIFF ON THE VEHICLE. WHILE DOING SO, CANINE AJAX ALERTED ON THE VEHICLE FOR THE ODOR OF DRUGS OR NARCOTICS. DEPUTY BRUNK THEN RETURNED CANINE AJAX TO HIS PATROL VEHICLE AND RETURNED TO THE DEFENDANT'S LOCATION. UPON DOING SO, HE EXPLAINED THAT CANINE AJAX HAD ALTERED ON THE VEHICLE FOR THE ODOR OF DRUGS OR NARCOTICS. THE DEFENDANT THEN ADVISED DEPUTY BRUNK THAT HE HAD SOME MARIJUANA IN HIS POCKET. THE DEFENDANT REMOVED TWO CLEAR BAGGIES FROM HIS RIGHT PANTS POCKET AND PROVIDED THEM TO DEPUTY BRUNK. DEPUTY BRUNK COMPLETED A THOROUGH SEARCH OF THE DEFENDANT'S VEHICLE; HOWEVER, NO OTHER CONTRABAND WAS LOCATED. I WEIGHED THE TWO BAGGIES WITH A TOTAL WEIGHT OF APPROXIMATELY FORTY GRAMS. DEPUTY BRUNK LATER TURNED THE CONTRABAND INTO THE CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE LOCKER. I TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. HIS BOND WAS SET AT $5,000.00 PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED A WRITTEN WARNING, NUMBER 199325B, FOR EXCESSIVE SPEED (55/45) BY DEPUTY BRUNK. *NOT-EXEMPT*
