SUBMITTED BY: BLAIR, ED 0469 (13-169884) (AR13-8379) ON 121113, AT APPROXIMATELY 1542 HOURS, DEPUTY CASALVIERI WAS DISPATCHED TO 3609 NORTH TIMOTHY TERRACE, BEVERLY HILLS, IN REFERENCE TO A VEHICLE BURGLARY WHICH HAD ALREADY OCCURRED. UPON HIS ARRIVAL, HE MADE CONTACT WITH THE VICTIM, MR LARRY JOHNSTON. THE VICTIM ADVISED THAT SOMETIME BETWEEN THE TIMEFRAME OF 121013 AT 2230 HOURS, AND 121113 AT 1542 HOURS, PERSON OR PERSONS UNKNOWN HAD ENTERED THEIR UNSECURED VEHICLE AND TAKEN CHANGE FROM THEIR ASHTRAY. THE VICTIM STATED THAT IT SEEMED THAT THE SUSPECTS HAD TAKEN MOSTLY QUARTERS, AND HAD MADE AWAY WITH NO MORE THAN $4.00 IN CHANGE. HE STATED THAT HE HAD FORGOTTEN TO LOCK THEIR VEHICLE THE NIGHT BEFORE. THE VICTIM STATED THAT THEY CONTACTED THE CITRUS COUNTY SHERIFF'S OFFICE TO REPORT THIS AFTER LEARNING THAT THEIR NEIGHBORâS VEHICLE HAD BEEN BURGLARIZED AS WELL. ON 121113 AT APPROXIMATELY 0700 HOURS, DEPUTY LAHERA RESPONDED TO the SHELL STATION LOCATED AT THE INTERSECTION OF CR 486 AND CR 491 AFTER LEARNING A WALLET FROM A NEAR BY BURGLARY WAS FOUND IN THE PARKING LOT. THIS DETECTIVE REVIEWED THE SURVEILLANCE FOOTAGE AND WAS ABLE TO IDENTIFY THE DEFENDANT IN THIS CASE AS A SUSPECT WHO MAY HAVE DISPOSED OF THE WALLET. DEPUTY MIKE BERRY IDENTIFIED THE DEFENDANT BY NAME AS ONE OF THE TWO SUSPECTS ON THE SURVEILLANCE FOOTAGE. DEPUTY BERRY WAS FAMILIAR WITH THE DEFENDANT FROM PREVIOUS DEALINGS. WITH THE ABOVE LISTED INFORMATION, THIS DETECTIVE RESPONDED TO 490 SOUTH EASY STREET IN LECANTO. UPON ARRIVAL, THIS DETECTIVE SPOKE with the DEFENDANT REGARDING THIS CASE. THE DEFENDANT WAS ADVISED HE WAS NOT UNDER ARREST, TO WHICH HE STATED HE UNDERSTOOD. THE DEFENDANT WAS ASKED IF THE EAR BUD HEADPHONE SHOWN IN THE VIDEO SURVEILLANCE WOULD HAVE COME FROM ONE OF THE BURGLARIES. HE STATED THAT THEY HAD AND THE CO-DEFENDANT, NICHOLAS EDMONDS GAVE HIM THE EAR BUDS BECAUSE HE DID NOT HAVE ANY FOR HIS PHONE. THE EAR BUDâS WERE REPORTED STOLEN FROM A VEHICLE BURGLARY AT 1 HOOVER WAY IN BEVERLY HILLS. tHE DEFENDANT REQUESTED TO SPEAK WITH THIS DETECTIVE IN PRIVATE, AS HIS FATHER WAS PRESENT. HE WAS ASKED TO SIT IN THIS DETECTIVEâS AGENCY VEHICLE AND TRAVEL A SHORT DISTANCE AWAY FROM HIS HOUSE. THIS DETECTIVE DROVE THE DEFENDANT TO A NEARBY LOCATION, WHERE HE WAS ADVISED OF HIS MIRANDA WARNINGS VIA PRE-PRINTED CARD. THE DEFENDANT ADVISED HE UNDERSTOOD AND WOULD SPEAK WITH THIS DETECTIVE. THE DEFENDANT ADMITTED TO DRIVING THE CO-DEFENDANT, NICHOLAS EDMONDS TO SEVERAL LOCATIONS WITHIN THE COUNTY TO COMMIT BURGLARIES. THE DEFENDANT RECALLED PARKING BEHIND THE DOLLAR GENERAL IN BEVERLY HILLS. FROM THERE, THE CO-DEFENDANT WALKED THROUGH A PATH TO WASHINGTON STREET NEAR 1 HOOVER STREET WHERE THE EAR BUDS WERE STOLEN ALONG WITH OTHER ITEMS. THE DEFENDANT ADMITTED TO WALKING TO THE PATH AND CARRYING ITEMS BACK TO HIS CAR FOR THE CO-DEFENDANT. THE DEFENDANT RECALLED DRIVING THE CO-DEFENDANT TO CIVIC CIRCLE IN