Probable cause affidavit: | SUBMITTED BY: STRICKLAND, DALE 0276 (AR16-19980) (16-84679) ON 062116, I WAS DISPATCHED TO THE AREA OF GROVER CLEVELAND BOULEVARD IN REFERENCE TO A THEFT. IT WAS RELAYED TO DISPATCH THAT THE VICTIM WAS FOLLOWING THE SUSPECT VEHICLE DOWN GROVER CLEVELAND BOULEVARD. I WAS ADVISED THE INDIVIDUALS IN THE SUSPECT VEHICLE HAD TAKEN MONEY FROM the VICTIM'S CONSOLE IN HIS TRUCK WHILE IT WAS AT THE RACETRAC IN HOMOSASSA. AS I APPROACHED the CORNER OF SOUTH PITTSBURGH AVENUE AND GROVER CLEVELAND BOULEVARD, I OBSERVED A NISSAN SENTRA, BLUE IN COLOR, BEARING FLORIDA LICENSE PLATE 481NKG, TURN ONTO SOUTH PITTSBURG AVENUE PAST ME. I ALSO OBSERVED THE VICTIM POINTING AT THE VEHICLE. I THEN TURNED AND INITIATED MY LIGHTS IN ORDER TO CONDUCT A TRAFFIC STOP. THE VEHICLE CAME TO A STOP ON SOUTH PITTSBURG AVENUE AND WEST AQUADUCT STREET. I THEN MADE CONTACT WITH the DRIVER, MR CHARLES MCKEEHAN, WHO WAS THEN ASKED TO STEP OUT OF the VEHICLE. HE WAS THEN ASKED WHAT HAD OCCURRED DOWN THE ROAD and WHY HE WAS FOLLOWED BY the VICTIM. MR MCKEEHAN STATED HE HAD NO IDEA WHAT WAS GOING ON. HE ADVISED HE KNOWS THE GUY "JOE" IN THE PASSENGER SEAT, WHO WAS LATER IDENTIFIED AS MR JOSEPH BAXLEY, THE DEFENDANT, AND he ADVISED THE TWO INDIVIDUALS IN HIS BACK HE DID NOT NECESSARILY KNOW. I THEN MADE CONTACT WITH MR JOSEPH BAXLEY, THE DEFENDANT, WHO WAS SITTING ON THE PASSENGER SIDE OF THE VEHICLE. I ASKED the DEFENDANT TO STEP OUT OF the VEHICLE. WHILE SPEAKING WITH the DEFENDANT, I ASKED HIM IF HE MINDED IF I PATTED HIM DOWN AND IF HE HAD ANYTHING ON HIM THAT MIGHT STICK ME OR ANY DRUGS OR NARCOTICS. HE STATED HE HAD A "RIG" MEANING A HYPODERMIC NEEDLE. I THEN ASKED HIM WHERE IT WAS AND HE STATED IT WAS IN HIS PANTS POCKET. I PATTED the DEFENDANT DOWN FOR WEAPONS. I THEN ASKED HIM IF HE MINDED EMPTYING HIS POCKETS ON THE HOOD OF MY PATROL VEHICLE. HE STATED NO. HE THEN PULLED OUT his CELLULAR TELEPHONE AND THE HYPODERMIC NEEDLE IN QUESTION. AFTER THE INVESTIGATION OF THE THEFT, IT WAS DETERMINED THAT THE VICTIM DID NOT WISH TO PURSUE CHARGES DUE TO THE FACT THAT THERE WAS NO MONEY MISSING FROM the CONSOLE OF HIS VEHICLE. THE DEFENDANT WAS ISSUED A NOTICE TO APPEAR (NTA) CITATION FOR POSSESSION OF DRUG PARAPHERNALIA, NUMBER 21006, WITH A MANDATORY COURT DATE OF 070716 AT 1300 HOURS. THE DEFENDANT WAS GIVEN HIS COPY OF THE NTA. HE ADVISED HE UNDERSTOOD ALL THE INSTRUCTIONS and WOULD APPEAR. THE HYPODERMIC WAS TURNED INTO THE CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE AFTER TESTING POSITIVE FOR METHAMPHETAMINE. |
