SUBMITTED BY: EMRICK, AL 0104 (AR11124134) THE DEFENDANT DID UNLAWFULLY ENDANGER THE SAFETY OF ANOTHER OR THEIR PROPERTY WHILE INTOXICATED OR DID WHILE INTOXICATED OR DRINKING AN ALCOHOLIC BEVERAGE IN A PUBLIC PLACE, CAUSE A PUBLIC DISTURBANCE, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 856.011 AND THE DEFENDANT DID UNLAWFULLY AND WILLFULLY ENTER OR REMAIN IN A STRUCTURE OR CONVEYANCE, TO WIT: OUTBACK STEAKHOUSE RESTAURANT, THE PROPERTY OF THE VICTIM, WITHOUT BEING AUTHORIZED, LICENSED, OR INVITED TO DO SO BY THE OWNER, LESSEE, OR THEIR AGENT, IN VIOLATION OF FLORIDA STATE STATUTE 810.08(2)(B) AND THE DEFENDANT DID ENGAGE IN DISORDERLY CONDUCT ON THE PREMISES OF A LICENSED ESTABLISHMENT, TO WIT: OUTBACK STEAKHOUSE RESTAURANT, AND THAT SUCH CONDUCT WAS CAUSING A THREAT TO THE SAFETY OF OTHERS, IN VIOLATION OF FLORIDA STATE STATUTE 509.143(1) ON 122711, I WAS DISPATCHED TO THE OUTBACK STEAKHOUSE RESTAURANT LOCATED AT 2225 EAST GULF TO LAKE HIGHWAY IN INVERNESS IN REFERENCE TO A TRESPASS. UPON ARRIVAL, I MADE CONTACT WITH DEPUTY MULLINS, DEPUTY cutlip and the defeNdant. the defendAnt appeared to be intoxicated AND was argumentative with the deputies. i then spoke to the manager WHO GAVE A SWORN WRITTEN STATEMENT AND advised that the defendant had been there for a few hours, consuming alcoholic beverageS and becoming a nuIsance to other patrons by making offensive remarks. the manager asked the defendant to leave, ten to twelve times, and the defEndAnt refuSed. the defendant gave "the finger" to the manager. the defendant had to be physically removed from the bar. contact was also made with the bartender who gave a sworn written statement that the defendant was "bothering bar guests and people at tables" and when he was asked to leave, he became" very aggressive with the employees" and had to be physically removed. CONTACT WAS made WITH A PATRON WHO GAVE A SWORN WRITTEN STATEMENT THAT THE DEFENDANT WAS "VERY UNRULY" AND HAD MADE "ANNOYING COMMENTS AND REMARKS" TO HIS TABLE AND OTHER TABLES AND THAT THE DEFENDANT BECAME "AGGRESSIVE TO STAFF AND RESISTED LEAVING THE PREMISES.” THE DEFENDANT WAS ARRESTED, HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK, SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. UPON ARRIVAL, THE DEFENDANT WAS PROCESSED AND LATER RELEASED ON HIS OWN RECOGNIZANCE.
