Probable cause affidavit: submitted by: TAYLOR, MATT 0400 (AR14-11433) DID UNLAWFULLY TAKE FROM THE PERSON OR CUSTODY OF THE VICTIM, MR MICHAEL SPARKS, CERTAIN PROPERTY OF VALUE, TO WIT: $330.00, CLOTHING, SHOES, XANAX PILLS, AND THE VICTIM'S WATCH, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE MR SPARKS OF A RIGHT TO THE PROPERTY, OR A BENEFIT THEREOF BY FORCE, VIOLENCE, ASSAULT, OR PUTTING THE SAID VICTIM IN FEAR, AND IN THE COURSE THEREOF THERE WAS CARRIED A FIREARM OR OTHER DEADLY WEAPON, TO WIT: A BLACK HANDGUN, SAID FIREARM BEING IN POSSESSION OF THE DEFENDANT, MR JOSEPH CALCAGINO, IN VIOLATION OF FLORIDA STATE STATUTE 812.13(2)(a); AND DID UNLAWFULLY AND INTENTIONALLY TOUCH OR STRIKE THE VICTIM, MR MICHAEL SPARKS, AGAINST MR SPARKS WILL OR INTENTIONALLY CAUSE BODILY HARM TO SAID PERSON AND IN THE COMMISSION OF SAID BATTERY DID INTENTIONALLY OR KNOWINGLY CAUSE GREAT BODILY HARM, PERMANENTE DISABILITY OR PERMANENTE DISFIGUREMENT TO SAID PERSON AND IN THE COMMISSION OF SAID OFFENSE THE DEFENDANT, MR JOSEPH CALCAGINO, DID CARRY, DISPLAY, USE, OR ATTEMPT TO USE A WEAPON OR FIREARM, IN VIOLATION OF FLORIDA STATE STATUTE 784.045(1)(a)(1) AND 775.087(1). ON 080114, AT APPROXIMATELY 1508 HOURS, DEPUTIES WERE DISPATCHED TO THE AREA OF HAVEN STREET AND SOUTH BORDER AVENUE IN INVERNESS, IN REGARDS TO A MALE, LATER IDENTIFIED AS THE VICTIM, MR MICHAEL SPARKS, BLEEDING FROM BOTH SIDES OF HIS FACE, ONLY WEARING BOXER SHORTS AND ONE SOCK WALKING AIMLESSLY DOWN THE STREET. ONCE CONTACT WAS MADE WITH THE VICTIM, HE INFORMED THEM THAT HE HAD BEEN BEATEN WITH A HANDGUN AND ROBBED OF ALL OF HIS BELONGINGS. THE VICTIM STATED THAT EARLIER IN THE DAY HE WENT TO A FRIEND’S RESIDENCE IDENTIFIED AS WITNESS, MR MIKE GERARDI, AND WAS GIVEN A RIDE BY MIKE’S FRIENDS WHICH WERE ANOTHER MALE AND A FEMALE, TO REXALL DRUGS IN INVERNESS, SO THAT HE COULD GET PRESCRIPTIONS FILLED. THE PRESCRIPTIONS WERE FOR OXYCODONE AND METHADONE, ALONG WITH SIX OTHER MEDICATIONS THAT WERE NOT CONTROLLED SUBSTANCES. ONCE AT REXALL DRUGS, THE UNKNOWN MALE AND MIKE GERARDI FOLLOWED THE VICTIM INTO THE STORE. THE VICTIM STATED THAT AS HE WAS WAITING FOR HIS PRESCRIPTIONS TO BE FILLED THE UNKNOWN WHITE MALE WEARING A RED SHIRT RAN OUT THE BACK DOOR OF THE PHARMACY. SHORTLY THEREAFTER, THE VICTIM WAS KICKED OUT OF THE PHARMACY BECAUSE OF HIS ACTIONS AS WELL AS THE UNKNOWN WHITE MALE’S ACTIONS. THE VICTIM STATED that THEY ENTERED BACK INTO THE VEHICLE, WHICH WAS DESCRIBED AS A FOUR DOOR PICKUP TRUCK, RED OR MAROON IN COLOR, AND BEGAN TO DRIVE WHERE HE THOUGHT WAS BACK TO MR GERARDI'S RESIDENCE. HE STATED that THE TRUCK TURNED INTO THE FOREST ALONG A DIRT ROAD, LATER IDENTIFIED AS TRAIL 9 AND TRAVELLED APPROXIMATELY SIX TENTHS OF A MILE TO AN AREA JUST OFF THE ROAD. AT THAT TIME, THE UNKNOWN WHITE MALE WEARING THE RED SHIRT WHO WAS THE FRONT