Probable cause affidavit: | SUBMITTED BY: RUBY, SAMUEL 0562 (AR09110465) DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: DEFENDANT PUNCHED THE VICTIM IN THE CHEST WITH A CLOSED FIST, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 081309, AT 0520 HOURS I WAS DISPATCHED TO 1030 S E HIGHWAY 19, IN CRYSTAL RIVER, IN REFERENCE TO A BATTERY IN PROGRESS. UPON ARRIVAL, I MADE CONTACT WITH THE VICTIM, MR WAYNE JAREMA, WHO ADVISED THAT WHILE INSIDE THE RACE TRACK GASOLINE STATION HE WAS STANDING IN LINE TO PAY FOR HIS ITEMS, WHEN FIVE OR SIX HISPANIC MALES WERE YELLING IN THE STORE. THE VICTIM STATED THAT HE ASKED ONE OF THE HISPANIC MALES TO STOP YELLING, AND WAS THEN APPROACHED BY ALL THE HISPANIC MALES THAT WERE IN THE STORE. THE VICTIM THEN ADVISED THAT THEY ASKED HIM IF HE OWNED THE STORE. THE ARGUMENT CONTINUED WHEN THE DEFENDANT, MR JOSE GARCIA-OLIVA, THREW HIS DRINK ON THE FLOOR AND PUNCHED THE VICTIM IN THE CHEST. THE VICTIM ADVISED THAT HE THEN LEFT THE STORE AND PROCEEDED TO THE PARKING LOT WHEN THE DEFENDANT'S COUSIN CAME OUTSIDE AND ENTERED A WHITE FORD PICKUP TRUCK RETRIEVING A BASEBALL BAT. THE VICTIM STATED THAT THE DEFENDANT'S COUSIN BEGAN BEATING THE BASEBALL BAT ON THE GROUND AND TELLING HIM TO COME ON. THE VICTIM TOLD THE DEFENDANT'S COUSIN THAT HE DID NOT WANT TO TAKE IT TO THAT LEVEL. AT THAT TIME, ALL THE HISPANIC MALES ENTERED THE WHITE FORD PICKUP TRUCK AND DROVE NORTHBOUND ON HIGHWAY 19. I ADVISED DISPATCH TO ISSUE A "BOLO" FOR THAT VEHICLE, BEARING FLORIDA TAG 148IPE. THE VEHICLE WAS LATER FOUND AT THE POWER PLANT BY SERGEANT LANE. THE DEFENDANT AND HIS COUSIN RETURNED TO THE CRYSTAL RIVER SUB STATION WHERE THE DEFENDANT WAS IDENTIFIED BY THE VICTIM. THE DEFENDANT WAS THEN PLACED UNDER ARREST, HANDCUFFED DOUBLE LOCKED IN BACK, SECURED IN MY PATROL VEHICLE, AND TRANSPORTED TO THE CITRUS COUNTY DETENTION CENTER. THE DEFENDANT'S COUSIN DID STATE THAT THE DEFENDANT PUNCHED THE VICTIM AND THAT HE DID RETRIEVE THE BASEBALL BAT FROM THE TRUCK AS HE WAS NOT SURE OF THE VICTIM'S INTENTIONS. THE VICTIM WAS GIVEN AN AGENCY CASE CARD BEARING MY NAME AND THIS CASE NUMBER. THE VICTIM WAS ADVISED TO CONTACT THIS AGENCY WITH ANY FURTHER INFORMATION. *NOT-EXEMPT* |
