SUBMITTED BY: MARTIN, PHILIP 0282 (AR07100441) DID KNOWINGLY, WHILE HIS OPERATOR'S OR CHAUFFEUR'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE UPON THE HIGHWAYS OF THIS STATE, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). ON 112207, APPROXIMATELY 2250 HOURS, I WAS SITTING STATIONARY IN the AREA OF NORTH CITRUS SPRINGS BOULEVARD AND DELTONA BOULEVARD, FACING NORTH. A SILVER STATION WAGON APPROACHED FROM THE REAR OF MY VEHICLE, MAKING A LEFT TURN OFF OF DELTONA BOULEVARD ONTO GARDENIA DRIVE. AS THE VEHICLE MADE THE LEFT TURN, IT CAUGHT MY ATTENTION DUE TO THE VEHICLE TIRE'S SQUEALING AS THEY MADE THE TURN OFF DELTONA BOULEVARD ONTO GARDENIA DRIVE. IT APPEARED THAT THE VEHICLE WAS TRAVELING AT A HIGH RATE OF SPEED WHILE MAKING THIS TURN. AT THAT TIME, I PULLED OUT FROM MY LOCATION IN AN ATTEMPT TO CATCH UP TO THE VEHICLE TO OBSERVE ANY FURTHER ERRATIC DRIVING PATTERNS. AS I WAS APPROACHING GARDENIA DRIVE, WITH MY WINDOW DOWN, I WAS ABLE TO HEAR THE SQUEALING TIRES OF A VEHICLE A SECOND TIME. AS I APPROACHED AND TURNED ONTO GARDENIA DRIVE, I PASSED THE SAME SILVER STATION WAGON THAT I OBSERVED INITIALLY SQUEALING HIS TIRES COMING BACK TOWARD DELTONA BOULEVARD. IT SHOULD BE NOTED THIS VEHICLE WAS THE ONLY VEHICLE PRESENT IN THE AREA AT THE TIME. AS I PASSED THE VEHICLE, I OBSERVED A FEMALE WALKING DOWN THE MIDDLE OF GARDENIA DRIVE, AT which TIME I STOPPED AND MADE CONTACT WITH THE FEMALE, LATER IDENTIFIED AS MS ALEXIS LASH. WHILE SPEAKING WITH MS LASH, THE SILVER VEHICLE REMAINED STOPPED AT THE INTERSECTION OF GARDENIA DRIVE AND DELTONA BOULEVARD, AT WHICH TIME DEPUTY DAVIS ARRIVED ON SCENE AND MADE CONTACT WITH MR JONATHAN LOGAN WESLEY SPELL, DATE OF BIRTH, 112481. WHILE DEPUTY DAVIS WAS MAKING CONTACT WITH MR SPELL, HE ASKED MR SPELL FOR IDENTIFICATION, AT WHICH TIME MR SPELL VERBALLY STATED HIS LICENSE WAS SUSPENDED. DEPUTY DAVIS ALSO ADVISED ME THAT THE defendant STATED TO HIM THAT HE HAD LEFT HIS FIVE MONTH OLD CHILD AT HIS RESIDENCE UNATTENDED AT 9412 NORTH TRAVIS DRIVE IN CITRUS SPRINGS. AT THAT TIME, DEPUTY DAVIS TRANSPORTED THE defendant IN HIS PATROL VEHICLE BACK TO THE defendant'S RESIDENCE. UPON ARRIVAL AT THE RESIDENCE, HE FOUND THE FRONT DOOR TO BE AJAR. DEPUTY DAVIS ENTERED THE RESIDENCE WITH THE defendant TO CHECK THE WELL-BEING OF THE defendant'S SON, WHO WAS IN A CRIB IN THE BACK BEDROOM OF THE RESIDENCE. UPON CHECKING ON THE CHILD, DEPUTY DAVIS AND I, WHO WERE IN THE LIVING ROOM, OBSERVED THROUGH A WOODEN GLASS TABLE, IN PLAIN VIEW, A WOODEN JEWELRY BOX CONTAINING MARIJUANA, AS WELL AS DRUG PARAPHERNALIA. AT THIS TIME, THE defendant WAS PLACED UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED, AND DEPUTY DAVIS TRANSPORTED THE defendant TO CITRUS COUNTY DETENTION FACILITY WHERE HE WAS PROCESSED AND RELEASED ON HIS OWN RECOGNIZANCE. MR SPELL WAS ISSUED CITATION NUMBER 8570EVX, WITH A MANDATORY COURT DATE OF 121307 AT 1300 HOURS. *NOT-EXEMPT* |