PASSENGER OF THE VEHICLE, PULLED A FIREARM AND STATED “GIVE ME ALL YOUR MONEY, I CANT BELIEVE THAT WE WENT THROUGH ALL THAT FOR NOTHING”. THE VICTIM STATED that THE WHITE MALE CONTINUOUSLY POINTED THE GUN IN HIS FACE AND ORDERED HIM OUT OF THE VEHICLE. ONCE OUTSIDE THE VEHICLE THE UNKNOWN WHITE MALE FIRED TWO ROUNDS INTO THE GROUND AND DEMANDED ALL OF THE VICTIM'S PROPERTY. THE VICTIM STATED that HE TOLD THE UNKNOWN WHITE MALE THAT ALL HE HAD WAS THE $30.00 IN HIS FRONT POCKET THAT HIS WIFE GAVE HIM FOR THE MEDICATION AND $300.00 IN HIS WALLET. AT THAT TIME, THE UNKNOWN WHITE MALE DEMANDED THAT THE VICTIM TAKE OFF ALL OF HIS CLOTHING, TO INCLUDE HIS WATCH AND WALLET. THE VICTIM ALSO HAD APPROXIMATELY 54 XANAX PILLS ON HIS PERSON, WHICH WERE ALSO TAKEN BY THE UNKNOWN MALE. ONCE THE VICTIM STRIPPED DOWN TO HIS BOXERS AND ONE SOCK, THE UNKNOWN WHITE MALE STRUCK HIM ON THE LEFT SIDE OF HIS FACE WITH THE FIREARM AND THE FIREARM DISCHARGED AGAIN. THE VICTIM STATED that WHEN HE FELL TO THE GROUND HE SUSTAINED ADDITIONAL LACERATIONS ON THE RIGHT SIDE OF HIS FACE. AT THAT TIME, THE UNKNOWN WHITE MALE PICKED UP ALL THE VICTIM'S CLOTHING AND THREW IT IN THE BACK OF THE TRUCK, WHICH WAS DRIVEN BY A WHITE FEMALE WITH DIRTY BLONDE HAIR. WHEN THE TRUCK DROVE OFF, THE VICTIM WAITED AWHILE AND WAS EVENTUALLY FOUND EXITING THE FOREST. PURSUANT TO A "BOLO" FOR MR MICHAEL GERARDI, DEPUTIES LOCATED MR GERARDI AT THE WALMART IN INVERNESS. UPON SPEAKING WITH MR GERARDI, HE IDENTIFIED THE DEFENDANT AS MR JOSEPH CALCAGINO, AND GAVE US STATEMENTS SIMILAR TO THE VICTIM. HOWEVER, MR GERARDI STATED THAT HE STAYED INSIDE THE TRUCK AND DID NOT SEE THE GUN OR HEAR THE DEFENDANT FIRE THE GUN. ONCE THE DEFENDANT WAS IDENTIFIED BY THE WITNESS, A PHOTO LINE UP WAS TAKEN TO THE VICTIM. WHILE REVIEWING THE PHOTO LINEUP, THE VICTIM POSITIVELY IDENTIFIED MR CALCAGINO AS THE INDIVIDUAL WHO ROBBED HIM OF HIS PROPERTY AND STRUCK HIM IN THE FACE WITH A GUN. MR CALCAGINO WAS SUBSEQUENTLY LOCATED AT 625 SOUTH SCARBORO AVENUE IN LECANTO. MR CALCAGINO WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY; HOWEVER DUE TO HIS INTOXICATED STATE HE WAS TRANSPORTED TO CITRUS MEMORIAL HOSPITAL FOR OBSERVATION. ON 080214, AT 0558 HOURS, I WAS INFORMED THAT THE DEFENDANT WAS BEING RELEASED FROM THE HOSPITAL AND TRANSPORTED BACK TO THE CITRUS COUNTY DETENTION FACILITY ON UNRELATED CHARGES. I RESPONDED TO THE CITRUS COUNTY DETENTION FACILITY AND CONTACT WAS MADE with the DEFENDANT. I INFORMED THE DEFENDANT OF HIS CHARGES AND ASKED IF HE WISHED TO SPEAK WITH ME. THE DEFENDANT INVOKED HIS RIGHTS AND COMMUNICATIONS CEASED. THE DEFENDANT WAS ARRESTED AT 0749 HOURS, AND HIS BOND WAS SET AT $60,000.00. $50,000.00 FOR ARMED ROBBERY AND $10,000.00 FOR AGGRAVATED BATTERY with A FIREARM. THE DEFENDANT WAS TURNED BACK OVER TO THE CITRUS COUNTY DETENTION FACILITY STAFF.
