SUBMITTED BY: BERRIOS, JUAN 0514 (AR11122901) MACIAS, JOSEPH 0756 THE DEFENDANT DID UNLAWFULLY AND INTENTIONALLY THREATEN BY WORD OR ACT TO DO VIOLENCE TO THE PERSON OF THE VICTIM, COUPLED WITH AN APPARENT ABILITY TO CARRY OUT SAID THREAT, AND UTILIZED A DEADLY WEAPON, TO WIT: A KNIFE, WITHOUT THE INTENT TO KILL, AND DID AN ACT OR ACTS WHICH CREATED A WELL-FOUNDED FEAR IN THE VICTIM THAT SUCH VIOLENCE WAS IMMINENT, IN VIOLATION OF FLORIDA STATE STATUTE 784.021(1)(A) AND THE DEFENDANT DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: A PAIR OF SNEAKERS, OF THE VALUE OF ONE HUNDRED DOLLARS ($100.00) OR MORE, BUT LESS THAN THREE HUNDRED DOLLARS ($300.00), TO WIT: $100.00, AND THE PROPERTY WAS TAKEN FROM WITHIN A DWELLING, IN VIOLATION OF FLORIDA STATUTE 812.014(2)(D) ON 092511, I RESPONDED TO 62 BEVERLY HILLS BOULEVARD IN BEVERLY HILLS IN REFERENCE TO AN ASSAULT. ACCORDING TO THE VICTIM AND THE WITNESSES, THEY SAW THE DEFENDANTS WALK INTO THE RESIDENCE AND MAKE CONTACT WITH THE VICTIM IN HIS BEDROOM. DEFENDANT MARCOS TORO HELD A KNIFE TO THE VICTIM'S CHEST AND THROAT. DEFENDANT JOSE GALARZA HELD THE VICTIM ON THE BED WHILE DEFENDANT JOSE HERNANDEZ THREATENED THE VICTIM WITH A CLOTHES IRON. DEFENDANT TORO ALSO POKED THE VICTIM WITH THE KNIFE. DEFENDANT TORO THEN STOLE THE VICTIM'S BOOTS, VALUED AT $150.00, AND WAS WEARING THEM WHEN I ARRIVED. DEFENDANT HERNANDEZ STOLE A PAIR OF THE VICTIM'S SNEAKERS, VALUED AT $100.00, AND PLACED THE SNEAKERS IN THEIR VEHICLE. THE DEFENDANT'S WERE ARRESTED AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. STATEMENTS AND PHOTOGRAPHS WERE LATER TURNED IN TO RECORDS AND THE RECOVERED KNIFE WAS TURNED IN TO EVIDENCE. THE DEFENDANT'S BOND WAS SET AT A TOTAL OF $7,000.00, IN ACCORDANCE WITH THE BOND SCHEDULE.
