DID LOITER AND/OR PROWL IN A PLACE, AT A TIME OR IN A MANNER NOT USUAL FOR LAW ABIDING INDIVIDUALS, UNDER CIRCUMSTANCES THAT WARRANT A JUSTIFIABLE AND REASONABLE ALARM OR IMMEDIATE CONCERN FOR THE SAFETY OF PERSON(S) OR PROPERTY IN THE VICINITY, IN VIOLATION OF FLORIDA STATE STATUTE OF 856.021. On 8-21-2013 at approximately 1950 hOURS, I observed a blue ford ranger leave from behind a closed business. The business Apache Sales and Service located at 30 NORTH FLORIDA aveNUE in Inverness. The truck left the parking lot very quickly. I was across the street and immediately started to follow the vehicle. ThAT was traveling south on u s HIGHWAY 41, then turned right onto Montgomery ave. The vehicle was stopped by a red light but quickly attempted to take off and was almost hit by a white pickup. I was able to get behind the vehicle again and activate my emergency lightS. Once I did this the suspect truck then moved into the center lane and eventually turned left onto South BOULEVARD. At this point, I noticed the passage later identified as suspect TWO, MR Brian Nevills. MR Nevills was moving around and appeared to be hiding something. The truck then pulled into the WTI parking lot and pulled into a parking space. I approached the truck and noticed several tires in the back. I obtained the driver's license from the driver. The Driver was identified as MR Johnathan a Senecal. I asked MR Senecal why he was behind a closed business for which he stated that they got junk tires from there. I asked if he had permission for which he stated he did not. I asked if the passenger MR Brian Nevills if he had permission for which he stated he did not. Contact was then made with the owner of Apache Sales, MR Mark Canova. MR Canova responded to our location where he identified the tires and wheels as his. He also signed a witness statement which he stated that no one had permission to enter his property and remove tires. MR Canova also provided a value of the tires and rims which he estimated them at approximately a total of $490.00. MR Canova also noticed that the right rear tire had been changed with one of his tires from a previous theft. MR Canova advised THAT he wanted to prosecute the suspects. A voluntary search of the vehicle, revealed AN aspirin Bottle that was converted into a pipe to smoke CANNABIS, which was found behind where defendant Nevills was sitting. Once the suspect 's where both placed under arrest and transported to the county jail Suspect ONE who during a post Miranda Digitally Recorded interview stated that this was the second time they went to the business. He further stated that both times he went that the co-defendant also went. He further advised that they had removed two of the tires from AN axle that was on the property. Suspect two, once at the jail was also read his Miranda Warning and agreed to talk to this deputy. MR Nevills advised that this was the first time he went there and it was defendant Senecal who planned to steal the tires. Suspect two also stated that he only went to the property one time and that was tonight. Both subjects are being held on a combined bond of $2,500.00. For loitering and prowling because they took flight upon seeing me and grand theft for stealing the tires.
