| Probable cause affidavit: | SUBMITTED By: PHILLIPS, SHANNON 0223 (AR14-13077) (14-167502) ON 120814, THIS DEPUTY WAS DISPATCHED TO A MINOR ACCIDENT AT NORTH CITRUS AVENUE AND WEST WOODHAVEN LANE IN CRYSTAL RIVER. UPON ARRIVAL, CONTACT WAS MADE WITH THE DEFENDANT, MS JORDAN GARCIA. WHEN THIS DEPUTY MADE CONTACT WITH MS GARCIA, SHE WAS STILL SITTING IN the DRIVER SIDE FRONT SEAT OF HER VEHICLE. WHILE SPEAKING WITH MS GARCIA, THIS DEPUTY COULD SMELL THE ODOR OF MARIJUANA. I COULD ALSO SEE A SMALL GREEN LEAFY "SHAKE" ON the FRONT OF HER PANTS. I OBTAINED MS GARCIA'S INFORMATION and WALKED BACK TOWARDS MY VEHICLE, AT which TIME K-9 DEPUTY VIGGIANO ARRIVED ON SCENE. DEPUTY VIGGIANO WALKED HIS CANINE AROUND MS GARCIA'S VEHICLE AND GOT A POSITIVE ALERT. WHILE THIS DEPUTY WAS COMPLETING THE ACCIDENT INVESTIGATION, DEPUTY VIGGIANO SEARCHED MS GARCIA'S VEHICLE WHERE HE LOCATED A SMALL MULTICOLORED WOOD SMOKING BOX THAT CONTAINED A WHITE "ONE HITTER" TYPE PIPE. AFTER COMPLETING THE TRAFFIC INVESTIGATION, THIS DEPUTY ASKED MS GARCIA IF the BOX BELONGED TO HER AND SHE ADVISED YES. IT WAS AN OLD ONE AND SHE HAD FORGOTTEN IT WAS IN the VEHICLE. MS GARCIA WAS WRITTEN A NOTICE TO APPEAR CITATION, NUMBER 20031, WITH MANDATORY COURT DATE OF 010815 AT 1300 HOURS. THE BOX WAS TAKEN AND TURNED INTO EVIDENCE. MS GARCIA WAS THEN RELEASED FROM the SCENE. |
