Probable cause affidavit: SUBMITTED By: HESSE, NICK 0689 (AR10118210) DID DRIVE A MOTOR VEHICLE UPON A HIGHWAY IN THE STATE OF FLORIDA WITHOUT HAVING A VALID DRIVER'S LICENSE AUTHORIZING HIM TO DO SO, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 322.03(1). ON 120310 AT APPROXIMATELY 2200 HOURS, WHILE TRAVELING NORTHBOUND ON US 41 IN the AREA OF AIRPORT ROAD, I OBSERVED A BLACK LINCOLN SPORTS UTILITY VEHICLE (SUV) PULL FROM BEHIND the FURNITURE PALACE and TURN SOUTHBOUND ON US 41. I ALSO OBSERVED THE BUSINESS TO BE CLOSED and the BLACK SUV CARRYING A KING SIZED MATTRESS ON TOP OF IT. DUE TO the CIRCUMSTANCES, I INITIATED A TRAFFIC STOP ON the BLACK SUV BEARING FLORIDA TAG 6422IX, AT THE INTERSECTION OF US 41 SOUTH AND AIRPORT ROAD. UPON MAKING CONTACT WITH DRIVER/DEFENDANT, HE PROVIDED A MEXICAN CONSULATE CARD IDENTIFYING HIM AS MR JOSE RAFAEL HERNANDEZ-LOPEZ. THE PASSENGER ADVISED THAT SHE AND THE DEFENDANT HAD REMOVED THE MATTRESS FROM the GARBAGE BEHIND the BUILDING AND WERE TAKING IT HOME. THE PASSENGER WAS IDENTIFIED AS MS MARIA BENAVIEDES. I THEN RETURNED TO MY PATROL VEHICLE WHERE I CONDUCTED A WANTS and WARRANTS CHECK ON BOTH the DEFENDANT MR HERNANDEZ-LOPEZ AND MS BENAVIEDES. THE WARRANTS CHECK REVEALED NEGATIVE RESULTS; HOWEVER, IT WAS LEARNED THAT THE DEFENDANT DOES NOT CURRENTLY HOLD A VALID DRIVER'S LICENSE AND HAS NEVER HAD ONE. I THEN MADE CONTACT with the DEFENDANT and REMOVED HIM FROM the VEHICLE AND SEARCHED HIM FOR WEAPONS AND CONTRABAND AND PLACED HIM UNDER ARREST FOR NO VALID DRIVER'S LICENSE NEVER HAD ONE. THE DEFENDANT WAS HANDCUFFED (DOUBLE-LOCKED) BEHIND his BACK AND SECURED IN the REAR SEAT OF MY PATROL VEHICLE. DEPUTY HUNTER RESPONDED as BACK UP and IT WAS ALSO LEARNED THAT MS BENAVIEDES, THE OWNER OF THE VEHICLE, ALLOWED THE DEFENDANT TO DRIVE WHILE KNOWING THAT HE WAS UNLICENSED AND SHE WAS CITED. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS ISSUED FLORIDA UNIFORM TRAFFIC CITATION 2146-ETP AND A FIELD INTERVIEW REPORT WAS COMPLETED. AFTER LEAVING, DEPUTY DEARDEN ALSO CHECKED THE EXTERIOR OF THE FURNITURE PALACE FOR ANY DAMAGE; HOWEVER, WAS LOCATED. THE DEFENDANT'S BOND WAS SET AT $150.00, PER THE BOND SCHEDULE.
