SUBMITTED BY: RICHEY, JONATHAN 0678 (AR14-12508) DID, KNOWING HIS DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(A). DEFENDANT DID REFUSE TO SUBMIT TO A LAWFUL TEST OF BLOOD, ALCOHOL, OR URINE IN VIOLATION OF FLORIDA STATE STAT 316.1939(1)(E). ON 102414, AT APPROXIMATELY 1917 HOURS, WHILE ON AN UNRELATED INVESTIGATION IN THE PARKING LOT OF THE PUBLIX IN CRYSTAL RIVER, I HEARD TIRES SCREECHING. AS I LOOKED UP, A WHITE SUV HAD ENTERED THE PUBLIX PARKING LOT FROM DUNKENFIELD STREET AND WAS DRIVING ON THE OPPOSITE LANE OF TRAVEL AT A HIGH RATE OF SPEED TOWARDS PEDESTRIANS THAT WERE CROSSING THE PARKING LOT. THE VEHICLE MADE A LEFT HAND TURN THROUGH THE PARKING LOT IN A RECKLESS MANNER, SCREECHING TIRES AND PROCEEDING TO THE EXIT ONTO HIGHWAY 44. THE VEHICLE CAME TO A STOP APPROXIMATELY 30 FEET PAST THE STOP SIGN OF THE PARKING LOT AND WAS IN THE LANE OF TRAVEL ON HIGHWAY 44. I PERFORMED A TRAFFIC STOP ON SAID VEHICLE AND THE VEHICLE RE- ENTERED THE PUBLIX PARKING LOT, STOPPING IN THE REGIONS BANK PARKING LOT. I APPROACHED THE VEHICLE ON THE PASSENGER SIDE, WHERE I MADE CONTACT WITH THE DRIVER, LATER IDENTIFIED AS THE DEFENDANT, MR JONATHON LOGAN SPELL, WHERE I ASKED TO SEE HIS DRIVER'S LICENSE AND REGISTRATION. HE ADVISED ME THAT HE WAS A HABITUAL TRAFFIC OFFENDER AND DID NOT HAVE A DRIVER'S LICENSE. I IMMEDIATELY OBSERVED THAT THE DEFENDANT HAD SLURRED SPEECH AND SLOW REACTION. I HAD DEPUTY NORTON ASK THE DEFENDANT TO STEP OUT OF THE VEHICLE, WHERE HE WAS PLACED IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK. THE DEFENDANT WAS PLACED IN MY PATROL VEHICLE, AT WHICH TIME IT WAS CONFIRMED THAT HE HAD MULTIPLE SUSPENSIONS. ONE OF THE SUSPENSIONS WAS ON 061506, FOR DUI AND THE DEFENDANT WAS CLASSIFIED AS A HABITUAL TRAFFIC OFFENDER ON 021408. I ADVISED THE DEFENDANT THAT HE WAS BEING PLACED UNDER ARREST. HE WAS READ HIS MIRANDA WARNINGS AND IMPLIED CONSENT, WHERE HE REFUSED. I ASKED FOR PERMISSION TO SEARCH THE VEHICLE, WHICH HE GRANTED. AFTER THE VEHICLE WAS SEARCHED THE PASSENGER/WITNESS, MR NICHOLAS SERRECCHIO, WAS RELEASED AND THE VEHICLE WAS RELEASED TO THE DEFENDANTâS WIFE, MS BRIDGET JASINSKI, WHO HAD RESPONDED TO THE SCENE. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY, WHERE HE WAS TURNED OVER TO DETENTION FACILITY OFFICER SEAN MCCAZZIO, WHERE HE ALSO REFUSED TO SUBMIT. OFFICER MCCAZZIO PROVIDED ME WITH THE REFUSAL TO SUBMIT AFFIDAVIT, WHICH WAS LATER TURNED IN TO RECORDS. THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION NUMBER 5284GZP5, FOR DRIVING WHILE LICENSE SUSPENDED KNOWINGLY AND BEING A HABITUAL TRAFFIC OFFENDER, WITH A COURT DATE TO BE DETERMINED. HE WAS ALSO ISSUED UNIFORM TRAFFIC CITATION NUMBER 4745XEX3, FOR REFUSAL TO SUBMIT WITH A COURT DATE TO BE DETERMINED. THE DEFENDANT WAS CHARGED ACCORDINGLY, WHERE HIS BOND WAS SET AT $1,000.00 FOR THE REFUSAL TO SUBMIT CHARGE AND $10,000.00, FOR THE DRIVING WHILE LICENSE SUSPENDED KNOWINGLY, WITH A PRIOR DUI CONVICTION, FOR A TOTAL BOND AMOUNT OF $11,000.00, PER THE BOND SCHEDULE. |