BEVERLY HILLS. WHILE THERE, THE CO-DEFENDANT COMMITTED A FEW BURGLARIES. THE DEFENDANT ADMITTED TO HAVING KNOWLEDGE THAT THE CO-DEFENDANT WAS COMMITTING THE BURGLARIES AND THAT HE received CHANGE STOLEN DURING THE BURGLARIES TO PAY FOR GAS. THIS DETECTIVE DID REVIEW THE SURVEILLANCE FOOTAGE OF THE GAS PURCHASE, DURING WHICH THE DEFENDANT PAID FOR THE GAS WITH SEVERAL COINS. FOR THE PURPOSES OF THIS AFFIDAVIT, CIVIC CIRCLE IS WITHIN A SHORT WALKING DISTANCE FROM THE VEHICLE BURGLARY LOCATED AT 3609 NORTH TIMOTHY TERRACE. DURING THE SAME INTERVIEW, THE DEFENDANT ADMITTED THAT STOLEN PROPERTY WOULD BE LOCATED IN HIS MOTHERS VEHICLE THAT WAS USED DURING THE EVENING. THE DEFENDANT STATED SHOES FROM ONE OF THE BURGLARIES WERE IN THE BACK SEAT OF THE VEHICLE AT THEIR RESIDENCE. THIS DETECTIVE LATER RETURNED WITH THE DEFENDANT TO HIS RESIDENCE. UPON ARRIVAL, IT WAS LEARNED THE DEFENDANTâS FATHER LEFT WITH the VEHICLE TO PICK UP HIS OTHER CHILDREN FROM SCHOOL. THIS DETECTIVE DROVE THE DEFENDANT TO MEET WITH HIS FATHER TO TURN OVER the STOLEN PROPERTY ON EDUCATIONAL PATH IN LECANTO. WHILE THERE, THIS DETECTIVE COLLECTED THE GREY/BLACK WRESTLING SHOES AND A SECOND SET OF SHOES FROM THE VEHICLEâS REAR SEAT FLOOR BOARD. AT THE TIME OF THIS COLLECTION. THE SHOES DID NOT MATCH THAT OF ANY REPORTEDLY STOLEN ITEMS FROM CASES THIS DETECTIVE WAS ASSIGNED. IT WAS LATER LEARNED THE SHOES WERE STOLEN FROM A VEHICLE BURGLARY LOCATED AT 1209 EDEN DRIVE IN INVERNESS. THIS CASE WAS ASSIGNED TO ANOTHER DETECTIVE. THIS DETECTIVE DID NOT ARREST THE DEFENDANT AT THAT TIME, AS THIS CASE NEEDED ADDITIONAL INVESTIGATION. THIS DETECTIVE LATER SPOKE WITH THE CO-DEFENDANT IN THE CASE. DURING THE TAPED INTERVIEW, THE DEFENDANT ADMITTED TO BEING A PASSENGER IN THE DEFENDANTâS VEHICLE AND PARKING NEAR CIVIC CIRCLE TO BURGLARIZE NEARBY CARS. THE DEFENDANT ADMITTED TO GOING THOUGH A VEHICLE AND PICKING OUT ONLY SILVER COINS FROM ONE OF the VEHICLE. THE STATEMENTS ARE CONSISTENT WITH THAT OF THE REPORTED QUARTERS MISSING FROM THE VICTIMâS VEHICLE. WITH THE ABOVE LISTED INFORMATION, THIS DETECTIVE SPOKE WITH the DEFENDANT VIA TELEPHONE. THIS DETECTIVE REQUESTED TO MEET WITH THE DEFENDANT TO SPEAK ABOUT THE CASE. THIS DETECTIVE DID ADVISE THE DEFENDANT THAT CHARGES EXIST AND HE WOULD BE ARRESTED. THE DEFENDANT COOPERATED AND MET WITH THIS DETECTIVE A THE SHERIFFâS OFFICE EMERGENCY OPERATION CENTER FOR THE INTERVIEW. THE DEFENDANT COMPILED AND ARRIVED AT THE MEETING LOCATION PROMPTLY. THIS DETECTIVE THEN COMPLETED A RECORDED INTERVIEW WITH DEPUTY PHILLIPS ASSISTANCE. DURING THE INTERVIEW, THE DEFENDANT ADMITTED TO DRIVING THE CO-DEFENDANT TO THE VARIOUS ABOVE LISTED BURGLARIES. AFTER THE INTERVIEW, THE DEFENDANT WAS ADVISED HE WAS UNDER ARREST FOR BURGLARY. HE WAS LATER TRANSPORTED TO the CITRUS COUNTY DETENTION FACILITY FOR BOOKING. DUE TO THE DEFENDANTâS LEVEL OF COOPERATION, HE WAS LATER RELEASED ON HIS OWN RECOGNIZANCE. |
