\tSUBMITTED BY: MILLER, DAVID 1337 (17-29116) (AR17-22819) \tdid, knowing HIS driver's license or driving privilege had been cancelled, suspended or revoked AS A HABITUAL TRAFFIC OFFENDER, drive a motor vehicle upon the highways of this state while such license or privilege was cancelled, in violation of Florida Statute 322.34(5). \t \tON 022617, WHILE CONDUCTING TRAFFIC ENFORCEMENT ON NORTH FLORIDA AVENUE, I WAS TRAVELING NORTHBOUND JUST NORTH OF BUSHWHACKER'S BAR, WHEN I OBSERVED A VEHICLE TRAVELING SOUTHBOUND AT A HIGH RATE OF SPEED, I ESTIMATED THE VEHICLE'S SPEED TO BE APPROXIMATELY 80 MILES PER HOUR. \t \tAT THAT TIME, I ACTIVATED MY FRONT MOVING RADAR, WHICH I HEARD A CLEAR AUDIO DOPPLER WITH A DIGITAL READING OF 83 MILES PER HOUR IN A POSTED 55 MILES PER HOUR ZONE. I THEN CONDUCTED A U-TURN AND ACTIVATED MY OVERHEAD EMERGENCY LIGHTS AND CONDUCTED A TRAFFIC STOP ON A SILVER IN COLOR FORD PICKUP TRUCK BEARING FLORIDA LICENSE PLATE HIVD97. \t \tI THEN MADE CONTACT WITH THE DRIVER/DEFENDANT, MR JONATHAN GIBSON, AND ADVISED HIM THE REASON FOR THE STOP. I REQUESTED THE DEFENDANT'S DRIVER'S LICENSE, REGISTRATION AND PROOF OF INSURANCE, WHICH HE DID PROVIDE THE REGISTRATION AND PROOF OF INSURANCE AND A FLORIDA IDENTIFICATION CARD. I ASKED THE DEFENDANT IF HE POSSESSED A VALID DRIVER'S LICENSE, WHICH HE ADVISED HE WAS CURRENTLY ON A WORK RELEASE PROGRAM THROUGH HIS PROBATION OFFICER AND HE BELIEVED HE DID. \t \tAT THAT TIME, I RETURNED TO MY PATROL VEHICLE AND RAN THE DEFENDANT'S INFORMATION THROUGH TELETYPE. I WAS ADVISED BY TELETYPE THAT the DEFENDANT DID NOT HAVE A VALID DRIVER'S LICENSE AND HIS DRIVER'S LICENSE WAS CURRENTLY REVOKED FOR 60 MONTHS FOR BEING A HABITUAL TRAFFIC OFFENDER. TELETYPE ALSO ADVISED THAT THE DEFENDANT RECEIVED COURT NOTICE OF HIS HABITUAL TRAFFIC OFFENDER STATUS ON 111616. \t \tI THEN RAN THE DEFENDANT'S INFORMATION THROUGH THE DRIVER AND VEHICLE INFORMATION DATABASE AT WHICH TIME, I DISCOVERED THE DEFENDANT TO HAVE MULTIPLE SUSPENSIONS, THAT INCLUDED AN FR SUSPENSION ON 112415, LICENSE CANCELED INDEFINITELY AND EXPIRED ON 042016, LICENSE SUSPENDED INDEFINITELY FOR FAILURE TO PAY TRAFFIC FINES ON 060616, DRIVER'S LICENSE SUSPENDED INDEFINITELY FAILURE TO PAY TRAFFIC FINES ON 072716, FR SUSPENSION ON 120616 AND DRIVER'S LICENSE REVOKED FOR 60 MONTHS FOR BEING A HABITUAL TRAFFIC VIOLATOR ON 120616. \t \tAT THAT TIME, THE DEFENDANT WAS ADVISED HE WAS BEING PLACED UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED, HABITUAL OFFENDER. THE DEFENDANT WAS THEN PLACED IN HANDCUFFS, DOUBLE-LOCKED, BEHIND HIS BACK AND PLACED IN THE REAR OF MY PATROL VEHICLE. \t \tTHE DEFENDANT WAS THEN TRANSPORTED TO CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. \t \tTHE DEFENDANT RECEIVED CRIMINAL FLORIDA UNIFORM TRAFFIC CITATION A1BU9EP FOR DRIVING WHILE LICENSE SUSPENDED OR REVOKED, HABITUAL OFFENDER, AND FLORIDA UNIFORM TRAFFIC CITATION A1BU9FP FOR FAILURE TO OBEY A TRAFFIC CONTROL DEVICE. \t \tTHE DEFENDANT'S BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE. \t \tCASE CLOSED BY ARREST. |
